Bought house but they’re still in it now!

So we exchanged contracts last week and completed by 10am today. We vacated our house by 12.30pm as our buyers keen to get in and contract said 2pm. The house we bought was supposed to be ready 2pm but it’s still
not ready! Now the seller (house we now own!) is saying they’re going to struggle to empty it by 8pm! And that sounds optimistic. They just don’t sound like they packed up properly. Anything we can do? Solicitor and estate agents shut.
We have put most of our stuff in storage - which is shut. We have though thankfully hired medium van which has our essential stuff in it. But we just want to unpack it now. We have 2 kids and have been at a bowling alley and kfc trying to kill time since school.
Would we be unreasonable to demand we move in 8pm?

Definitely go there now. You can help by throwing all of their stuff out onto the drive.

Woompund · 26/09/2025 17:57

Get in there and 'help' them remove their things. You don't need to be too careful either but everything needs to be out by 8pm. They don't get to stay another night. You book yourselves into a local hotel and seek costs back from them via solicitors but make sure they are out and you have keys before you go.

They have sadly blocked driveway with a big hire van. They definitely weren’t organised. Whole way through it was like this with paperwork so should have known it’d be bad but just didn’t expect they’d be this late!

Essentially they have failed to complete.

In reality, you need to be "reasonable", as threatening police or anything daft will just prolong things.

I would TELL them that at 7pm, you will be accessing the house and moving your stuff in, and that they need to either put everything onto the driveway to the side, or leave any remaining stuff in one room at the front of the house, then return at 10am to collect it tomorrow. Make it clear that they do NOT have access after 7pm.

If they cannot make this deadline, then you should inform them that they will need to pay for hotel rooms over night for you, along with any additional costs e.g. meals out. If you ate out at KFC, then pass the bill on to their solicitor as they failed to complete on time.

MotherofPufflings · 26/09/2025 17:56

While you have every right to move in, I'm not sure how you force them to get out. I can't imagine the police will get involved because this is a civil matter.

I think one of you needs to go round there and say that if they're not out by, say 8pm, that you will have to book a hotel and you will pursue them for costs. Then take pictures showing they're not out and maybe a video if you can do so without causing drama.

Hopefully this will work, otherwise it's a hotel until they're out and contact your solicitor on Monday.

Have you got free legal cover with any insurances you hold?

Helpline more likely to have out of hours advice, esp as your solicitor is closed.

ItsOnlyRainFFS · 26/09/2025 17:56

Yep we’ll go round as really do need to get kids more settled than this. I will be firm! Didn’t know if this was as much of a piss take as I thought it was but it clearly is!

Call your solicitor to call their solicitor to make it their problem.

They're in breach of contract.

TheatricalLife · 26/09/2025 17:55

It's YOUR house. They don't own it anymore and have no right to be in there. It's their own fault they aren't organised. Go and start moving in. I can imagine it's going to be in a right state to clean as well as they obviously will have been traipsing in and out. Twats.

AlorsTimeForWine · 26/09/2025 17:54

Personally I'd be really clear they need to get out now now or you'll be seeking financial recompense.

Park up get your stuff - Find an empty room and start moving your stuff in to those empty rooms while making in clear they need to get the fuck out ASAP. No carefully folding clothes. Dump them into a bin bag and move.

Their failure to plan isn't your problem.
Make it unconfortable and also start moving their stuff onto the street.
Do not let them keep ONE thing
On the property even if it means they or you go Until 1am

Offherrockingchair · 26/09/2025 17:54

Grow some balls! It is your house now. Why are you acting like you need permission? Call the police and report them as intruders.

HollyhockDays · 26/09/2025 17:54

Don’t let them keep or store stuff. They’ll just take the piss.

Bitzee · 26/09/2025 17:53

Go round. Park on the road. Start setting up the essentials (kids rooms) around whatever the hell they’re still doing.

ItsOnlyRainFFS · 26/09/2025 17:53

My DP is raging as we’re both sleep deprived as been packing and cleaning and organising meticulously for 2 weeks now!
It’s not a medical emergency they just said how hard it was to pack up and blamed their removal company! No shit it is hard if you leave it to last minute

OP posts:
ItsOnlyHobnobs · 26/09/2025 17:52

do you have the keys?

Park outside the front of the house.

Do you have family nearby who can have the kids/possibly overnight?

I think one of you needs to walk in and say you own this property, and you need to move in and get your kids to bed.

RealEagle · 26/09/2025 17:52

Go in it’s yours now

Geranium879 · 26/09/2025 17:51

Just go in and start unpacking. Get the kids places to sleep ready etc.

WhamBamThankU · 26/09/2025 17:51

Wow! I’ve read threads like this before where the person in your position has helped them pack to move things along. But you’re under no obligation to! Are any rooms empty to start unloading your hire van?

exhaustedbeinghappy · 26/09/2025 17:51

As PPs have said, it’s not their house anymore - it’s yours - so it’s perfectly reasonable go into the house tell them exactly that and to start moving your stuff in. They have no legal right to be there.

I know that’s easier said than done, but they need to be told in a calm factual manner that they are in YOUR house and to leave

Bobiverse · 26/09/2025 17:51

Just go in. They can empty while you are there. If you want to be nice, give them one room to store their stuff in if they can’t get it all out and they can collect at a convenient time for you. Or, go in and anything still there is yours. Anything there after the time in the contract is yours.

MeridianB · 26/09/2025 17:51

Brightermornings · 26/09/2025 17:47

Start moving in. Legally it’s your house.

This. Call the police if you have to but they need to leave (and ideally get all their possessions out of the house). Guessing this means they won’t be cleaning it either. It’s outrageous.

MathiasBroucek · 26/09/2025 17:51

Accidentally voted unreasonable. Their behaviour, unless triggered by a medical emergency is a disgrace. Do NOT go to a hotel! What does your lawyer say?

KeenGreen · 26/09/2025 17:51

This is shocking! By 8pm!
That’s awful! Yes demand they leave now and surely they are technically trespassing now?

How can they be so disorganized and disrespectful! Mind boggling!

InMyHealthyEra · 26/09/2025 17:50

I voted YABU because YABU to accept any of that.

You order them out of your property immediately and either put all of their belongings out the front or in a designated room for them to collect later when it suits you. First thing Monday you call the solicitor or estate agents and start the process of financial compensation for their breach of contract

ItsOnlyRainFFS · 26/09/2025 17:50

A couple of hours delay is not too bad but I’d say they have to be out by 6pm. If they haven’t got all their stuff it’ll be in the garden waiting for them
