To expect a company to honour what its AI customer service email promised?

TLDR: Should a company refund after the AI email bot, told me incorrect information, and seems to have been programmed to agree with the customer.

Change a few details as I might want to follow this up in real life.

Booked and paid for something - let's say a camping pitch in a large field.

Used a company I have used lots of times before- normally they own the field, sometimes they rent pitches (I didn't know this)

Due to emergency at home I couldn't travel on the expected date, so I contacted the email given and asked if I could turn up later in the week- I still wanted to use what I had paid for, I just couldn't get there on time.

I didn't realise in the initial conversation that it was AI as it was over email so I didn't read the reply immediately and it was signed off by a person's name.

In writing I have proof that the customer service email chat said:

It is ok to turn up at any time during the booked period

I double checked this and was told again

You have paid for your pitch, you can access it at any time during the booked period

Then I asked if it was ok to downgrade (I had a more premium option but without DH who now couldn't travel I wouldn't be able to do it on my own, so wanted to downgrade to the cheaper easier alternative (so in this scenario we were bringing a caravan and wanted to downgrade to tent)

AI email said

It is fine to downgrade but there will be no refund due to price difference, just let them know when you arrive

Brilliant, exactly what I needed.

When I arrived (four hour drive) I was told my booking was immediately cancelled due to no show, and that the original company has kept the money and not sent it on to the campsite.

Apparently it is NEVER possible to retain pitch without attending.

Thankfully it was out of season and they took pity on me (they don't normally accept on the day bookings) but obviously I had to pay again to stay there.

Finally got through to a human who said all bookings are non refundable* if cancelled with less than a week's notice - they will not read or consider what the AI bot said.

*This is what I was expecting, but I would still have needed a letter from them so I could claim on my travel insurance.

AI really BU to expect them to honour what they had put In Writing(!)?

Editing to add that it is never possible to turn up after the first day, regardless of who owns the site. Bookings are always cancelled after no show on the day

Definitely not being unreasonable.

Air Canada lost a similar case in Canada. I don’t think there’s a similar UK case yet, but a general principle that automating a process doesn’t remove the provider’s responsibility if something goes wrong.

Did the email have any disclaimers about it being AI?

This issue will get more and more prevalent - if the booking company (who are different from the actual site company I am guessing - you used a third party?) won't even look at the emails from their AI then this is something I would take to Anna Timms at the Guardian. Because as I say, this is a very modern problem and definitely something for them to get their teeth into because there will be many more of these types of issues in the future.

If they don’t honour what the bot promised take it to their social media channels and news outlets.

Ooh yes I’d fight that battle too OP! That was a representative of the company you were talking to and you acted on the information they gave you in good faith. What on earth is the point of “employing” ai bots for the customer service chat if customers are supposed to know they can’t rely or believe what they are told by them?

Thanks for the links- no information at all about it being AI- which is interesting as I've been clicking other companies support channels and most of them say immediately that they are AI and that you can request a human.

The email made no representation that it was AI, in fact by signing off with a name it made it seem more like a person.

Still waiting for a actual person to reply- I have replicated the question and the AI still gives false information - and doesn't announce that they are AI

It sounds as if you may not have stated when your booking was for, so it would not have realised you were chang8ng the booking at short notice.

Thankfully it is all in writing, it understands and repeats my issues and offers the solution. It's just the solution isn't correct.

I've found a WhatsApp number so I'm waiting for a reply

their Customer customer Service told you what you could do

They’re using a chatbot for that so they have to take responsibility

I will update. I am really cross because not everyone could have found the money with no notice, and what would I have done if they had refused me.

They have to be accountable for what their AI bot says. What else is the bot telling people?

It doesn't matter if its Ai or not. You have a contractual agreement with them in writing which they broke. I'd be advising them I'd take them to the small claims court if they don't return your money

Yanbu at all. Companies need to stop using chat bots if they aren't prepared to stand behind the responses

You absolutely can challenge them! The EU AI act and GDPR are your friends for this. Oddly, I would also use AI to get all the terminology correct, but essentially you need them to explain their decision making, and the information you were given. This seems to fall under automated decision making, without human interaction, so thats all their fault.

This is crazy - what is the point of a customer service bot if not to provide correct answers to questions? How else were you meant to get that information?

I would fight this to the bitter end - and def go to the media so others are aware as well. Let us know how you get on!

Absolutely do not back down. It's their own fault for using a bot with no human oversight. Completely unacceptable and irresponsible use of AI. Hopefully you can teach them an expensive lesson.
