I struggled to even come up with a title for this thread as I am so enraged I know I will get deleted and even banned if I say what I really think.

One of the problems with legal challenges is they are so expensive. For women scotland has one on the go. It's cost so much already.

SuperLoudPoppingAction · 03/05/2021 15:12

The equal boards legislation has a strange definition of what a woman is, but the way Scots law works, you can't extrapolate from that to other legislation afaik

stumbledin · 03/05/2021 15:09

Upthread someone posted the link to the archive application pack which included the phrase statement about being women only under the EA (although web page didn't say this).

So there may be two different things going on here. One of which is, I thought Scotland had effectively changed the definition of what a woman was in relation to ??? being discussed in the Scottish Parliament.

Alternatively the implementation of women only is where it is shown there is a genuine need for this. Could this mean that the advertisers, ie ERC could say well in fact given the "experience" of the candidate we dont need to evoke the genuine need as this candidate has shown it isn't necessary.

But either way I think they should be challenged for false advertising. I wonder is any other applicants would be willing to do so?

But overall this is part of the push by those who want to make it a fact that self identity is as valid as being born female.

So this isn't just about the individual who wants to show this / be this but about all those around who are willing to be part of it.

And it seems Scotland has gone far further than any other part of the UK.

I hope there is a legal challenge rather than some twitter spat which 90% of the population will never see.

SO racist. At some point these woke idiots will understand why.

You're more optimistic than me!

AvocadoBathroom · 03/05/2021 14:49

@FightingTheFoo

Incredible that they carve out "BME" women with trans women.

It is SO racist! It is just so fucking racist. And dehumanising.

BME women are still WOMEN you fucking muppets. They don't need to be carved out into a separate group with people who are not biological women.

SO racist. At some point these woke idiots will understand why.
thepuredrop · 03/05/2021 14:40

Though I take the point already mentioned by others, that discrimination on the basis of gender is more appropriate as a sex-based suit would fail.

thepuredrop · 03/05/2021 14:36

I hope a man who could have applied, but didn’t because of the single-sex exception invoked, sues for sex-based discrimination. Unfortunately no-one will take the female applicants’ or service users’ concerns seriously.

HermioneWeasley · 03/05/2021 14:35

Don’t know why my post was deleted - I was very careful to say “male”

Can anyone archive this please?

PPs have already linked to the older Wings Over Scotland pieces about this individual, but new excoriating one up on the whole mess.

What it is to be kind

So we’re making a plea from the heart. Spoil your constituency paper, readers. For children, for women, for gay people, for Scotland and for kindness.

Jaxhog · 03/05/2021 13:59

@transsloth

Amazing, isn't it, how a male woman was the very best candidate for being the CEO of a rape crisis centre.

Male humans really are better at everything than female humans, aren't they?

I just wonder what the last 45 years has really been for? We've gone from my not getting a job because 'the men won't like it' to a male person as CEO of a rape crisis centre. Feels like a huge step backwards.

I guess men really got on board with the 'if you can't beat them, join them' idea.

SuperLoudPoppingAction · 03/05/2021 13:57

I've seen MC laugh about 'terfs'.
Really would not be voting for her tbh. Mind you, people generally don't.

Edinburgh Rape Crisis' chief operating officer is Maggie Chapman who used to be co-convener of the Greens before the even nuttier Lorna Slater took over. She is standing as a candidate again this year. This is the wonderful Joan McAlpine asking her if she thinks women can have penises.

@BuffysBigSister

I'm not a lawyer, but if you were a female who applied for the role and didn't get it, then found out it was given to a male even though the EA2010 exemption was called out in the advert - would you have a legal case of any kind?
As MW doesn't have a GRC they are considered male for the purposes of sex discrimination in the Equality Act 2010. So for example a better qualified woman overlooked for the job would be able to point to MW as a male comparator in arguing there has been sex discrimination. It would be good old fashioned sex discrimination where a woman is treated less favourably than a man.

I haven't get got my head around the legal effect if any of the purported reliance the Genuine Occupational Requirement exception except that it may mean that a better qualified man who was overlooked for the job might have a claim for discrimination on the grounds of (lack of) gender reassignment.

A country that cannot give a raped woman whatever the fuck she wants to make her circumstances a bit less shit is not a civilised country.

I suppose the only consolation is that funding is being pulled from women's shelters in Scotland. Perhaps Mridul will be out of a job soon.

We need to rebuild our self funded shelters, don't we? Start again.

KeepPrisonsSingleSex · 03/05/2021 13:37

I am concerned that the Board members have the bare minimum of experience in this sector.

www.ercc.scot/about-us/meet-the-team/

So many necessary skills and experience is wholly absent. This leaves the organisation in a precarious position in terms of the ability to risk assess and put in place & maintain safeguearding.

Ereshkigalangcleg · 03/05/2021 13:34

When similar happened in Canada (and the key difference was that the organisation said no) it led to 12 years of court battles:

ArabellaScott · 03/05/2021 13:32

@Gibbonsgibbonsgibbons

So should men just turn up for women only jobs in their kilts from now on? Violent threats/images on your twitter no problem either apparently.

AngryAngryAngry

Ah, yes, Mridul posted the image of a goddess beheading their enemies on Twitter shortly after some horrific beheading incident, iirc.
LostToucan · 03/05/2021 13:31

@justaftb

Wow. The advertisement for the role explicitly says:

'Only women need apply for the above posts under Schedule 9, Part 1 of the Equality Act 2010.'

The only women who matter anymore are women that have a penis. They matter more than women who have been violently sexually assaulted.

Interestingly, the women only requirement wasn’t on the ERCC website job advert. Maybe it was stated in the application pack (link to that no longer works).

ItsAllGoingToBeFine · 03/05/2021 13:25

This was Joan's tweet at the time. I remember seeing MW's reply claiming it was involuntary

Thankyou. It really does seem that this individual is unsuited to the job regardless of their sex.

ChakaDakotaRegina · 03/05/2021 13:21

@ConfusedAdultFemale

“Gender” based violence? Let’s call it what it is in the very least ffs.
Yep. Sex based.

If we cannot talk about sex we cannot tackle sexism and sex based violence.

eurochick · 03/05/2021 13:20

I did a sharp intake of breath when I saw the reference to BME women after trans. It's incredibly racist.
