Man cleared of rape because he was too drunk to realise which bed he was in.

Sorry DM but here.

This guy's girlfriend refused sex, he stumbled into another room "by accident" and started having sex with the woman in the bed there.

He was cleared of rape.

There is so much wrong with this that I don't know where to start. I imagine he's been cleared because he didn't intend (apparently) to commit a crime. But the fact is that neither woman had consented to sex with him, so whoever he decided to penetrate it would have been rape. He seems to have been cleared on the grounds that if he had walked back into his (non-consenting) girlfriend's room and penetrated her without further ado, that would not have been rape. It obviously would have been.

:( scared and Angry all at once.

The police are just saying they are in shock by the outcome.I wanted his previous to be brought up but they wouldnt, hes an evil person, had the jury known about his previous they would never have let him walk free anyway. What he did to me that night came easy to him,i fougnt so hard that night,i begged and pleaded but he didnt care one bit,he wanted what he wanted and he didnt care what happened to me,i just dont know where to go from here, surely theres something i can do to try and get justice for myself and protect the next girl he sets his sights on!

Bokengirl, I'm so sorry for what he did to you. It's painful even to read about your experience so I can't imagine what you must be going through. There will be lots of women on soon to give you practical and supportive advice

The trial went on for a week and 2 days, the police told me he was looking a 9-12 years. What went so wrong? I havent stopped crying since i heard yesterday morning he was found not guilty

lemonmuffin · 02/03/2011 11:27

How awful bokengirl, I'm sorry you've been failed so badly by the justice system, it's shocking that he was able to walk free from court, i don't understand how its allowed to happen.

The monster who beat, strangled and raped me walked free from court yesterday. The evidence was so strong against him, even down to evidence of my hair being pulled from the root found in his car.The system has failed me badly and let this man walk free to hurt another girl and to walk around the same town i live in.I hoped to try and rebuild my life in some sense once id got some justice, ive now not even got that to hold onto.I wont ever get over the horror of what i suffered that night and now im even further from moving on.What were the jury thinking, they were presented with a book of photos showing bruises, the marks from being strangled,i repeated so many times "please dont do this to me" should that have been enough? I just need some advice,is there nothing more i can do now,its so wrong,im the victim here, how have i been failed so badly?

Why the random story at the end??

He basically stood up in court and said he wanted to rape his girlfriend, but he raped someone else by accident, and he was cleared of rape - is that right?

Best comment on here. My thoughts exactly.

PeterAndreForPM · 27/02/2011 14:47

I remember Crown Court too! Had forgotten all about it before this thread.

My mum used to be glued to it

MmeLindt · 27/02/2011 13:17

SGM posted a link to the Attorney General further up thread. Not sure if that will help, but emailing his office is a start. Here is the link again.

Other than that - writing to MP? My hometown's MP is pretty hopeless tbh, so not sure if I will bother.

Mumbybumby · 27/02/2011 13:10

I am absolutely speechless.
As others have said, he would have been committing rape regardless of which woman he had sex with as neither consented.
Absolutely unbelieveable and disgusting.

LarkinSky · 27/02/2011 13:03

I just wanted to add another voice saying how disgusted and furious I am in response to this case.

I feel helpless. I don't live in the UK but am still classed as UK resident and am a voter. Is there anything I can do?

BooyFuckingHoo · 27/02/2011 12:56

i posted a comment but they're moderating for this article and i commented on how vile it was of the DM to tag on the 'cry rape' story to this so it wont be posted.

I wish I didn't fucking know why things like this happen Booy but I do, and so do you :(

Dittany - yes and then the sentences nearly always run concurrently so basically if you've raped one woman, in jail terms you get to rape as many more women as you like 'for free' Angry

This is another case where if I was the woman who had been raped I'd be going to the civil courts arguing that regardless of the rapists sleep disorders or intent I had suffered damages and deserved compensation from the rapist whether or not the criminal courts thought he should go to jail.

thumbwitch · 27/02/2011 12:25

Gosh dittany - either you're even older than me or you have a fab memory - I remember Crown Court, was actually thinking about it when I wrote my post, but couldn't remember a single case from it if I tried! I used to watch it during the daytime, iirc, probably in school holidays.

ladysybil · 27/02/2011 12:21

surely there must be more to this story? the article isnt exactly the best bit of journalism i have ever read, commenting about completely unconnected cases in the last few paragraphs as if they were related to the main case.

if he was not so drunk that he could initiate sex, and actually have sex, then how can he be too drunk to notice the person he was with was saying no. I find this horrifying and hope its just dm nonsense.

BooyFuckingHoo · 27/02/2011 12:14

i am stunned by this. what logic could possible clear him of rape. he hadn't received consent from anyone that means he penetrated a woman without consent. he did, no-one made him, he did that and that is rape. how can he be cleared of soemthing he so obviously did?
