Sorry, this thread (brilliantly!) updated lots while I was typing. I found the FiLiA piece really helpful a couple of years ago, so went and found it to use as a template - meanwhile, the rest of the vipers were on the case, so no need to after all.

I so desperately hope that this review succeeds. How the hell is this the world we inhabit.

There's a very big problem with this judge. Isn't it very fucking suspicious when these judges (because this has happened far more frequently than it ever should have) basically condone paedophilia and rape?

I'm sorry but how did we get to the point that raping a child doesn't result in a jail sentence?!

That is sickening. Benefit cheats get sent to prison (don't approve of that but it isn't the same as this) but this b*stard gets off. Poor child and mum.

Yes, you can appeal unduly lenient sentences. (This is edited from a FiLiA piece a while ago, on another horribly lenient sentence, which I used as a template. Thank you to FiLiA.)

I am writing to request that you review the sentence handed down to Callum Haycock at Worcester Crown Court on 1st October, for the rape of a five year old child. This 21 year old man did not plead guilty, and therefore subjected a five year old to providing witness evidence at the trial of her own rape. He was sentenced to just three years of community service, with five years on the Sexual Offenders Register. There was no custodial sentence.

This sentencing level is grossly inadequate for an adult convicted of extreme sexual violence towards a very young child. It does not begin to reflect the seriousness of the offence, it cannot serve as any deterrent to others, and it does not even adequately provide for proper levels of oversight and monitoring in the years ahead. I therefore believe that this sentence is unduly lenient. I ask that this case is referred to the Court of Appeal.

These things have a lot more sway if the wording is personal, so please do write your own email if you have time, or stomach, to do so. This mother, and above all brave little girl, so deserve our solidarity.

If the mum is on Mumsnet: we send love and outrage in equal measure. Your little girl is the bravest of the brave, and it's horrific that a judge let her down so horrendously badly. I very much hope that the Appeal Court do review this, and ensure justice is done.

looking at the list where you can track whether this case gets referred to the Court of Appeal (the link was in the autoreply from the AG office), there are sentences of 2 years imprisonment for conspiracy to commit burglary being handed out (I'm not sure if the appeal is for unduly lenient or excessive) but that judge thought that 2 yrs was appropriate for planning a burglary and another judge thought that a 3 yr Community Order (please let that mean something waay worse than it sounds) was sufficient for raping a 5 yr old child!!

At the criminal bar here. Usually reluctant to comment on cases I know nothing about but this looks unduly lenient.
The fact he pleaded not guilty and was convicted at trial at which the young child was required to give evidence means. I credit for pleading guilty etc. So it looks event more odd.
If he had spent time in custody then obviously that would be taken into account eh if he’d been in for 6 months awaiting trial that’s equivalent to a 12 month sentence of imprisonment - sometimes that is behind what seems a very low sentence.
One other thing which can be involved is assistance to police which of course if it were a feature may not be able to be mentioned during sentencing remarks. The judge will have given extensive sentencing remarks partic because this is a sentence at first blush outside of the sentencing guideline.
All very odd. Very low sentence. Very difficult for the family to deal with. Would think the cps will appeal it. If they don’t then there may very well be something behind it all which can’t be disclosed.

Sadly this is common in Worcester courts pedophile given a two years suspended sentence told no socialising with under age children must report if he has a car and keep the police appraised of his address caught with a 12 year old in his car who admitted she had been into his flat (the police believed he lived in his parents house elsewhere in the district) back to court ANOTHER two year suspended sentence he was serving 2/3 consecutive suspended sentences at one point

Surely the guidelines must include a custodial element?

What do we know about the judge that presided over this case? Are they known to be lenient? Are they following sentencing guidelines

When you think of the low conviction focused for rape - this basically says ‘You will get away with it’.

How can such a crime have no custodial sentence? Raping a child - for the love of the wee man, how can this go unpunished?

Luckily, the newspaper report gives all the relevant information required by the Attorney General for the review request but I would have bloody well trawled the court records if not.
