Thread 1 here
www.mumsnet.com/Talk/womens_rights/3632380-Fascinating-tweets-about-JY-s-waxing-case-Read-here-Thread-title-edited-by-MNHQ

This is a continuation of all that is JY and their waxing cases bought against minority women in Canada.

We are a fair way in, and still are no closer to knowing what the final judgment will be, but we have lots of info. and are finally seeing this case, and all the attending issues with self ID, in the public eye and main stream press.

In UK, it is very much a 'courtesy'. There is nothing written in any statute about use of pronouns, so-called 'mis-gendering' or so-called 'dead-naming'. To write such requirements in law is a breach of international human rights law

While an organisation can impose rules about courtesy that facilitate participation, compelled speech, expression or belief is a breach of international human rights law

I'm not sure that's entire true. Section 22 of the GRA makes it a criminal offence to disclose the birth gender [the Act uses 'gender', not 'sex] of someone who has a GRA. People often disbelieve me about this, so I'll quote the Act:

It is an offence for a person who has acquired protected information in an official capacity to disclose the information to any other person.

Protected information in this context means birth gender or that someone has applied for a GRA.

The criminal offence doesn't apply to people acting as private citizens, but does apply to a very wide range of people in their work - including HCPs, the police, civil servants etc.

So that's millions of people in the UK who would commit a criminal offence if they disclosed the birth 'gender' of someone with a GRA while at work. Obviously, if you use male pronouns or a male 'dead name' about someone who now identifies as female, you are effectively disclosing their birth sex. So, by the back door, millions of people are compelled in their working lives to pretend to believe that trans people have changed sex. At present, the offence is only committed if a trans person has applied for, or has, a GRA, but the principle of compelled speech is thus already part of UK statutory law.

MagneticSingularity · 28/07/2019 20:34

I know it’s not actually enshrined in law there JackyHolyoake - yet - but it seems to me more and more that it might as well be given the number of people who are falling afoul of the gendering ‘courtesy’.

JackyHolyoake · 28/07/2019 20:25

Is it a courtesy though? What about the judge there who insisted the victim address her assailant with female pronouns? The suits brought by TRAs there against people who’ve misgendered them on social media? Even here on mumsnet we’re not allowed to misgender. It seems to me it’s rapidly becoming an obligation rather than a courtesy.

You may remember that legal case in N Ireland involving the bakers' Ashers, wherein the UK Supreme Court last year protected the human right to freedom of conscience, belief, speech etc:

His name his maxime bernier. So far he has not been banned from twitter for saying that Yaniv is a man

littlbrowndog · 28/07/2019 20:12

There is a Canadian politician on twitter who has broken the silence

He said that Yaniv is a man

MagneticSingularity · 28/07/2019 19:32

Apologies, had a brainfart about the name of the victim, it was Maria Maclachlan

MagneticSingularity · 28/07/2019 19:29

Regardless, most of us aren't in Canada. Use of pronouns is a courtesy.

He's apparently got female on birth certificate and driving .license, so in Canada I guess he is legally female (if it's true, of course, he's one of those liars who is constantly making things up in answer to any situation he finds himself in - hence his supposed ability to get pg and his periods since 13 years old).

Regardless, most of us aren't in Canada. Use of pronouns is a courtesy.

BernardBlacksWineIceLolly · 28/07/2019 15:58

Yaniv is legally female

is he though? what's the process for changing your legal sex over there? I'd have thought that if he had a GRC he'd go on about it all the damn time

TimeLady · 28/07/2019 15:32

Yaniv is legally female, so I guess anyone in Canada has to be careful how they refer to JY on a personal level. It's just bizarre.

BernardBlacksWineIceLolly · 28/07/2019 12:42

It’s like the writer just can’t mention sex

BernardBlacksWineIceLolly · 28/07/2019 12:41

But the National Post article spectacularly misses the point that Yaniv is a man trying to use the law to coerce women to handle his genitals.

