The court will try the case, assuming it isn't thrown out. If it comes to it, the prosecution must prove, beyond reasonable doubt, that whatever it was that MM did caused alarm and distress to the parties, and that she intended this and/or was reckless as to whether it would.

It will be for the court alone to determine this, subject to a potential appeal.

Let us wait and see what happens.

So the original charges weren't strong enough in the end and then the situation was ballsed up by posting about the police officer involved, and that does seem to be sticking? (Well court case pending, granted.)

That really is snatching defeat from the jaws of victory.

It's the police and CPS (or Scottish equivalent, sorry) desperately trying to salvage their reputation after being made fools of.

Obviously you won't want to see that but it's quite blatant.

I asked for a source for the potentially defamatory accusation from jay and all he/she could reply with was a tweet from Marion?

I haven't posted any tweets. I asked what Jaysmith's source for her claims was and she was the one who posted a tweet.

and you decided that tweet was the one referenced in the allegation of a potentially defamatory accusation against a police officer, this is what you said:

Ergo you are stating as fact that Marion has been charged over the tweet that Jaysmith posted.

All of this is for the court to determine.

I report what others have said. It is a fact that they said it. To accuse them of lying without evidence is defamatory.

We have no idea whether or not MM's accusations about the officer are the alleged 'false information.'

We know that PC Gul denied Harry Miller's claim that he spoke about needing to 'check your thinking.' Harry had this in contemporaneous notes, like the good ex-copper that he is.

MM wrote her tweets about the arrest shortly afterwards. Is it now an allegation that she fabricated the whole thing motivated by the fact the officer was gay before knowing this was the case?

As people keep saying, the process is the punishment. Regardless of what happens in court her life has been hugely impacted, and a very strong message has been sent to women.

And isn't it interesting that this alleged offence happened after she was first spoken too, and the apparent hundreds of homophobic/transphobic tweets receive no mention at all... Almost as if they were struggling for something that would stick...
