I don't think it's pretty clear. Lots of people still describe their children as little girls even when they're 10 or 12. The fact her mother described her as a brave little girl tells us nothing except that she's not an adult.

Don't forget that the court could have been sitting quite a while ago too and the sentence has only been passed now; the child could have been giving evidence years ago. Budget cuts (and now Covid) mean our court system is struggling immensely at the moment; many people wait years for cases to be heard.

I am guessing - I do not claim to know since the date the crime was committed has not been released and I have not been able to find any sentencing remarks - but I think it's entirely possible this crime could have been committed 5 or 6 years ago, which would put the offender in the 14 - 16 age bracket.

It is one possible explanation for the light sentence.

@KnightsofColumbusThatHurt

The paedophile, who was found guilty of raping a child under 13 at Worcester Crown Court on October 1, was sentenced to a three-year community order and 35 days' rehabilitation requirement.

He was also fined £200 and ordered to pay £2,500 to the victim as well as being put on the Sexual Offenders' Register for five years.

Whaaaaaaaaattttttt?

I don't understand this? What is the justification for such a lenient sentence?

I have no words.

I shall find some pithy ones in the morning though!

Brave little girl to testify then for a judge to do this 😢

Oh crap - his picture and full address has been published by news outlets. Cue vigilante ‘justice’
I think I would find it hard to care if the girl's family or community took the matter into their own hands. I don't think it's right, but nothing about this situation is right.

I've written to the AGO. Like many others, I did the same when the Natalie Connolly sentence was handed down. They didn't care. I am struggling with this quite a lot. That poor girl.

@GrumpyHoonMain

The mum still calls her a little girl. I'm willing to bet my house that this isnt historic.

DespairingHomeowner · 15/10/2020 19:53

@equuscaballus

I have commuted on the train in the same carriage with this man several times. Mentally he does not have full capacity.

He takes his toys with him to play on the train and talks to himself.

Not sure why this isn't in the media.

@equuscaballus: thanks for bringing up this point, also raised by @HeronLanyon

There is clearly more to this story, it’s covered by Daily Mail FFS

Awful for child victim, but ‘judge is a paedo lover’ etc is a ridiculous stance : something clearly behind this re defendant too

And before any idiot claims I’m defending child rapists: far from it, was sexually assaulted as a child myself (not raped I’m thankful), it was taken very seriously indeed and I’m fully aware of damage to my whole family

Very unlikely. It would have to have been... 8/10 years ago or something, so the girl could be maybe 12/15ish or something now.

The comments from the mum dont track with that. Mum said the it has been hell, but all the support workers involved have bee fantastic. She also said the girl is now wetting the bed, and talked about her taking the stand and being so proud of it. It doesnt sound like something that happened to a young adult when they were a child and is only coming out now.[/quote]
I don’t really trust the DM with their reporting really. Wetting the bed can be normal even years after rape and sexual assault - a girl raped that young could have injuries consistant with child birth.

@GrumpyHoonMain

I imagine it was for a historic rape he did as a child himself. I can’t see any self-respecting judge dish this out otherwise.
The report doesn't read that way - the mother describes her DD in the present tense 'She's one of the bravest little girls I've ever met. '.

Lockheart · 15/10/2020 19:47

Assuming this crime happened when he was an adult and he has full mental capacity, this sentence is very strange.

I suspect that this is a crime he committed when he himself was a child (he is now only 21) and / or he does not have full mental capacity.

T33l9 · 15/10/2020 19:43

Thank you for highlighting this. I am sickened Sad

What the fuck is wrong with the world, you can go to prison for council tax arrears but are allowed to walk free after being convicted of raping a small child.

I hope the bastard drops dead.

Rapunzathepenguin · 15/10/2020 19:41

Good God. Even if there are questions over his mental capacity, surely for the safety of other children he should be put in a secure unit? For life? What on earth is wrong with Worcester?

I will also be writing; I'm just waiting for my password to come through for basic membership of the lawpages site so I can make absolutely sure I've got the correct details.

That poor little girl and her family.

RedDiamond · 15/10/2020 19:38

Can I just say to everyone that I am absolutely HORRIFIED. I just cannot get my head around a non custodial sentence unless there is something else there. What Judge in their right mind would not give a custodial sentence? And I am sure the Mother of this little girl would have been shouting from the roof tops that the reason there was not custodial sentence was because of other mitigating circumstances. So there cannot be any other mitigating circumstances.

@Aridane

When a countries justice system breaks down to the point where it is not delivery justice, is vigilantism all that wrong? If it brings on reform?

WhereverIGoddamnLike · 15/10/2020 19:33

@RedDiamond

He has been convicted. He was found guilty after a trial.

The issue is the punishment. He needs to pay £2700, will be on the sex offenders register for 5 years (should be life) and has to do community service. For raping a child. It's awful.

TheShepherdsCrown · 15/10/2020 19:33

My heart is breaking for the child and her family. I hope her mother wins an appeal. And I hope that this family get the ongoing support that they need after such a horrific ordeal.

RedDiamond, but a mental or neurological disorder doesn't mean you basically get off. It's why we have secure mental health facilities like broad moor. I don't think anyone would argue that he should not be removed from society in order to protect other children, even if prison isn't the right place.

Caveat: of course we don't know the specific details of this case, so it's very hard to comment.

This is disgusting! Poor family :(

BaronessWrongCrowd · 15/10/2020 19:27

@JuiceBogTrotter

I'm confused. If he has reduced culpability for whatever reason, surely he should be detained somewhere secure for the safety of other children?
Agreed. If this is the case then should be in a secure unit, not in society with access to children.
