Magistrates!!! That's the one! I googled it after I wrote that and wondered where I'd got the info from. 2/3 of my degree was bloody law modules so I was getting a bit worried Blush

StillFrigginRexManningDay · 06/07/2014 22:57

This Judge has shown a masdive disservice to men and to women. Blatent victim blaming will no doubt put off victims from reporting and implying that rape is an instinct that men have to resist.

HappyJustToBe · 06/07/2014 21:49

McBear The judge will have practiced law as a solicitor or barrister, though not necessarily criminal law, before becoming a judge. Magistrates are the ones without qualifications.

Awful comments from him Angry

ReallyFuckingFedUp · 06/07/2014 19:14

no, that fucked me off too cat and I was ranting at dh about it.

Rape is something you do to someone. And it is a crime.

Sex is something you do with someone and not a crime. Honestly, everything about this case is wrong.

Thanks Sandor.
Another quote from the judge that's bugging me. "You had sex with her." As opposed to "you committed rape on her" - the "with" implies mutuality.
Oh I dunno. Maybe I'm over thinking. It's just never ending sometimes, isn't it?
The comments are interesting.

SandorClegane · 06/07/2014 18:58

Doesn't say much but the comments are encouraging in the main

Trapper · 06/07/2014 18:56

Wow, disgusting. That poor woman. And insulting to men as the judge believes we are clearly incapable of controlling ourselves in such situations.
I think women who know this judge should take heed and avoid being in his company - just in case he deems them pretty and is unable to control himself.

CatKisser · 06/07/2014 18:36

Sandor, any chance of a link?

CaptChaos · 06/07/2014 18:35

The other point I was going to make was about the 'classic rapist' comment. He is a classic rapist, he raped someone he knew, in a place she obviously felt safe enough to use as a crash pad when drunk. He raped someone who trusted him. That is what classic rapists do. Or at least the vast majority of rapists.

This judge still seems to believe that 'real' rapists are bad men who jump out at people in dark alleys.

The other thing, I suppose would be that if the rapist had apologised, it would have meant that he knew that he'd raped her, whereas he no doubt maintained his innocence til the end. Despite his lack of emotion when being sentenced.

ElizaPickford · 06/07/2014 18:32

Good god, the comments from the judge are truly shocking. Sad

SandorClegane · 06/07/2014 18:30

It's been picked up by buzz feed...

SandorClegane · 06/07/2014 18:28

That's horrendously depressing and insulting to both men and women.

McBear · 06/07/2014 18:22

I'm not sure. It makes no difference. He's still a rapist. Had she not been drunk he'd have lacked the opportunity but clearly the intent was there.

For me, when they feel the need to mention it in the title, it's as if they want you to think 'asked for it' or that it's not a real rape because somehow it's her fault.

Fair enough to mention it in the article as it gives a clear description of what happened.

CatKisser · 06/07/2014 18:17

I honestly think this judge assumes a classic rapist is a baddie in black, hiding in the bushes waiting for woman walking in the dark on her own. Whereas anyone with a scrap of sense, or indeed anyone who's read the thread about rape survivors, knows the reality is far more likely to be something totally different.

Id be interested in other peoples' perspectives on the headline. Maybe I'm wrong, but is it right to include the word "drunken" in the headline? I think not.

McBear · 06/07/2014 18:14

But what is a classic rapist?

Pretty and drunk?! How dare she! Practically begging for it, obviously!

CatKisser · 06/07/2014 18:12

Pretty AND drunk, don't forget. She was obviously up for it. Angry
Yes, "classic rapist" is spectacularly ignorant. Surely someone in the legal profession cannot have failed to follow high profile sex cases where it emerges the rapist was anything BUT the "classic" man in a dark alley, to give a ridiculous stereotype.
Very, very depressing.

Optimist1 · 06/07/2014 18:10

I reckon her downfall was all due to the fact that she wasn't wearing modesty shorts (as introduced to me today on another thread).

CaptChaos · 06/07/2014 17:55

That is bloody awful, although not surprising. Our judiciary don't have a particularly good record on rape myths, do they.

A Judge (for the most part) has to have legal training and have worked in the judiciary for at least 5 years before they're appointed. I also thought that judges had to be fairly neutral in their summing up, except in rape or sexual assault cases, natch.

I notice the lack of men or women posting about how this shows that men accused of rape should be named before trial, you know, like they would be screaming for the opposite if he were found guilty.

McBear · 06/07/2014 17:35

But you don't have to have legal qualifications, or any really, to know the judge is a cunt.

It's obviously her fault for being pretty. Obviously no man can restrain themselves from a pretty woman Angry

McBear · 06/07/2014 17:33

Judges don't have legal qualifications tho do they? Aren't they meant to be a member of the public and they get legal advice from a legal person.

BelleCurve · 06/07/2014 17:20

Can we complain about the judge? Anyone know how?

ReallyFuckingFedUp · 06/07/2014 16:46

What training do judges get?

I'm pretty sure he got his degree out of a cereal box. You'd think, what with practicing law, and all that he'd be hyper aware of how the man in that story is the "classic rapist".

OP posts:
ReallyFuckingFedUp · 06/07/2014 16:44

rightly IMO still. he made it abundantly clear that men have to have to practice restraint when a woman they "fancy" is in the room.. Because it is so hard not to rape someone.

I know it's a struggle when I see good looking men to not rape them.

OP posts:
EBearhug · 06/07/2014 15:35

If only she hadn't been pretty. Or he'd just said sorry. Then it would all be all right.

What training do judges get?

StillFrigginRexManningDay · 06/07/2014 15:15

He couldn't resist the poor love what with those nasty women showing up with their vaginas.Hmm

When judges make comments like those it, rightly or wrongly, makes me question the morals of that judge.
