Thanks Xanthangum

More Stephanie Hayden news.

Judge has thrown out 'this MoS article is defamatory'! (And also ignored her 'you must recuse yourself cos you are biased' opinion)

www.bailii.org/ew/cases/EWHC/QB/2020/540.html

She risks paying for the Mail on Sunday's lawyers.

And she still thinks she has won. twitter.com/flyinglawyer73/status/1237695137414864898?s=20

DuLANGMondeFOREVER · 02/03/2020 22:10

This is excellent news.

Onwards and upwards (through the court system!)

SwimmingCait · 02/03/2020 21:32

Yes, please make sure we know where to direct the spades. Very much want to help dig.

BitterAndOnlySlightlyTwisted · 02/03/2020 17:49

I have a spade and I’m not afraid to use it. I just need to know where

Gibbonsgibbonsgibbons · 02/03/2020 17:14

Oh you brave woman Flowers
Ready to dig

GenderCriticalFeminist · 02/03/2020 15:11

I don't think the courts took reasonable account of the fact that Kate had blocked Hayden on twitter - so how was it harassment?

This is really important. I made this point upthread, but in the Harry Miller case, the judge ruled that Harry's tweets were directed at people who had chosen to follow him, not at the wider public. This is the exact opposite of the judge in Kate's case, who decided that all tweets could be read by everyone - even though, as we know, Kate had blocked Hayden to stop Hayden reading them.

Even allowing for the fact that Miller's case was a judicial review and Kate's was a criminal court, I don't see how it can make any legal sense to have two opposite rulings on the use of Twitter.

Am very glad new evidence has been found.

BustedWench · 02/03/2020 14:57

It's an appeal to a higher court. More evidence has been discovered so instead of a review of the judgement, we want the crown to re hear it

Astonlegalbrain · 02/03/2020 14:56

There will not be a jury unfortunately. The appeal will be decided by a judge-panel of High court judge/recorder and between 2 and 4 (usually 2) magistrates.

teawamutu · 02/03/2020 14:13

Bring. It. ON.

happydappy2 · 02/03/2020 12:57

will all the evidence come out in this trial? ie SH's vile twitter history? If all evidence is heard then I think Kate will be fine

Dreamprincess · 02/03/2020 12:57

Sorry for the ignorance, but is this a retrial as the original was a mistrial, or is it an appeal to a higher court? Thanks

Coyoacan · 02/03/2020 12:51

Great news, but how stressful for Kate.

GrinitchSpinach · 02/03/2020 12:44

Thanks for the update, Amalfi. I’m glad to hear it, but oof how stressful for Kate. Please keep us posted on how to help.

WrathofFaeKlopp · 02/03/2020 12:21

Crown Court, there will be a jury.

FannyCann · 02/03/2020 11:57

Will the full retrial involve a jury?
I feel hopeful a jury will take a sensible view.

2BthatUnnoticed · 02/03/2020 11:53

This whole thing is a snow flakey shit show. I keep having to remind myself that SH is an extreme outlier (at least I assume so) and not representative of the average TW.

Great news re the appeal. I’ll dig.

Amalfimamma · 02/03/2020 11:45

Quick update and breaking news

Kate is going for a full retrial at the crown Court, and will in need of some digging. I'll keep you up to date as I get more

CharlieParley · 20/02/2020 10:25

Wow, OK.

You asked me why, WotchaTalkingBoutWillis. I gave you reasons without judgement. You're old enough to know that, yes, sometimes people just go off on a rant because their anger spills over. Mumsnet is full of threads of posters dealing with the fallout of either having ranted or been ranted at.

You didn't say anything about being an insult exclusively for women in your reply Charley at all, your reply to mine said it wasn't exclusively a trans insult.

I said it was an insult that typically referred to an overweight female and more generally to an unattractive one. You may have misread "typically" as referring solely to "woman" as meaning typically to a woman but sometimes to someone not a woman, when the context is typically to an overweight woman, but sometimes to a woman who is not overweight but otherwise unattractive.

It's a gendered insult that I had never heard used in relation to anyone other than a woman before.

Even if you see it as being an insult up for anyone, why, why would you tweet that? To or about anyone?

Why would anyone post 'not so long ago people like you had no civil rights" to a POC, or indeed tweet in defence of the nazi gassings? See, those 2 single tweets to me are a million times worse than anything Kate tweeted.

Yet the person who posted about nazis and "people like you" is seen as the victim and is doing the rounds of local BBC radio shows trying to be the victim. I, could dig out at least 30 tweets that person made about Kate in that same time period. Some implying violence, others being completely and utterly disgusting. I could also pull 100s of tweets by the "victim" targeting other women which would fall under the same crime Kate has found herself a victim off.

Please do inform yourself about the subject before making a complete and utter tool of yourself. Ta very much

WotchaTalkinBoutWillis · 20/02/2020 01:34

Many times we don't think about how the other person will respond to the insult at all, we just let rip.
Wow, OK.

TheProdigalKittensReturn · 20/02/2020 01:18

I'm Scottish. I'm fairly sure asking me not to swear counts as some sort of anti Scot hate crime.

CharlieParley · 20/02/2020 01:13

Even if you see it as being an insult up for anyone, why, why would you tweet that? To or about anyone?

I said that it wasn't an insult up for anyone but one used almost exclusively for women.

As for the why, given the context within which these Twitter exchanges occurred, I can think of a few choice words that I would use about some people - not to annoy the other person, but to express my anger and relieve my stress and tension. Which is an incredibly well known phenomenon, so much so that we have research showing that swearing measurably reduces pain, stress, blood pressure etc.

It is simply completely inaccurate to claim that every time we use an insult directed at someone we seek to cause annoyance or anxiety. Many times we don't think about how the other person will respond to the insult at all, we just let rip. Without considering the other person's feelings. Mumsnet is full of threads about that.