TimeLady · 28/07/2019 12:09

That National Post article.....maybe Canada isn't a completely lost cause after all.

There are people who might actually need the protection of a rights tribunal. But not the bullying and troubled being who wants their privates barbered under force of law.

littlbrowndog · 28/07/2019 11:53

The member atthe hearing has said Yaniv can be referred to as Jonathan

SarahPickles · 28/07/2019 11:51

BickerinBrattle

It's like when they say "sex work is work" and somehow erase the "sex" component. Yes, all wage work is coerced work; that has LONG been the left's understanding of labour relations: the need for wages is the coercion. Therefore "sex work is coerced work." Therefore, in prostitution, "sex is coerced." The word for coerced sex is rape. Therefore, to legalise prostitution is to legalise rape.

Awesome.

Canada laughing stock of the world

Jux · 28/07/2019 10:51

BOF, so one can simply want to be disabled and that gives you the kudos of belonging to an oppressed group. Trans-disabled my arse.

We thought Yaniv had taken us to the logical end of all this trans nonsense, but some mad professor somewhere has shown us we were wrong.

FannyCann · 28/07/2019 09:13

Excellent article by Jenn Smith. It was always going to be to pass laws that do not reflect physical reality and this is where such laws have brought us. Furthermore, declaring that trans is not a mental health issue means that people such as Yaniv not only have the law on their side, but treating any mental health issues associated is very difficult as this is not a mental health issue apparently!
We really need to get back to reality, which should be reflected in law and in treatment pathways.

Childrenofthestones · 28/07/2019 07:47

Bit of good news.
Lyndsey Shepherd has had her Twitter account reinstated.

BitOfFun · 28/07/2019 05:41

Absolutely.

It's clear that many TRAs and their useful idiots allies will be distancing themselves from Yaniv as some weird aberration, but it's important to bear in mind that what's happened is totally the logical outcome of the Transwomen are women mantra.

TimeLady · 28/07/2019 05:32

Good article by Jenn Smith, although I would take issue with the amateur-hour mental health diagnosis. How about JY is an unlikable racist mysogynistic attention-seeking con artist, with an unhealthy interest in young girls and a predeliction for foisting their paraphilias on the public? Have I missed anything?

We shouldn't be offering this POS the get out of jail free card of 'mental health' issues. JY has brought this on themselves; they could have stopped the harassment of women and girls at any time but have chosen not to do so.

I would like to thank Yaniv though for highlighting the potential problems of self ID in a way I wouldn't have thought possible a year ago. Also thanks to Null at Kiwifarms for allowing the documentation if all JY's activities. It's proving to be a valuable resource.

BitOfFun · 28/07/2019 01:35

@2Rebecca, even the scammers are oppressed, apparently...

2Rebecca · 27/07/2019 22:55

Has JY ever actually done a day's work? You wonder how lefties can support folk like JY who are obviously just playing the system for everything they can get and make you think Trump should invade Canada and sort out the woke nonsense. Socialism only works if people don't exploit it for selfish gain. OK JY doesn't come across as the sanest citizen Canada has but their system is enabling JY's extreme nonsense and wasting a huge amount of tax payers' money on JY.

TurboTeddy · 27/07/2019 21:55

I know not everyone here is a fan of Jenn Smith but this article hits the nail on the head for where we are now.

Michelleoftheresistance · 27/07/2019 20:30

she completely neglects to take into account that a woman working alone from home might have very good reasons for not admitting a strange man into her house.

Exactly.

She is arguing that women should accept any male into her home, to be alone with her for intimate care, if they inform her that they identify as a woman. And as we know, JY is demonstrating, that male who identifies may be someone with highly dodgy history, sexual interests and worse. But the writer is all for them cracking on with this, and the woman sucking it up in the name of..... well. Something she seems to be able to see as positive without being able to explain why, or explain the injustice and oppression of women that it involves, in order to privilege men. All men. Any men. Just facebook them and say the magic words, guys.

In her argument, she and the whole ideology come over as equally insane and stupid.
