I have no words. Reports from Joani Walsh and Maya Forstater at the Trial in St Albans

I'll chip in appeal!

Yes I will pay towards the appeal too.

Amalfimamma · 14/02/2020 11:43

Just to make this clear.

Kate was banned from Twitter
Made a second account as we all do
She didn't contact claimant but claimant found her via photos of her dog, as admitted in court
Second account banned, 3rd account made and the same thing happened

The police recorded NONE of the claimants tweets so each and ever one of Kate's tweets have no context nor meaning

Each time said account was found claimant told her to delete account or it would be reported and amended to claim. Which they were.

The fact the claimant admitted in court that they knew about Kate, her husband, where they lived, their jobs, their children etc is apparently not harassment.

I hope in the appeal Kate is allowed to disclose the full extend of claimants criminal record.

It is not illegal to call anyone a racist otherwise all the tras and each and every member of the labour party would be in jail.

Totally: we simply have to fight this. I'm going to save up, ready for the inevitable next crowdfund. It's going to take many cases to win back what we've lost, never mind to strengthen our rights!

So disappointing but the Fair Cop judgment and the chance for Kate to appeal are positive. How long will an appeal take though and how much will it cost? Hopefully she can get crowdfunding again. It will certainly be taking its toll on her.

Bezalelle · 14/02/2020 11:32

This proves just how high up the regulatory capture has gone.

Oldstyle · 14/02/2020 11:28

This must be taking its toll on Kate. Flowers to her and a fervent promise to donate to any future crowdfunder. Don't wish to sound hyperbolic but this way lies fascism (runs screaming in to the woods).

NellieEllie · 14/02/2020 11:22

Can’t see how it can stand, given in the high court, judge said “Free speech includes the irritating, the contentious, the unwelcome and the provocative”. But here because the tweets cause “annoyance and anxiety”, they’re unlawful. It makes an absolute mockery of our courts, so they will have to reconciled on appeal, just hoping in the right way.

OvaHere · 14/02/2020 11:22

I assume the Fair Cop Judgement will be something Kate can reference in her appeal. I wonder if that's why the judge decided to not wait for the outcome of FC (their words).

DeployTheTut · 14/02/2020 11:20

I just saw something interesting, on Twitter, which might explain why Kate's decision was taken by a lower-tier Judge (and why an appeal is likely to succeed?)

Please let there be an appeal, I'll be donating

JessicaLangoustine · 14/02/2020 11:16

I am hoping that, as with Maya's case, the publicity Kate's case will garner, losing in tbis patently ridiculous way against such a vile individual, will bring this issue to do many more people than had she won. I know that's small comfort to Kate, but rendering Hayden's victory a pyrrhic one is the most important thing now.

TreestumpsAndTrampolines · 14/02/2020 11:16

Bloody hell. Right, well, time to donate for the appeal then, this was a very poor decision (from someone who I'm assuming hasn't ever actually spent time on twitter and seen what is regularly written between strangers, let alone from the accuser in this process)

DeployTheTut · 14/02/2020 11:14

It's terrifying.

There's a big, long thread of updates on both Scottow and the Fair Cop JR. You can find it, here: 14.02.20 Live updates on Harry and Kate’s cases HERE www.mumsnet.com/Talk/womens_rights/3822585-14-02-20-Live-updates-on-Harry-and-Kate-s-cases-HERE

Personally, it's useful to separate them out, even though they are relevant to each other. And show how differently our legal system treats men and women

I am beyond words. This is appalling

Daughterofmabel · 14/02/2020 11:10

I just saw a head explodes giff on twitter. Seemed to sum it up for me. Not funny though. Scarey as hell.

DeployTheTut · 14/02/2020 11:07

So some of you might know a bit about this process? Please help me out! is it possible that this Mag's decision might be overruled, wry Harry's JR? Why is the Judge referred to as a Judge, rather than a Mag?

OP posts:
fuckitywhy · 14/02/2020 11:06

Creepy. Also, if the onus is on being kind, not being honest or factual, that's worrying.

BoreOfWhabylon · 14/02/2020 11:06

Bring on the appeal.

FredaFrogspawn · 14/02/2020 11:05

I don’t recall ever hearing of any Male in court being told that, ‘We teach our children to be kind.’

It sounds like a Sunday School telling off. Infantilising and adult.

NellieEllie · 14/02/2020 11:04

Magistrates will be at sea with this quite frankly. Unless there were legally qualified mags, they are just advised on matters of law by a court clerk. When I was involved in family/child care law, the mags were notorious for duff decisions..

GloGirl · 14/02/2020 11:02

The sentencing is a joke. £1000??

How funny that one of the related articles was this crime. £175.

NellieEllie · 14/02/2020 11:01

Surely principles ruled in judgement in judicial review in the High Court binds magistrates?
