Women need to raise a class action

... to ensure that misogynist males with grievances against them cannot abuse the police and court system to cause suffering, stress and harassment.

I know nothing about the law, can anyone advise?

Is it feasible to do this?

I'm in Scotland.

I'm glad Marion Millar's case was dropped, but more needs to be done. We can't allow the system to be abused and used to target and harass women like this.

It's already happened far too often.

Marion Millar
Ceri Black
Posie Parker
Caroline Farrow
Kate Scottow
Linda Bellos
Venice Allan

This has to stop. The law is not meant to be there to harass women. The law should be there to protect women from harassment.

I agree OP, it's scary how many of these ridiculous cases have been given legitimacy by the police. It is definitely being used as a way to intimidate and harass women.

I am starting to think that there will end up being a war of the sexes or something, because there needs to be huge pushback against government and institutions who allow stuff like this to go on, it is always to the detriment of women. We are going to have to fight tooth and nail to get any sort of fairness and they won't listen until we make a huge fuss and wake people up to what is happening right under their noses.

Along with the Police spending far too much time painting rainbows on cars and investigating scary ribbons, we have the Equal Treatment Benchbook which is problematic once a case actually gets to court.

Marian could make a complaint to the Scottish Police Investigations and Review Commissioner. I really hope she does. Although my confidence in their impartiality is not good.

endofagain · 28/10/2021 15:38

I said on the other thread that I would be happy for my donation to Marion's case to be used to sue, and I would be prepared to donate again for some sort of class action. Because this is going to keep happening as long as certain people are getting away with it.

nauticant · 28/10/2021 15:12

The context for the comments is that there are things, for example policies, which are lawful but cause harm. Judicial reviews are not necessarily the right way to proceed because they can be successfully used against things which are unlawful. In such cases a judge might say that the best way to proceed is for individuals to make their individual claims in respect of the harm they've suffered.

Manderleyagain · 28/10/2021 15:05

Excuse my naivety does that mean specifically the women who have been arrested on bullshit charges?

No I don't think it was specifically in reference to trumped up charges. When AEA tried to bring a judicial review against the ehrc for their guidence on single sex spaces the judge said individual womem should sue to show they were discriminated against. I think the prison judicial review (which failed) said the same.

It could be my echo chamber only giving me certain news, but there really does seem to be a pattern of political opponents using the police against gender critical feminists, and the police allowing themselves to be used that way. But who would a class action be against? They are all different police forces, and the cps has usually said not to prosecute. Linda Bellos' case was a private prosecution, and the cps stepped in belatedly to put an end to it.

I don't know how best to approach it.

Isthatthebestyoucando · 28/10/2021 14:16

Judges have been hinting through several cases now that direct cases need to be brought by women.

Yes Arabella I feel exactly the same, this cannot be allowed to continue. Instead of fighting to defend ourselves across many divided fronts we need to get together and fight back in a concerted effort to bring changes to the legal system, so that it can no longer be used to punish those who defy male entitlement.

I'd also very much like to see one of the people who have been using the police as their own enforcement squad (to bully and silence uppity women) facing legal consequences to their actions. They've been allowed to waste everyone else's money, the tax payer and the defendant, while they sit back, smirking and hunting for their next victim online.

FOJN · 28/10/2021 14:03

Mr Paisley is currently pursuing a similar case against a feminist lesbian in N Ireland. He should be facing charges himself for harassment

Did anyone notice this in the comments section on The Herald article?

Artichokeleaves · 28/10/2021 13:46

As I remember, less than 5% make it to court. CPS are far more enthused about possible female wrong think tweets than serious sexual assault.

Carboncheque · 28/10/2021 13:44

Actually, what % of reported rapes are actually prosecuted?

Carboncheque · 28/10/2021 13:43

How man women are threatened online with rape and physical violence every day? How many of those cases do they even record let alone prosecute? Usually the women are given advice to stay off social media.

Some complaints are obviously much more important than others.

Artichokeleaves · 28/10/2021 13:41

No, not biting at disingenuous attempts to get everyone to stop talking about raising a class action for women to stand up to weaponisation of court process and argue with them about reading comprehension instead.

Petitions and open letters are everywhere and are meaningless with electronic signatures. Judges have been hinting through several cases now that direct cases need to be brought by women.

TonyThreePies · 28/10/2021 13:39

Should we do one of those open letters? Encourage everyone to sign.

Just show me the dotted line.

Isthatthebestyoucando · 28/10/2021 13:39

@BlueberryCheezecake

A class action to achieve what exactly. Women being exempt from consequences if they break the law?
No men not using the police as a tool to harass women who don't adopt one particular ideology.
nauticant · 28/10/2021 13:39

Who has broken the law?

@ScreamingMeMeSawUs

Would writing to Priti Patel/AN Other be helpful?

@CruellaDeVilla

“More evidence piling up that the UK is monstrously and fundamentally misogynist right to the very core of its court, policies, government and basic civil rights. It is all unequally stacked against women, the evidence is everywhere. Past time for half the electorate to be a bit less ladylike about it.”

I totally agree.

Yep.

Which is, very likely, a much more satisfying and publicly face saving outcome than Marion getting this heard in a court room where it is publicly unpicked, discussed and the full gory details expressed.

By which, to be very clear: I mean the general public would have wondered wtaf the Scots govt thought it was doing, and the embarrassed party would have been the complainants.

Artichokeleaves · 28/10/2021 13:20

@Datun

See anyone who has been following this will just be hearing more of the same.

We know we don't have a case, but we want you to feel intimidated anyway.

I'm with you Arabella and will do whatever I can to help. This is a new and fun way to abuse females for daring to not do what misogynists tell them, and the court system in this country should not be permitting themselves to be weaponised for petty coercive abuse and control.

Although goodness knows the many thousands of women who have been trying to get the family courts to stand up to misogynist men using court proceedings to continue being able to abuse them after they have escaped would point out they've been trying for years.

ChattyLion · 28/10/2021 12:36

Happy to write to whoever would be the most effective to appeal to. Agree this is harassment, totally unacceptable.

LizzieSiddal · 28/10/2021 12:01

I agree we need some kind of class action, it’s pure misogyny and misinterpretation of the actual law ENTIRELY due to lies from Stonewall, who have “advised” the police.

Is it Stonewall who needs suing?!!

The process is the punishment.
ArabellaScott · 28/10/2021 11:13

yes, nauticant, although Marion was prosecuted under 'malicious communications'. We haven't even GOT to the new shiny 'hate crime' bill yet.
