To expect compensation from holiday company

Changing a few details and being vague to remain unidentifiable. My partner and I recently had a 2 week holiday somewhere warm to celebrate a birthday and anniversary. On day 2 of the holiday my husband was injured as a result of something breaking (that shouldn't have). He grazed his forearm from fingertip to elbow, slight grazing to the leg and suffered a bump to the head. He received first aid from a hotel employee including an ice pack for his head. The next few days were a write off until his wounds healed and he didn't feel so sore. I have pictures of it all and the bruises He still had 6 days later. It was reported at the time and the travel company representatives checked in on him.
On our return I submitted the photos and a report of the incident to the travel company for some kind of apology / compensation, but they have told us that is not possible as we did not get a medical report.
This seems so unfair and we are wondering if we should take it further. What are our chances? Anyone have any experience of this.

I do think your entitled to something.

Something similar happened to us at alton towers when were staying for a weekend, there was a hole in the ground where a bollard had been removed. My DD who was running at the time fell down it and damaged all her ligaments ( confirmed at A&E)

Alton towers were fantastic, this is everything they done

Got a taxi to and from the hospital paid for
Free electric scooter as she couldn't walk and fast pass through all the rides
Fully expense paid weekend stay any time we wanted with everything included (except food)

Honestly it was a massive pain when it happened as we had DD then a 4 year old and a newborn, we had traveled 5 hours so going home wasn't a quick option and it meant my husband had to take her on and off all the rides as i couldn't lift her weight, anyways i thought the response from alton towers was fantastic and i always recommend them purely based on their response.

That's the very definition of a 'graze' OP. Sorry, but I also think you're being a bit ridiculous.

For context - the attached was an injury to my leg after a manhole came away at a hotel several years ago and I literally lost one leg down a hole. It was also deemed a 'graze' with 'some bruising' by insurance. I got an apology and a nice dinner from hotel but that's all.

Don't pursue any compensation OP
A graze and scratch that didn't require medical intervention!
Most people have a story to tell re similar experiences

TotallyFloored · 18/02/2025 12:24

I agree with others stating that if the injury was not bad enough to seek medical assistance, I fail to see how it was bad enough to make any kind of claim.

In addition - you had no real losses and the point of compensation is to put you in the position you would have been in save for the wrongdoing. It is generally not to punish the other party.

You have no real losses here - no medical bills etc... You could argue you missed days of your holiday I suppose, but that goes back to the original point that the injury was not bad enough to seek medical attention and appears very minor from the photos you have posted, so I don't think you'd get much sympathy trying to run that argument (as can be evidenced by the majority of responses on this thread). Most people agree it is something they would shake off and just get on with it. To be fair, I feel I have done worse shaving my legs...

I’m an ex holiday rep.

The correct procedure would be to fill out an accident form for the customer in resort which goes back to head office.

We would NEVER compensate for an accident or illness as this is admission of guilt and responsibly for the accident and could be used at a later date if it goes to court.

Even an apology is risky but I would definitely have kept in touch with you in resort and checked on you which it sounds like they did.

I would have also signposted you to DR or hospital if you had asked for one.

It sounds like your husband didn’t need medical attention so no medical report from a DR or medical report required.

You wouldn’t just get money of a holiday for being ill or hurt, you’d need to take legal action or make a claim against the company with evidence provided.

Claiming for illness or injury is a serious issue not just money off a hol.

Growlybear83 · 18/02/2025 12:24

😆😆😆 Seriously OP, how could thst have resulted in a few days of your holiday being a write off?

Why didn't you get him checked by a doctor if he is on blood thinners and had a head injury and we're concerned. I don't know what more you expected the hotel to do than administer first aid.

scanni · 18/02/2025 12:23

Blood thinners, head injury yet didn't see a medic and now want compensation.

I'm embarrassed for you.

Saggyknickers · 18/02/2025 12:22

Those scratches on his arm caused the first few days to be "a write off"??

You must be joking.

friendlycat · 18/02/2025 12:21

Without seeking any medical assistance at the time there really is nothing you can do about this.

shellyleppard · 18/02/2025 12:20

Dear god its a graze.....why on earth did this stop him doing anything on holiday??? If he had broken a bone then yes I would expect some compensation. But a graze???? Takes the piss

Whattheduck · 18/02/2025 12:20

Ihaveausername · 18/02/2025 11:48

We got nothing from the hotel. They didn't even check up on him. It was the holiday company that checked up on him. I know it looks like a simple graze but when you are on blood thinners AND you have a head injury it is very worrying.
OK we may be out of order wanting compensation but not even a £10 voucher off our next holiday.
And yes we did have travel insurance, cost a lot due to his medical history. But nothing to claim there as he didn't want to see a doctor.

