AIBU to think neighbours should not be naked in their garden?

For context: Our house is on a new build estate and the houses are pretty close together. It’s fairly easy to see into neighbours gardens because the trees etc are not well established yet.

AIBU to say my neighbours shouldn’t be naked in their garden. They are often out in the garden totally naked taking photos of themselves. They have parties quite often and it’s not uncommon for them and friends to be out in the garden naked / using the hot tub etc.

Am I being a killjoy ? Seems excessive to me.

Someone’s eyes pointing in a specific direction isn’t the same thing as ‘looking’.

The law is fairly straightforward, it is legal to be naked in your garden but you should not be causing alarm or stress to others. The guidance is that fences or hedges should be sufficiently high that your neighbours shouldn’t be able to see in from their garden. Sexual activity is different and that has a higher threshold so that wouldn’t be allowed if your garden can be viewed from any point externally eg from neighbours upper window.

I think moving is the best option op, they don’t sound like the best neighbours

If its laying in your garden i agree there is no law to stop it, police will not be interested.
Fences make sense and if a neighbour sants to look out of a bedroom windos it is tjeir choice and they do not need to look if ghey dont want to

Unfortunately though, some parents handle it by laughing at their child and calling them a 'little prude', as happened to me. Which is why I feel passionately now that parents need to be sensitive to whether or not their children seem comfortable with their nudity if they choose to go naked at home.

That assumes that the parents in question are able to handle it maturely themselves and actually listen to their children if they seem uncomfortable.

Unfortunately though, some parents handle it by laughing at their child and calling them a 'little prude', as happened to me. Which is why I feel passionately now that parents need to be sensitive to whether or not their children seem comfortable with their nudity if they choose to go naked at home.

Its only becausethe general public isnt used to it yet, its like a victorian wearing a mini skirt im sure one day we will accept how we are are feel comfortsble nakes instead of wearing a bikini and be left with those awful tan lines instead of a all over tan

I get what you’re saying but it probably depends on how overlooked your garden is too. I have houses behind so couldn’t do this but I’m often naked around the house

I’m a prude so would hate it. Have zero desire to see my NDN’s naked and I’m sure vice versa. I can’t fathom why anyone would want to do this either. If you live in a detached in the middle of nowhere then feel free otherwise keep it to yourself.

But should it? So it’s a discussion point then isn’t it? About how bodies are completely natural and normal and that we all have them and that in the privacy of your own home that you are allowed to not cover up your body. I’m not saying I’m right by the way, I’m no expert on being exposed to the human body vs keeping it private and the effects to that has on children. I’m happy to be proven wrong but to me I kind of like that (in a non sexual way of course) children will see body parts. They’ll see them eventually and I feel like seeing that we all look a bit different is a good thing. Maybe I’m weird. That said, I wouldn’t personally do it but I resent that a man can walk down the street with his nipples on show but that a woman can’t. Different wt argument I know but opens up a wider discussion IMO.

It seems to be a British thing as no one cares when abroad

Wish I had this confidence, I can’t even just go in the garden in my underwear to put some washing on the line

Another thread where posters on MN seem to inhabit a different world to the real one. It beggars belief that so many seem to think OP should be blasé about her neighbours cavirting about with theur friends naked in the garden.

Personally OP I"d be reporting them to the police and the police can decide whether they are actually committing a criminal offence. Or at least have words with them about consideration for others

I'd be very careful with this advice as I had a client who reported this, she was advised by the police that the neighbour was complete at liberty to sunbathe naked and my client reporting as such could potentially charged with harassment.

Many years ago when we moved into our current home, our neighbour came round to introduce themselves and say welcome. She also wanted us to know that her and husband were naturists and when the weather suited would spend a lot of time in their garden naked. She said that we were always welcome to call round but to be aware that if we went round the back unannounced we may catch them with no clothes on. They weren't bothered for themselves but just to let us know.

Anyway, the road consisted of bungalows, they had high fences/hedging around their garden and we never saw so much as a naked shoulder let alone anything else.

Fast forward to three years ago, a family moved into the bungalow the other side of them and proceeded to get planning permission to make it into a two storey building. Naturist neighbours explained the situation when commenting on the planning application and suggested Velux windows. House duly built (normal windows) and neighbours started to complain about the naturists because they had children whose bedrooms overlooked the garden. Naturists refused to change their ways and new neighbours said it was causing them distress. Eventually new neighbours sued the long time neighbours. Sadly, before it came to court the husband died and the widow moved away.

For the purposes of this thread it would have been interesting to see what the outcome of the court case would have been.

Now. Would I be unreasonable to ask the neighbours to ensure they have clothes on if I had a house viewing? Pa ha

Ask them if any of their friends would be interested lol

Gross! I'd hate having to see my neighbours and their friends in the nude, whether they were sitting around or playing outdoor party games. Aside from anything else, most people look awful without their clothes on. 🤢

In the case of the NDNs I think the behaviour there would constitute disorderly conduct, and therefore could be grounds for legal action if no amicable compromise could be found.
In relation to simply being visible or overlooked however, it is not sufficient to say “most people are likely to find it harassing, alarming or distressing” to merit legal intervention, as the law specifically includes the addendum:

“An act of public nudity is unlikely to
constitute this offence unless members of the public
were caused actual harassment, alarm or distress
(as opposed to considering the likelihood of this
happening or the complainant personally finding
nudity distasteful or offensive).”

So there would need to be some intention on the part of the naturist to cause upset in order to meet the threshold for that offence. Simply going about your normal business, e.g. sunbathing naked in the garden for example, in the absence of any other factors would not attract any police interest.

“In the lawful situation where there is an absence of any
sexual context in relation to nudity and where the person
does not intend the behaviour to be, and is not aware
that it may be disorderly, it will not be appropriate to take
any police action.”

It is difficult to assess how the courts would view the situation as there have been so few prosecutions, and none successfully for the practice of naturism in itself. Most cases of course don’t get as far as the courts, as they wouldn’t meet the criteria of being in the public interest or have the likelihood of securing any conviction.
