Hammer thief sentenced to jail then judge immediately changed sentence purely because being transgender is more relevant than threatening a shopkeeper with a clawhammer.

It is time for third space within men's prisons where trans women can be securely and safely held to serve their sentences, and away from vulnerable women prisoners. It must be possible.

I don't get this. Who is more vulnerable to attack than a paedophile rapist, yet they arent let off because they will be attacked. Allowances are made for this in their accomodation. Why isn't the same thing done here?

SunsetBeetch · 27/02/2020 18:36

Have a strong suspicion Layla is going through their accounts and changing details, as their FB, which I posted above, now looks like this:

Reminded me of this - woman held up a shop with a knife and was sentenced to 3 years and 10 months.

ShootsFruitAndLeaves - well that ad certainly contravenes the Trade Descriptions act

Aesopfable · 27/02/2020 18:07

The only way Le Fey could prove her new gender would be an “undignified examination”, one which court staff were not prepared to do, Ms Upton said

Consider the sex of the court staff being required to do this! Angry

ShootsFruitAndLeaves · 27/02/2020 17:45

I'm guessing this is the source of Leila

en.wikipedia.org/wiki/Leila_Waddell

ShootsFruitAndLeaves · 27/02/2020 17:44

I would also note, en passant, that I'm assuming Layla is named for Anton LaVey, judging by Layla's FB, which is devoted to the occult.

I find it quite confusing when someone is variously named after a satanist, called 'Candice', 'Adam' and 'Marcus' to know what name is supposed to stick. Presumably one of these is a legal name.

ShootsFruitAndLeaves · 27/02/2020 17:37

Yeah I think Layla is in fact penis-less.

"Hi my names candice I'm 35 feminine fun friendly escort and I'm post op 100% woman I'm smooth slender very feminine character wise I'm fun bubbly and outgoing and most of all very discreet I have spacious studio flat if you wanna sit cillout and chat first to get to know me if it's your first time with a TG woman I cater to all. I will admit I'm still only an A cup bra size. I live in Brighton area call"

I think that these ads are the one place you get honesty about this stuff.

Men hiring a trans prostitute want to know. They will not be happy if they have paid for someone with tits & a dick and the prostitute doesn't have a dick. So I would be inclined to say that Layla is 100% deffo post-op.

As I understand it, a transgender case board is supposed to be convened within 14 days. assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/863610/transgender-pf.pdf

So in this case Layla should have been sent to male prison based on legal gender, a case board convened, and then transferred to women's prison on the basis of fairly conclusive evidence of 'living as a woman' within 14 days.

I don't know why instead they just let Layla go.

ShootsFruitAndLeaves · 27/02/2020 17:31

How did you find that?

Linked from Layla (not Leila)'s FB.

ShootsFruitAndLeaves · 27/02/2020 17:30

Hmm that might be an old ad though.

This one says 'post op'

Definitely has a working cock. £40 and you can have a go.

Considering that his given address is a woman's shelter, it's hard to understand why he wasn't sent to a women's prison.

I think a couple of years ago he would have been. Plenty of males without a GRC were sent to female prisons after they changed the policy in 2016. The tide is turning. Although this is utterly rage making it's an improvement on that. Now we need an outcry at violent male thugs evading punishment.

Puuulllll!

Langbannedforsafeguardingkids · 27/02/2020 17:26

So my question is: why wouldn't any criminal, about to be sent down, now not identify as trans? Because it's self ID - so really, what's the down side? There's only an advantage to said criminal.

There is going to be a HUGE increase in the number of 'trans' prisoners now.

Lordfrontpaw · 27/02/2020 17:21

Well reading that it would be hard to know where to place them to be honest!

Worrying to see a judge flout public opinion and fairness in this way. Judging by the Telegraph (not called the Torygraph for nothing), the government is gunning for the civil service and for judges:

www.telegraph.co.uk/news/2020/02/27/mps-have-shamefully-allowed-judges-green-activists-call-shots/
Was it too much to ask that ministers and MPs across the House prioritised the interests of the British people and the economy and listened less to the self-appointed, self-important, self-righteous climate protesters? Was it too much to ask that such decisions are decided at the ballot box rather than at street protests? Was it too much to ask that ministers make positive, decisive and swift action on a matter of national importance before allowing the judges to swoop in and usurp their role?

It turns out that the answer to all three questions was “yes”. And now we will all pay the price.

and even more starkly: www.telegraph.co.uk/politics/2020/02/26/arrogant-overrated-civil-service-must-now-face-political-reckoning/

Will the Treasury still be allowed to “veto” new ideas, the Cabinet Office to block non Left-wingers from public appointments, the defence establishment to buy overpriced, overspecced and irrelevant kit, and a self-perpetuating Foreign Office oligarchy to instruct Downing Street what to think about Israel or China? And are we happy that it is judges, not politicians, to whom we entrust deciding whether Heathrow expansion should be given the go-ahead?

The institutitonal capture by TRA ideology - visible in civil society, the civil service, corporate life, charities and public services - shows that we need all the checks and balances in a society. Judges should exercise independence from the government, by all means, but Judge Mooney wasn't being "independent", he was being indulgent; and any pushback coming to him won't just affect him, but his more fair-minded colleagues, too Angry. Yes, this will affect all people who depend on the law to life in safety and peace, rather than having to fear a hammer-wielding maniac with an alcohol problem, who has been emboldened by getting away with a crime. I don't even wish that on Brighton.

Once again a quick Google could have helped enormously

MrsTerryPratchett · 27/02/2020 15:13

Ms Upton also said prison regulations state she could not be kept in solitary confinement there.

Sorry but what has happened to being placed on Rule (43)? Child sex offenders, prisoners in debt to others, plenty of vulnerable offenders get placed on Rule, out of gen pop and are fine. How is Leila more vulnerable than a child sex offender in prison? FFS.

Thelnebriati · 27/02/2020 15:08

Ask for a Crown Court sentence to be reviewed online
www.gov.uk/ask-crown-court-sentence-review

IfNot · 27/02/2020 15:02

Many types of men are vulnerable in prison. Feminine acting gay men, geeky teenagers, men with disabilities-the list is endless. Whether Leila kept Leila's dick or not, Leila seems more able than many men to handle Leilaself in prison.

Herja · 27/02/2020 14:53

While I'm thinking about this, I have friends and family who have been to prison. A strip search on entry was standard for all of them (all for drugs or violence, I accept it may be different with different crimes, but this WAS a violent one).

What part of this 'undignified examination ' would be fucking more intrusive than that? None. Perhaps equal, but they'd have to do it anyway?
Should everyone who finds a strip search be exempt from one in prison? What about airport security? It's no less intrusive there...

The lack of critical thinking in this is just plain alarming. That someone can become a judge, but have this absolute failure in thought process is terrifying.

GlomOfNit · 27/02/2020 14:45

According to the Daily Heil, Leila (or Layla, they can't seem to decide) has two entirely different male names they also go by (forgive me for deadnaming but hey, the Daily Fail did it) . So I suppose you also have to ask yourself, what sort of person has a whole string of aliases? And why might that person benefit from identifying as a woman and thus avoiding prison (but only as a transwoman. Fairly sure a woman would have been sent down)?

We just need a dedicated trans prison, really. Or unit within an existing prison. Goodness, there DO seem to be an awful lot of these trans offenders, don't there?

fascinated · 27/02/2020 14:39

That’s not equal treatment. That’s special treatment.

Clymene · 27/02/2020 14:26

So a person who demonstrates an escalating pattern of violent offences has escaped jail because they identify as transgender? Is that right?

Words fail me
