No - I’m not splitting hairs. You and another poster came on here to suggest that the word of LFI on “uk law” is gospel. I’m suggesting you don’t have the requisite understanding of law to be making that claim and providing useful background as a counter to your position.

It isn't beside the point - I believe we actually have the opportunity, compared to many countries, to make our opinions count. We have the opportunity to make our voices heard.

So to clear a few things up:

Sport and the performing arts are not the idealistic level playing field we might like to think they are. I'll stick to sport as it's the leisure activity I'm more familiar with. Sport already discriminates by sex and body weight, in para it discriminates on all manners of characteristics. It commonly discriminates on nationality, and this can vary significantly from sport to sport. On top of that national selection can be incredibly biased and loaded towards specific teams or athletes. Add in professional and amateur limitations and there is a whole other layer.

Israel and the occupied territories is not a fair and equal society. Israel openly discriminates between ethnic Palestinian Arabs and Israeli Jewish immigrants.

Fair sporting competition is closed off to significant numbers of people living under Israeli jurisdiction. Particularly where international travel might be involved. It is beholden on international governing bodies to ensure that national and regional governing bodies maintain a level of fairness and equality, particularly at grass roots. If a national or regional governing cannot maintain that code, or where it is prevented from doing so by the policies and actions of a national government, it should not be allowed to compete.

Its still a resolution. Lots of cases never get to an action because of a letter from a lawyer reminding people of the law.

There are many reasons why people or organisations choose not to go further down a route towards litigation. It’s a strategic question especially when there is media involved. Are you suggesting therefore that all the times LFI have chosen to drop their cases or people have ignored them and cracked on, it’s because they were wrong?

No, the case hasn’t been resolved legally. Someone sent a legal letter and someone else did something. That’s not a legal resolution that’s a decision that’s been made pre-action to avoid going any further down a legal avenue.

i asked for a quote because that poster is suggesting I misunderstood something and so I asked for some evidence - fairly basic for someone who is so into the law and upholding it I would have thought.

The organisation originally said the Israelis could not compete not because they didn't like Israelis, or they supported BDS, but because - they said - they couldn't manage the security requirements that they thought would be needed. So the discrimination claim had there ever been one would have been for unlawful indirect discrimination, and the defence, had there been one, would have been "objective justification" - that they couldn't manage the necessary security, that it was a legitimate aim to want to continue with the competition, and that their decision to bar the Israeli competitors was proportionate. Whether that was the case or not, in the law of England and Wales, on those facts, hasn't been decided in law because the people running the competition decided they could manage the security.

The latter but some people will always see the former. and the LFI letter cites law relating to the former because anti discrimination law applies. That’s why the discussion turned on security because that’s a possible defence to discrimination.

Are they refusing them because they are Israeli or because they are representing the state of Israel? It's two very different things.

But the law didn’t decide. LFI sent a letter citing some law, and the people they sent it to backed down. For the law to decide it would need to have gone to court and a judge would decide what the correct application of the law was in those circumstances.
