To the PP in law who suggested there might be "something else" going on that would reduce sentence that couldn't be reported on, what sort of thing might that thing be? He isn't underage or related to the victim.

SchadenfreudePersonified · 15/10/2020 19:09

@FairFriday

Surely the guidelines must include a custodial element?
You would think so, wouldn't you? Raping a child - though if he was placed in custody, what's the odds it would be a woman's prison?

Bloody disgusting all round.

I'll be writing, too.

SorryAuntLydia · 15/10/2020 19:08

@ErrolTheDragon

Are there any other reports which give any idea why this ludicrous sentence was applied to such an awful crime?
Local FB seems to suggest the criminal has some sort of learning difficulties. Would be helpful to learn more as the sentence is so extremely lenient. IANAL so I’m not clear how this would impact on sentencing- but would assume that if he is capable of rape, capable of giving evidence in a court, then he has the capacity to know right from wrong and to control his own behaviour. So I’m not sure how these alleged learning difficulties would be mitigation.

I am gobsmacked by this sentence and vv angry. I will also write.

Justasecondnow · 15/10/2020 19:08

I don’t think we know date of offence do we?

I wonder how old he was at time of offence? If perhaps he was a child and perhaps a victim of sexual abuse himself. A possible circumstance that could account for the exceptionally lenient sentencing. Pretty shocking sentence without some extraordinary back story.

DishingOutDone · 15/10/2020 19:07

Oh hang on, I see @20mum is suggesting medical castration. Well, yes, that AND a custodial sentence so that mum can say to her DD "he can't hurt you now".

Aridane · 15/10/2020 19:07

Thanks, @Kantastic, for expanding what TW meant in this context

Aridane · 15/10/2020 19:06

I cant find then judge's comments anywhere. The judge usually gives some remarks explaining their sentence, but I cant find them published anywhere.

Has anyone got a quote?

I can’t find anything g either

That poor little girl, is that all they think she’s worth

howard97A · 15/10/2020 18:59

This makes me wonder about the judge. Why be so lenient?

I think it’s worth remembering that a judge is not entitled to pass any old sentence that he personally thinks is appropriate. He has to follow the Sentencing Council Guidelines.

Section 174 of the Criminal Justice Act 2003 imposes a duty to give reasons for, and explain the effect of, the sentence. Unfortunately the reasons for this sentence are not reported in this article, but as the the sentence range for this offence is 6 – 19 years custody the circumstances of this case must have been wholly exceptional.

@Kantastic

Am slightly baffled by the TW in the OP's title though - can't see relevant reference in the DM article, have they edited it out

TW means "trigger warning" in this case!

I was baffled too - I would suggest the op asks for the title to be amended for clarity.
Aquamarine1029 · 15/10/2020 18:54

How long until this monster claims another victim? There will be more victims, I have no doubt. Absolutely sickening.

Dawnlassie · 15/10/2020 18:52

That is horrific. Judge needs to be sacked asap.

User478 · 15/10/2020 18:50

She will still be underage when he comes off the sex offenders register.

Makes me sick.

Kantastic · 15/10/2020 18:48

Perhaps put your thoughts on a different thread @20mum? I'd hate to see this one derailed from activism to achieve justice for this little girl.

Dagnabit · 15/10/2020 18:47

This is my home town Sad. There is no justice in this; that poor family. Not that I approve as such but his details are plastered over our local FB page and if he stays here, his life will be pretty miserable.

wellbehavedwomen · 15/10/2020 18:46

@Straven123

I would think you need to put your name address and phone no if you email. Thanks for Centre of Womens Justice link, I can donate some of the money I'm not spending thanks to Covid!
Yeah, it's one of our monthly standing orders, and it makes me feel a little less powerless. Just wish we could give more. They are bloody brilliant - they're also supporting some of the women suvivors of the child grooming gangs, in one case to get her convictions for being an underage rape victim who complained too aggressively when seeking police help expunged from the record (I really, really wish I were joking). They also supported Emily Hunt, the woman told by the CPS that her rapist had every right to film her, naked, without her knowledge, because as she couldn't prove the rape to their satisfaction (they never charged him) it was completely his right to do that to her, as (presumed) consent to sex equalled consent to filming anything at all during the time in question, even without knowledge. She had to go to Judicial Review to force the CPS to accept that consent in relation to voyeurism is an oxymoron. They've also been at the forefront of the fightback against rape complainants having every single part of their digital life made available to police and assailant.

Whenever I see a case where women are combating inequality, I expect to see their names. Because usually, there they are.

BaronessWrongCrowd · 15/10/2020 18:46

I'll be writing in the morning.

TW = Trigger Warning @Fairineouf

20mum · 15/10/2020 18:43

After researching a great deal, many years ago, I reached a conclusion that almost all prisons do no good. Not, I hasten to stress, because people like this are best left wandering around. This week or last, radio 4 had a feature on some senior and sensible person who advocated closing most prisons, because they cannot make sense.

A lot of the people in them are more victim than villain. (A large proportion were abused, unwanted, neglected babies, and went despairingly on from there) There are inadequate, bewildered, hopeless, mentally ill, drug addicts. The literacy rate is low. After a conviction, they have little realistic chance of anything but crime.

It interested me that treating people like humans tends to make them behave better. Scandinavians apparently put fewer people in prison, but they are likely to get treatment and support aimed to change their behaviour. They are keen to have child and partner friendly meeting places and even conjugal visits, since they know a prisoner's continued contact with any family will be the best assistance to keeping on the right path after release. A minority of course need to be kept away from the public permanently.

The expert on radio 4 advocating closing prisons didn't mention hormones, but it had fascinated me that there's a direct correlation with testosterone levels and violence, even for women. It was long ago, but as I remember, the Scandinavian model included an option for rebalancing hormones, and also the option for those whose sexual interests were criminal, and not controllable, to choose to have medical assistance to ensure they had no interest in sex. It would seem sense to give the opportunity, because truly there is not the faintest chance that locking a man up, then letting him out, will change his sexual preferences. Once a danger, always a danger,(and a man of 70 80 or 90 who wishes to do something, and has the opportunity to do it, is still a danger)

Coldhandscoldheart · 15/10/2020 18:42

@Fairineouf TW = trigger warning. Not the other.

BaronessWrongCrowd · 15/10/2020 18:40

@Fairineouf

Anyone know if there's a petition for this? Have looked and can't see one. Absolutely horrendous, I can't imagine what the family must be going through. Perhaps this would be better moved to AIBU to get more people to write in and complain?

Am slightly baffled by the TW in the OP's title though - can't see relevant reference in the DM article, have they edited it out?

TW stands for trigger warning.
