Really don't know if the Harry Miller case is anything to do with all this - it appear to be. So here's a link to the judgement re: his tweets....you can see the way the Judge was thinking from his opening quote from Animal Farm.

If liberty means anything at all, it means the right to tell people what they do not want to hear

Looks an interesting read

(As an aside, had to laugh at that there Richard Madeley being criticized for listening to a woman MP - poor fucker must have been really confused - "but I'm meant to listen to women and not silence them - It's not for me to decide the merits of what they say....oh dear !")

BustedWench · 18/02/2020 10:00

Also, Mr Yalland has never worked on the criminal case for either side as far as I'm aware

BustedWench · 18/02/2020 09:59

Some misinformation again (quelle surprise)

Mr Yalland attended a Case Management meeting between myself and the complainant (me the defendant again) but has never worked on the civil claim bought against me by the complainant, which is still live. So it's not over for me quite yet, more punishment on the way

Cuntysnark · 18/02/2020 09:58

Adrian Yalland has an utterly brilliant twitter thread about this. Someone is clutching at straws and it’s not Adrian Yalland.

Welcome to MN Jenner.

my worry is where is the digging leading to?

Thanks for the reminder, off to add to the dig now.

Quick .... look over there...... Hmm

JennerOfKensington · 18/02/2020 09:41

Gets stranger and stranger. My worry is where is the digging leading to?

Women aren’t covered by hate crime legislation. It’s as simple as that. We are the only protected group (under the 2010 EA) not to be protected.

Go figure ...

The foul misogynistic hatred of women is so normal, it’s not considered criminal.

littlbrowndog · 17/02/2020 15:10

Wrong thread 🤦‍♀️

littlbrowndog · 17/02/2020 15:09

This is where we are now in Scotland. It’s to unsafe for women to speak as our security can’t be guaranteed.

How is this possible

BatShite · 17/02/2020 15:02

Isn't it funny how its so clear that TW are not treated as W when it comes to what they're allowed to say.

I said this on the other thread too. TW are absolutely not treat like women in law..seemingly. Yet thats fine as it..gives a huge advantage?! Basically, say whatever the hell you like to women, send hundreds of messages threatening them, turn up where they live, no comeback. BUT if women say anything you don't like, know we will be there to instantly arrest them for hate crimes. Despite sex also being a protected characteristic in law..apparently..

BatShite · 17/02/2020 14:52

This law says that if you cause annoyance to someone by persistent use of a public electronic communications network then you have committed an offence.

Indeed. This is exactly why I suspected Kate would be found guilty. Not that I agree she should have a record for this, especially as it seems her 'multis' did NOT harrass Hayden and Hayden only found them by stalking (is that right?!). That Hayden admitted in court they knew kates uni, her family etc...kinda scary really. Hayden also apparently actually contacted kates uni? Yet, calling Hayden he is the criminal offence here..bonkers.

Online debate is potentially illegal if it annoys someone.

Indeed. This would, in any other case, open the doors for mass prosecutions, when all the women who are actuaslly harassed and stalked by TRAs all reported the abuse to the police. But oddly, it only appears to protect male people? As Carolines case proves..Hayden and Harrop threatened her MULTIPLE times..sometimes with over 20 tweets directed at her per day, threatened to go to her house/church with golf clubs too IIRC, yet police have absolutely no interest. Why? Anyone who supports this judgement explain that one?

GodwinsRulebook · 17/02/2020 12:34

Had Hayden been bullying Kate?

Loads of evidence - stalking, and threatening via Twitter. For example, finding out where Ms Scottow lives. Then - making several Tweets remarking on the golf courses near her home.

This might seem nothing, unless you also know that Hayden has a conviction for assault on a person, using a golf club.

Such a typically female crime ...

GodwinsRulebook · 17/02/2020 12:28

What I worry is that the splash damage from that backlash may also do great damage to both feminism

Indeed. For every post on forms of social media I see (Twitter, FB etc) supporting the feminist arguments, there are also posts along the lines of
"Well, the women had it coming" or "Bloody feminists. Serves them right."

BovaryX · 17/02/2020 08:36

TheProdigal
I hope not. I feel optimistic that it won't, but I understand the concerns. One thing I notice is that the media sources which are reporting these issues have highlighted the fact that it is left wing feminists who have been at the vanguard of safeguarding and defending freedom of speech. The Daily Mail even had a paragraph within an article about RLB explaining why Lachlan Stuart was citing bullying of lesbians. I thought that was encouraging.

TheProdigalKittensReturn · 17/02/2020 08:28

I agree, Bovary, and have been assuming that a backlash would be a case of when rather than if. I think some of the more sensible trans public figures are expecting it too and that's why they've been so vocally critical of the lunatic fringe of their movement. What I worry is that the splash damage from that backlash may also do great damage to both feminism (many feminists have opposed this stuff for years, decades even, but that's not the way the media will spin it) and the broader gay rights movement.

MangoesAreMyFavourite · 17/02/2020 08:25

One mere whisper of offense against a trans woman and the judicial system pounces. Yet women are stalked, harassed and threatened with rape on the internet every day, to the point where some women completely avoid social media or online communications, and the police just shrug their shoulders.

This. The legal system is bollocks.

I think there is a growing public backlash against this. The prominent media coverage of Harry's case and the Gestapo comments by the judge are reported at the same time as a You Gov poll which shows a collapse of public confidence in the police to investigate real crimes The public loss of faith in the police and the perception that they are operating with zealotry in certain cases whilst doing nothing elsewhere? This is dysfunctional and untenable

InionEile · 17/02/2020 05:04

And again we learn, as if we needed to, that while men beat, abuse, rape and kill women every day of the week, some of them never even being charged or going to jail for it, the only thing a woman needs to do to end up in court is hurt a male-born person's sense of self and fragile identity.

Amazing how different the world can be if you are born male, regardless of how you later identify.

NoSharon · 17/02/2020 04:51

What had Hayden done to Kate? I'm just wondering where you used the analogy of my bully getting me fired for me retaliating.

Had Hayden been bullying Kate?

NotMyFIrstTIme · 16/02/2020 15:42

I'm so angry about this case.

First that the Judge actually said she had thought of waiting for the judgement in the Judicial Review - but didn't. I mean why not, ffs.

Secondly that on the offensive scale, what Kate said to Hayden was barely a playground spat, especially when you compare it with the level of bilious misogyny that is hurled at women & girls on social media all the damn time. Men are insulted because of the way they look, too.

Lots of other reasons, too, but as my BP has barely got back down to normal again post-verdict, I'm going to stop here.

BingBongSong · 16/02/2020 10:11

Just wanted to add that I will also be contributing to any costs if Kate wants to take this further. Flowers for you Kate.

BustedWench · 16/02/2020 09:55

The case involved 16 tweets over 7 months, 9 of those in direct conversation about the Yardley case. The court found persistant does not rely on quanitiy, so we should all be aware of what this means for us all

ferrier · 16/02/2020 09:30

Talking about me, character pulling, discussing me - it'd be upsetting.
Nothing to do with "hurty feelz." Anyone human wouldn't like that.

But this happens every second, thousands of times around the world on social media. That's what social media has become. Why was this one particular case chosen out of all the millions ..... ?
