I have been subject to bulling, humiliation, and threatening by parents

who breached their NCMA contract, didn't pay me, and threatened me and my family to terminate my contract without any notice.

I have suffered from them for more than 13 days I fear they may harm me, my family or other children I care for, or submit untrue complaints against me to damage my career and deter me from pursuing my legitimate and legal rights.

?so have you already allowed him to sign an agreement stating he is out of contract and that he doesnt have to pay you any other money??..if so, are they still threatening you?? what are they NOW saying and why is he/they still contacting you??

itsachallenger · 18/01/2008 19:02

Regardless of monies owed I would give him the termination or have your DH deliver it in person & refuse admission to him or his wife for your own safety & that of your other mindees.

Get rid of them & ignore the insults (difficult I know ) just refuse to open the door to them & call the police if they don't go/ Keep a log of the visits/times/dates of threats & tell them you have taken legal advice.

Horrid for you

Get in touch with your co-ordinator as well. Mine was great, she made sure other CM's new what was going as well, so they could be aware of potential problmes, and gave them the chance to be wary of the person if they tried to contact other CM's for care.
Get a notepad and make a note of everything like I said

I had similar problems - over money, surprise surprise.
Definately tell the other parents whats going on.
Make notes of any phone calls, visits etc from the man abusing you. Include dates and times.
Go to Citizen's Advice, tell them everything

nonna · 18/01/2008 14:16

read this as well(termination of childminding contract? )

Its perfectly fine. Have you got a signature on it?

I don't know what to suggest, other than the 3 contacts we've already discussed. What about your local co-ordinator? She MUST be able to do something to help.

nonna · 18/01/2008 14:12

i did all of that and i send a copy of that to the ofsted , ncma, cis & early years
and went to the police

You are not employed by the parents - you are SELF-employed and you offer a service. They sound a complete nightmare....

nonna · 18/01/2008 14:09

This document confirms ;
This termination of contract is due to mere personal circumstances on my part, and it is made after my own request, with the approval of my childminder.
I and my childminder agree that there are no pending matters, disputes or concerns after the termination of the childminding contract.
I confirm that I have received from my childminder all items that belong to my daughter; including all clothing items and outfits, unused wipes, nappies and medicines.
but i still afraid??
i did all the thing right

Jeez nonna! That's dreadful! Start writing these things down. Times, dates etc. If this continues, you'll loose track of what was said and when.

Karen999 · 18/01/2008 14:08

Oh poor you. They are clearly threatening you and intimidating you. I would contact a lawyer and get their advice. At least that way if they say to you that they have been asking about it "for days" then you can say that you too have sought advice.

Re calling the police...I take it you are in England? To be honest in Scotland that kind of behaviour could constitute a breach of the peace.

Did the police give you any advice on how to deal with it?

flowerybeanbag · 18/01/2008 14:08

Sorry nonna, for some reason I assumed you were a nanny.

Do speak to the CAB anyway, and push the NCMA and Ofsted. I don't think this is purely a contractual issue, if they are making threats etc, so Ofsted saying that is just avoiding the situation.

I hope you get some decent help.

repeated his threats over and over and his shouting continued and my kids were scared and I was afraid he may try to hurt me or them as I didn?t know exactly what he was threatening of doing.
? As a last resort, as I feared for the safety of my family, I offered him not to make him pay and to give him his daughter?s items provided that he sign the ?Termination of Childminding Contract? document.

MaureenMLove · 18/01/2008 14:04

Are the other mindees parents aware of whats going on? I know each families business is confidential, but they need to be made aware of what going on, if you fear for the other mindees.

Have you got anywhere with NCMA yet? Don't just leave it that you can't get a reply.

nonna · 18/01/2008 14:04

? he said that I should learn that childminders are employed by parents and thus should work with parents to implement what parents want for their child.

OP posts:
flowerybeanbag · 18/01/2008 14:02

Is she self-employed??

You are right. I apologise.

Hmm. Will have a think.

nonna · 18/01/2008 14:01

paren said he will pay nothing and claimed I haven?t discuss the settling-in period with him and his wife before signing the contract.
? I reminded him that this is not true and that I gave then a copy of my policies and a copy of the contract to read and I allowed them two weeks to give a good read and ask any questions. I reminded him as well that I did offered them a settling-in period and that it could be between two and four weeks and that he and his wife choose not to have a settling-in period.
then he said there is no way he will pay me and started shouting and threatening me and my husband using phrases such as: ?you don?t know what I prepared for you and you don?t know what I can do. I have been asking people about this for days now so don?t force me into a corner?.
