JY’s parent sounds like an absolute loon. It would explain a lot.

Agree with Forgotthebins Well said.

OMG I wish I hadn't read about the tomato sauce

At least you only read about it, sometimes YouTube is best avoided.

FermatsTheorem · 09/07/2019 07:37

Cookie you'll have to repost that with JY's name and Twitter handle covered up. MN are insisting we play by the Canadian courts' insistence that JY only be referred to by initials during the court proceedings.

(Fair enough: I wouldn't want to give any reason for this whole debacle to go to a retrial and put the poor defendants through it twice.)

Forgotthebins · 09/07/2019 07:31

I wonder if the focus is on the defendant's religion because that is the interest of the conservative legal group, JCCF, who stepped in to provide legal representation. They support a bunch of other "religious freedom" cases. It's a crying shame that no other legal aid organisation stepped in to defend all these women without reference to religion. www.jccf.ca/our-cases/

I'm still mindboggled that a human rights tribunal thinks there is a debate about whether a woman should be forced to handle genitals against her will. I'm so angry - not with JY who is apparently ill, but with the Court for making an active decision (which they did) to go ahead with this case and put these women through this ordeal, and with the fact that no progressive legal organisation stepped up. It's the Court and the coalition of the silent who should be the focus and held accountable when all this is over. I hope the BCHRT is feeling uncomfortable with giving a platform to a racist who wants to force women to handle their genitals, and with what that says about their system.

I can certainly see why the victim defendant raised her lack of qualification. It can only assist her argument, particularly if she does have a suitable qualification for all other procedures she performs. One probably could make an argument for drawing the line without a qualification, but this is better.

The second case appears to be a Sikh woman who declined to provide waxing services. She goes to peoples homes, alone. It was for arm/leg wax apparently.

Whilst declining to wax scrotum hopefully will be clear cut I fear this may be less so. But it made me think - quite a few people provide services in the home. Hairdressers for instance. Manicurists and beauticians. A work colleague had a second job as a personal trainer. She would go to people's homes and also gave massages (to women). She had several regular clients for therapeutic massage.

I would think these are the types of services one might reasonably choose to provide to women but not to men. But if TWAW where does that leave one when, for instance, Charlotte Gold Lamé Purse, another vindictive serial litigant wants a home treatment. Or Mr Call me Ma'am ?

I hadn't thought about it before but it appears that women who provide a range personal services, going alone to people's homes may not be able to choose who they accept as clients.

I am very grateful to the person on twitter shining a light on the case. And all sympathy to the poor women defendants who are being put through this. I hope the case goes well for them.

As far as I can figure out, in the U.K. you need to have completed a course accredited by one of a handful of professional bodies in order to be insured.

There are basic waxing courses that cover the easy bits like legs and then advanced waxing courses for the more complicated bits.

Female intimate waxing and Male intimate waxing are two completely separate advanced courses (although they only take a day or two to complete).

I’ve tried searching for Canada but Google has decided only to show me U.K. results (I can tell you about waxers in Canada Water, London!) but surely it can’t be that different?

I did find this document, it suggests that at the time of writing there were no specific requirements of waxers in BC, but that there were concerns about safety: pdfs.semanticscholar.org/a000/ff1c06c0ce5f9948a268ea93daa010ca6d2b.pdf

There is non-compulsory training available, although I can’t find any info on specific modules.

Quote:
Legislation on waxing services
Criticism of BC Legislation, Guidelines, and Procedures
BC used to have the Cosmetology Act but that was deregulated in 2003. The current Regulated Activities Regulation (B.C. Reg. 161/2011), under the BC Public Health Act (2008) has a small section regarding PSEs. At most, the BC regulation highlights potable water requirements and mostly focuses on tanning salon requirements rather than the wide scope of personal services. Salons that provide waxing services fall under this regulation and are therefore prescribed as a regulated activity. As such, under the same Act, it is the duty of the operator duty to prevent health hazards, respond to any health hazards that arise and ensure that employees are “adequately trained and sufficiently equipped to recognize, prevent and respond to health hazards that may arise” at the salon. However, the term “adequately trained” is vague. Neither the Public Health Act nor the Regulated Activities Regulation specifies that employees of PSEs in BC require certification.
Interestingly, there is a BeautySafe program available in BC (BeautySafe, n.d.). This is a training and certification program that educates beauty professionals on best practices and effective infection protocols. Not only does it have a course on general trade practices, there are modules for specific trades’

Didn't he just let it drop if the beautician said yes? Only pursues if they say no?

