New neighbours complaining about our toilet

We’ve got a new build where one side of our house completely backs on to a neighbours garden - that’s the back wall/boundary of their garden essentially.

Downstairs, we have a toilet with a window which is on the side of the house where that wall is, and has a small window which opens at the top. Their garden is slightly lowered so it isn’t within reaching distance. It’s a fairly odd design but we’ve lived here for years with no issues.

The neighbours have recently changed. In one of the early weeks in April when it was warm, they put a note through the door which asked we keep the window closed when it’s sunny because of the smell. We don’t really open it much anyway so thought nothing of it.

We’ve since had a further note through this week asking it stays closed on Saturday because they are hosting a BBQ for a family members birthday. We also have family over on Saturday and the downstairs loo is the one they’d naturally use.

Are the neighbours being CF? They surely can’t expect us to introduce a rule where we only crap upstairs whenever they say so!

If it's bad it's possible you could be breaking the law on this one. If they can't relax in the garden because of the smell, you would be in the wrong. Although I'm not sure if that would get to court.

"For the smell to count as a statutory nuisance it must do one of the following:

unreasonably and substantially interfere with the use or enjoyment of a home or other premises"

Personally I'd get the drains checked for leaks or gaps and just fit an extractor, I'm sure it's more the thought of it than the actual smell.

A dump so bad it actually breaks the law ?

The window opens into the neighbours garden…

I imagine it’s something like this in terms of the OP’s window actually opening into the neighbour’s garden, though here it’s fairly obviously a dodgy extension. Whereas the OP says they live in a new build, so presumably planning compliant..?

I would have the drains checked. We once had an issue with a god awful smell. Turned out one of the drains was full of builders rubble and rubbish. Cleared out and no issue since. If you or your neighbours have water burbling back up into any sinks it’s definitely drain related. That said, the downstairs loo in my house is very much a no poo loo. Send the smelly boys upstairs 🤣

Catwalking · 16/05/2025 17:33

How do they know the window is for the loo?
Bet it’s their own drains!
I’d ignore it, & offer them some essential oil candles?

Sorry but that’s full on CF almost like the Mumsnetter whose la di da neighbour was hosting a garden party for “well to do” friends and wanted Mumsnetter to not use her garden and to keep her kitchen door shut.
I would get a good couple of old skool stink bombs and release them outside as close as possible to CF’s fence. I doubt the BBQ smoke could fend off a stink bomb.

And a whoopee cushion that makes disgusting fart noises!

ScouserInExile · 16/05/2025 17:14

We have the issue of being able to smell our neighbour's toilet also, and it really isn't a pleasant thing to have to live with. It is right next to our wall, and their window is permanently open.
I know people here are making fun of the whole concept, calling it out as snobbery, but if you were living with it you might feel differently. I feel sure that none of you would like to be in this situation. Not wanting to smell someone else's shit on a daily basis does not mean you are Hyacinth Bucket or have delusions of grandeur.

PuppyMonkey · 16/05/2025 17:10

Can you start a WhatsApp group and add them so that the lads can give everyone fair warning when they’re about to dump their load?Grin

Put a note round saying you have guests at the weekend, some of whom are vegetarian and could they please not have a BBQ as you all find the smell objectionable.

let them see how bat shit crazy they are. If they never want a waft of a smell from a neighbour they need to move somewhere more remote.

Then they come back and say “we are cooking vegetarian food on the bbq” and so the madness continues.

LittleBitofBread · 16/05/2025 17:07

SpunkySquid · 16/05/2025 15:13

It seems extreme to me to be able to smell it from outside. Surely it’s dissipated enough that you wouldn’t smell it out in the garden and fresh air unless they’re stood right outside the window waiting for a sniff. This is so weird.

I agree; I can't imagine how they can smell a loo that much in this situation.

It's probably not even smelly. It's the fact that they know the window is open and they know there is a toilet on the other side of the window and are grossed out by the mere idea of other people's bodily functions.

I agree with this. I bet it doesn’t smell. I mean previous neighbours didn’t have an issue 🤷‍♀️

Cognacsoft · 16/05/2025 16:58

When their friends are visiting stand in the toilet, window open and shout very loudly.

Who has used this toilet?
You know our new neighbours asked us not to use this toilet when they have visitors. We'll get more notes now.

Put head through window a la Hyacinth Bouquet and shout 'Sorry, as you were' as you shut the window.

They'll never ask you to shut the window again.

I suggest you put a silhouette of a 🖕 in the window asap

OneFineDay13 · 16/05/2025 16:51

Why can't the neighbours move their BBQ area to another part of there garden? Isn't that the logical answer I don't think anyone has suggested

It sounds like from ops posts that their seating area is near said offending smelly window.

Iamthemoom · 16/05/2025 16:50

If I was having a bbq I definitely wouldn’t want the smell and sound of four men’s toilet visits going direct into my garden. It does sound like a poor design and they moved in after you so had the opportunity to think it through. While of course they can’t ask you to keep toilet window shut, I do feel for them. The sound of one man pissing would be enough to put me off my burger let alone four and the smell issue too!

thegirlwithemousyhair · 16/05/2025 16:47

Tell them you dont want to smell their rank barbeque when you're taking a dump.

sweetpickle2 · 16/05/2025 16:47

Ignore the letter, but buy some poo drops.

housethatbuiltme · 16/05/2025 16:47

How smelly is your loo that it needs airing so often and others in the area complain.

Also who visits someone else's house to crap? Shy of having medical issues like IBS/chrones etc... its not common for family to come over to visit and then line up to consecutively christen your toilet.

Are you sure its not a noise issue, maybe they are trying to in a faux polite round about way attempting to tell you that the acoustics are amplifying so all and sundry can hear the cavernous echo of you pebble dashing the bowl. Which to be fair would put me off my sausage at a BBQ.

TheOriginalEmu · 16/05/2025 16:46

Amanda98 · 16/05/2025 13:58

Yeah, this. Classic MN with everyone distancing themselves from doing smelly craps!

And you yourself said that ‘in a house with 4 men it won’t smell of roses’ as if male shit somehow is worse than female shit. 😂

HelpMeGetThrough · 16/05/2025 16:45

BurntBroccoli · 16/05/2025 16:05

There was a story in the news where someone’s drain had been cut in half by a new telecoms line I think it was! So everything was backing up 🤢.

Sounds like everyone in the OPs house is a bit backed up if they smell that bad.
