Doesn't matter who it's for, you are seeking renumeration for something which sounds like a total accident based on a child being overly adventurous. As many children are. The school aren't to blame, I'd be loathe to blame a child, but it's just one of those things. Yes having operations and the risks they being can be a worry and be a source of anxiety for child and family, but it doesn't mean anyone deserves money to soothe this.

Unless the equipment was faulty, staff guided or encouraged him then I can't see how any of it was the schools fault? If it happened in a public playground would you sue the council?

Was there a defect? Incorrect surface underneath? Too many kids using it at once or caused by a bigger kid etc or was it just an accident.

Id definitely write to them & ask for an explanation. They would have to have done an accident form & assessment afterwards. That's more use than 'suing'

Perhaps get your DC a phone or tablet & they can sit inside watching that instead of playing with the other kids. Also you will need to keep them off PE throughout school in case they get hurt doing that.

Children have accidents, it's part of life. Just because another child hurt themself there, it doesn't mean the equipment was faulty.
To have any claim you would need to prove all of these
-the equipment was faulty

• they knew it was faulty and didn't do anything about it
• a clear long term measurable impact/disadvantage sustained due to the injury. Not just 'he might not like his scars'

If you were sucessful, what would the money be for exactly? You need to show that he would incur extra costs as an adult as a direct result of this injury

It would be embarrassing for your child if the school’s defence in court was that your child was a fool or halfwit. They could use his reading level and spelling test results to prove their case.

But surely you should have your child removed because you are such a bad parent that you haven't properly taught him to jump on a climbing frame? Or face prison at the very least for your neglect?

At my dc’s school there was always a child in the school with a broken limb because of the monkey bars. It was just a part of school life.

You should be prepared to take your child out of the school if you are suing them. It’s not fair on your child .

Your child jumped and fell and did not at any point touch the money bars? Im really not clear how this is the school's fault to you.

A personal injury claim requires a duty of care (which you have to a pupil), a breach of the duty and the breach causes injury.

What did the school do wrong? It can't be equipment maintenance as he didnt touch the equipment. It cant be simply having the monkey bars because thats not a breach.

What are you suggesting the school did or did not do that caused the injury?

No you dont try to get money from an accident. Why do you deserve money! It was an accident. Imagine if every parent did this. The courts would be full on a daily basis with claims.

All schools will lose out directly or indirectly if this becomes a norm.

broken arms in children are relatively common, your sons sounds worse than my (non-medical!) experience. I see a lot of kids with broken bones in schools. Often after ski holidays actually! But several in recent memory from playgrounds/ trampolines and even a few in our school playground.

children need to take risks on play equipment, it should be supervised but there is always an element of risk. Just like when you take them to the playpark !

Yes, if it was a worker who was going to lose pay because of a faulty machine at their job, you get why they'd need to money. Or if there was no NHS and the parents were having to pay the medical bills, ok.
But presumably any play equipment at a school will have been checked as well as at any council playground, so it's just one of these unfortunate accidents.