If he’s on blood thinners and was bleeding a lot and also had a head injury then you should have sought medical advice you couldn’t have been that worried
For any claim you would need a medical report not just a few photos

ttcat37 · 18/02/2025 12:20

Ihaveausername · 18/02/2025 11:21

I will add a photo of his arm. This was taken the day after the incident after all the blood had been cleaned up. It wasn't a simple graze.

This took him out for 6 days? FML. I was out for lunch 6 days after a c section and on blood thinners. No wonder you’ve not been offered a refund- 99% of folk would have dabbed some savlon on and got on with it. Bit grabby OP.

Vergus · 18/02/2025 12:19

And they’ll see through it too so don’t waste your energy

JudgeJ · 18/02/2025 12:19

Doggymummar · 18/02/2025 11:28

That's a scratch, he's being a bit wimpy here!

The photo looks like our daughter's arm after she stumbled on a rock and grazed her arm, but she was about 3 or 4! She was very proud of her wounds and every damned photo of her on that holiday she her elbow raised into a prominent position!

Vergus · 18/02/2025 12:19

@Itsnotallaboutyoulikeyouthink

I suspect it didn’t really ruin the next 6 days and you are in fact just trying to get some money back.

This.

Hwi · 18/02/2025 12:18

If this is not a piss-take and not a deliberate attempt to rip off your insurance, you have to have strong words with your husband - if he is such a wuss that such a minor thing puts him out of action for a while, you need to consider what you are going to do when you get older and what sort of support you can expect from him in the future as you age - this is not going to be sustainable and fair on you.

BMW6 · 18/02/2025 12:18

But OP as he wouldn't see a doctor immediately after the accident what evidence can you present to the insurance company to prove

When it happened
How it happened
What his injuries were

All you've got is your say-so and a photo. You surely know that's never ever good enough for a claim? You are aware that people make fraudulent claims all too often?

delvar · 18/02/2025 12:18

I've no doubt that the mishap gave you both a fright, and he was probably sore and grumpy after it.

However, I'm baffled as to why you didn't immediately seek medical attention since he is post stroke and taking anticoagulants. You both must have known the dangers of injuries causing bleeding when taking them.

I hope he's better now. I'd leave it and move on. Be thankful he didn't have a brain bleed is all I can say at this point.

AlohaRose · 18/02/2025 12:18

"they replied that they were not aware of the incident. Don't know how the floor was repaired 6 days later if they were unaware."

They may not have been aware of the incident, but presumably if the board was broken someone in the intervening six days (most likely a staff member) noticed and reported it?

Notmycircusnotmyotter · 18/02/2025 12:17

I hate compensation culture.

He had a graze and a few bruises.

I would honestly find £10 more of an insult as it suggests he’s fine and they just want to keep you quiet.

sorry to hear he got hurt op. I hope he’s feeling better now

I wasn't trying to drip feed, but someone asked about underlying health conditions. He is 70, had 2 strokes 18 months ago and is on blood thinners. It wasn't a chair. It was the floor!!!

Your 70 year old disabled husband fell through a floor and you didn't call an ambulance ? That's negligence on your part tbh

Khhi · 18/02/2025 12:16

Head injury + blood thinners normally means you need medical review - he would probably have been offered a CT scan in the UK.

Unfortunately you did choose not to seek medical attention and I do think it is fair that they would expect if the injuries were such that they required medical attention that you would be responsible enough to go and acquire it.

Holiday companies get lots of spurious claims and I think in this case you cannot expect compensation when you failed to seek a medical review.
It would be the case in the UK too.

MissDoubleU · 18/02/2025 12:16

chickenpieandchips · 18/02/2025 12:15

I'm thinking it didn't seem so bad on holiday, now back and someone's mentioned about compensation and they've realised they've potentially missed the boat on that one.

Yup. Head injury on blood thinners and had to stay in the room for 6 days worth of holiday…. But not bad enough to get a medical report or even have a doctor check for concussion. Rightio!

cheezncrackers · 18/02/2025 12:15

a) that's a series of small grazes OP, stop being such a drama queen; and
b) if he didn't want to see a doctor then even he didn't think it was that serious.

I can't believe that anyone would 'take 6 days to heal' for such a minor injury.
