Just come across this story while reading the news...

www.bbc.com/news/world-us-canada-48858761

Short version: boy rapes girl at party, sends video to his friends. Judge says he should be tried as Juvenile so it doesn't ruin his college chances and tells girl she's ruining his life. Appeal court decides he should be tried as an adult.

The judges comments to the girl are unbelievable.

The judge also argued that rape “tradition[ally]” involved two or more males using a weapon to threaten a victim in an “abandon[ed] house,” “shed” or “shack” — circumstances not matching G.M.C.’s alleged crime.

I don’t actually think this is a real judge.

I take it the boy is white? Because black boys are automatically tried as adults. Ruining their lives is never taken into consideration

All that said , I hope the victim gets justice

It's like living in the upside down

Yes it is!

OvaHere · 04/07/2019 07:51

Good job he only raped a girl rather than stating there are only two genders in a Scottish classroom!

The latter lost his education but it seems like the former is no biggie these days.

It's like living in the upside down.

What horrible comments, sadly this sort of crap is common. That poor girl Flowers

FUCK OFF. Angry

LordProfFekkoThePenguinPhD · 04/07/2019 07:44

A female judge? She should be fired. Is she related to the judge who let a paedophile off Scot-free in Scotland because it would hurt his studies and prospects as a vet?

BogglesGoggles · 04/07/2019 07:44

Maybe he did the same in his youth

I'm still angry about it this morning (although relieved the Judge was overruled). Doesn't the fact the girl has had her life turned upside down matter? But that isn't as important as a boy hurting his college prospects. He's the only one that ruined those.

It took me years to fully accept my attack was in no way my fault. And I was a lucky one where it was a failed attack as I was able to fight off and run before anything happened.

And yet I've seen people on here call for trial by jury to be done away with in the case of rape and instead have it decided by a judge. If this is the outcome? Do these judges ever have to justify their comments? What are they thinking?

This one is worse.

According to the panel’s decision in that second case, Superior Court Judge Marcia Silva had denied a motion to try a 16-year-old boy, identified in court documents as E.R.M., as an adult on charges that he sexually assaulted a 12-year-old girl.

The victim alleged that E.R.M. penetrated her “with force” in 2017 despite her “repeatedly” saying no, biting him and asking him to stop. She began to bleed, prosecutors say, and eventually succeeded in pushing the boy off

In her decision to deny the waiver, Silva wrote that the girl’s assault claim, even if true,“is not an especially heinous or cruel offense beyond the elements of the crimes that the waiver statute intends to target.”

″[B]eyond losing her virginity, the State did not claim that the victim suffered any further injuries, either physical, mental or emotional,” Silva wrote

Seen this a million times. The boy's life is ruined. Boo hoo.

Not once have I seen any consideration for the girl's life - except growing up in India when her life was deemed ruined and her only acceptable option was to go and commit suicide. Hmm Angry

What is wrong with people!!!

Fucking hell. How dare he make these comments. He should be sacked. His comments on what rape is should have him sacked.
