My mum wants to transfer ownership of her flat to me

Hi,
just looking for some personal experiences of this. My mum currently rents her flat out (no mortgage on it). She spoke to me yesterday and said she wants to give me and my husband this flat as sort of an early inheritance gift by transferring ownership to me. I’ll obviously go and see a solicitor but I’m just curious of people with experience of this was it straight forward? I’m aware there will be tax implications etc but anything else that comes to mind? Although incredibly grateful it feels very daunting at the same time.

There is no SDLT to pay (that's done on transaction value) but there is CGT to pay, which is calculated on market value, not on transaction value.

There is no tax implications for you, the receiver. Are you going to live in it?

If you are going to rent it out, think about who you will want to declare the income and the ownership needs to reflect that. ie. If you don't have a job it makes sense for you to declare the income but you would need to own in 100% to declare 100% of the income.

Are you going to live in it and if not do you want to become a landlord ?
If no to both, perhaps suggest she sells it and gives you the money instead.....

The other thing to consider is , if you got divorced. The flat would be taken into account when sorting out finances.

Would this not be considered to be deprivation of assets if at some time in the future your mum needs to be in a care home?

How old is your mum? And what is her state of health? If it's a deliberate attempt to avoid paying any future care costs which can reasonably be foreseen, then it could be classed as deprivation of assets:. Helpful link here

That was my first thought and that you may find it is treated as a gift for IHT purposes.

Your mum will have to pay CGT based on the current market value.

There may be IHT if she dies within 7 years of the gift.

If she needs care in the future it may be considered deprivation of assets, but if she is in good health now and it wasn't foreseeable that she would need care, that is unlikely.

It would become a marital asset.

If you don't plan to live in it, CGT will be payable when you sell.

In principal the gift is ok, as others have pointed out there are CGT and IHT considerations. Depending on your mother's health and other assets there maybe a case of "deliberate deprivation", but be aware not everybody ends up needing care and the average stay in a care home is 18-24 months. The biggest problem is that if you continue to rent it out, you have to take on all the landlord responsibilities, insurance, repairs, gas and electrical safety checks etc, add in the risk of bad tenants and having void periods, unless you are already a landlord, I would accept the gift graciously then quietly sell it.
