Section 75, experience and expectations please!

I bought an item for £3,000
i reported it faulty to the manufacturer within 3 months
they refused to fix it or refund, saying it is fine (it is definitely NOT fine!)

I opened a section 75 with Amex about 6 weeks ago at the start of August. I contacted Amex a week ago for an update. They can’t and won’t give me one.
amex say they don’t have a timescale for dealing with Section 75, and they don’t give updates.

I find this ridiculous! I could be waiting months or years, and I cant get an update how my case is progressing.

does anyone have experience of a section 75 claim and how long it took?

Any joy @holiday22 ? For what it’s worth I found Amex superb in a similar situation. Was refunded £2200 within a few days of submitting claim

8 weeks - if they fail to respond with a final decision within that time frame take it forward to the Ombudsman.

I thought it was 28 days when I did my against Virgin Holidays during Covid.

A quick Google search suggests 8 weeks and then go to financial ombudsman.

Financial Ombudsman: If your credit card provider rejects your Section 75 claim or fails to respond within eight weeks, you generally have six months from their final response letter to escalate the case to the Financial Ombudsman Service.

My question is about the section 75 process. Do you have anything helpful to add?
I’ve no experience of section 75 and I’m trying to figure out if Amex are being reasonable or not, given they have time line to work towards, nor do they provide feedback on open cases. I’m in limbo!

The vendor claims it is a design of the product.
it is clearly not fit for purpose in my opinion, and that of professional trades people.

But my question is specifically about section 75 and how long people have waited for it to be resolved.

Surely then must be loads of buyers that have complained all over the internet?

Why does that matter? She’s asking about section 75, it’s literally in the title, not the manufacturer. You don’t need to know everything.

Twice within the last year.
Both times I was refunded within 10 days, with the caveat that it could be reversed if the other party could prove I was in the wrong.
One item was c. £60, so below the limit.
Not Amex though.

Mine was done and dusted in my favour after about a month. £700 though.