This has been the case so far. So seemingly not so keep on actually having that 'gender affirming' wax he crows on about being so important to him that he would drive hundreds of miles for one Hmm

littlbrowndog · 08/07/2019 23:28

Canada has gone so far down the trans trumps everything that no one can move just in case they are found to be transphobic.

I think that’s why we have what the rest of world thinks this case is bonkers yet this is where Canada is

Asking women to wax bollocks and they say no.

It’s no longer enough that women say they don’t want to wax a strangers bollocks in their own homes. They have to justify why they don’t

Unfucking believable

popehilarious · 08/07/2019 23:26

On a more basic level, if male waxing is a thing then why was 'getting waxed' such a crucial (female-)gender-affirmative experience? JY insisted that getting waxed would somehow affirm their female gender but how, if anyone of any sex can get waxed at a place that offers it?

LassOfFyvie · 08/07/2019 23:22

lass, if it's just about her not having the competency, how come it's got this far? What is the tribunal even dealing with it?

I have no idea. Viewed from a UK legal perspective everything about this case makes no sense.

Datun · 08/07/2019 23:22

ahumanfemale · 08/07/2019 23:14

As soon as he contacted her she was going to be sued. Either she refused to wax JYs scrotum and got sued for discrimination, or she did wax them and (inevitably) injured the skin and got sued for that.

Win-win for JY.

And if you think "Yeah, but he'd have been injured in the second scenario" you'd be right, but I'm betting the pay off of having his cock and balls handled by a woman would have outweighed that inconvenience (plus the $$$ would have been at the forefront of his thoughts).

TheRedBarrows · 08/07/2019 23:12

I saw tweets over the weekend showing that this individual is now claiming to be disabled due to paralysis and uses a mobility scooter.

And was trying to say that a photographer taking pics of the sudden recovery from paralysis having boarded a train would be prosecuted. And that court cases would now be bringing trans to a halt... and the tweet by JY about the photographer was really racist.

FlaviaAlbia · 08/07/2019 23:01

I was thinking of it in relation to this case, I can't imagine JY taking "no experience" as an excuse when suing for discrimination has been profitable so far. So the lack of available qualification means the waxer can't prove they're not qualified by saying they don't have it.

LassOfFyvie · 08/07/2019 22:29

Should the lack of a formal qualification matter? The beautician had never done it before and didn't want to do something she knew nothing about.

There must be other trades where there isn't necessarily a qualification (or there is but not everyone has a formal qualification) but tradespeople draw the line because it is outwith their competency.

2Rebecca · 08/07/2019 22:25

The tweets do make it all sound completely mad. Amazed no press there. Our press would love his although JY does sound mentally ill. The menstrual period obsession is both mad and creepy. Coming soon...to a changing room near you.

FlaviaAlbia · 08/07/2019 22:14

LassOfFyvie since there's apparently no qualification available for waxing male genitals I wonder if it wouldn't still turn into a he said / she said situation regarding competence and whether it was being used as an excuse.

Erythronium · 08/07/2019 22:08

He's a predator.

OhtheHillsareAlive · 08/07/2019 22:00

I wonder if the court is taking it so seriously so that when (I hope) the case is thrown out and JY has to pay substantial damages; there will be no grounds for appeal.

From the tweets - which are clearly taken from notes after each day's proceeding it is important to say - it seems that JY is being given a lot of opportunities to make his case as clearly and in as much detail as he demands. He is being given quite a bit of guidance & help from the "Member" - the person presiding over the hearing, who sounds wise & compassionate.

I'm hoping he's being given enough rope to hang himself, as they say. BTW, of course I don't really believe anyone should hang themselves or be hanged!

JY is ill and I can only imagine how his parent must feel. It's so sad.
