To expect compensation from holiday company

Changing a few details and being vague to remain unidentifiable. My partner and I recently had a 2 week holiday somewhere warm to celebrate a birthday and anniversary. On day 2 of the holiday my husband was injured as a result of something breaking (that shouldn't have). He grazed his forearm from fingertip to elbow, slight grazing to the leg and suffered a bump to the head. He received first aid from a hotel employee including an ice pack for his head. The next few days were a write off until his wounds healed and he didn't feel so sore. I have pictures of it all and the bruises He still had 6 days later. It was reported at the time and the travel company representatives checked in on him.
On our return I submitted the photos and a report of the incident to the travel company for some kind of apology / compensation, but they have told us that is not possible as we did not get a medical report.
This seems so unfair and we are wondering if we should take it further. What are our chances? Anyone have any experience of this.

I'm on dual anti-coag and anti-platelet treatment, if I cut/graze/scratch myself and it doesn't continue to bleed for 24 hours after, then I'm no more 'injured' than the average person. I certainly wouldn't need 6 days to ascertain that I'm ok.

Goodness. Really spent so long unable to do anything.
Dh slipped on a wooden structure at Butlins last year. He hit his head and took most of the skin off his arm and leg and bent his mobile.

We did suggest they did something to the wood to make it not slippery in the wet.

DoItBetter · 18/02/2025 14:00

@MeowCatPleaseMeowBack
I did read the thread. The OP said he had a bump to the head and grazes ranging in severity. She also said he felt sore and had bruises which is hardly surprising after a fall that not only injured your leg and arm but also your head.
Most people are totally ignoring the facts and are only looking at the grazes.

Did you miss the bit where she mentioned he also had a head injury he’s 70 and has had two strokes? The upshot is the floor shouldn’t have given way people can die from a bang to the head. Especially someone her husband’s age and health history.

Did you miss the bit where the most superficial grazes ever were held up to the camera like a traumatic flesh wound from a megalodon?

pestowithwalnuts · 18/02/2025 13:58

So if the 2 days after the accident were a 'right off '...what did you do instead ? Stayin your hotel room ?

Bogginsthe3rd · 18/02/2025 13:56

Ihaveausername · 18/02/2025 11:21

I will add a photo of his arm. This was taken the day after the incident after all the blood had been cleaned up. It wasn't a simple graze.

Lol. This is so unbelievably minor. Hang your head in shame OP for taking the piss.

ServantsGonnaServe · 18/02/2025 13:55

I feel quite sorry for you OP.

It doesn't look immediately awful but appreciate it was sore for him. My sympathy for you though is it sounds like your husband broke something, git injured, refused a doctor and then you gave up 6 days of your holiday to sit with him and now you're the one lumbered with trying to make a claim.

I think you need to ask DH to take this on if you both agree it warrants pursuing.

And yet she chose to show a few scratches on his arm as ‘evidence’? None of that was mentioned in her OP.
If he’s that frail then he should have gone to hospital - in fact the advice if you’re on blood thinners is to go to hospital if you’ve have a significant fall because of an internal bleeding risk. They will also have had to pay for specialist insurance with this level of medical need so why would you not use it?

Pineapplewaves · 18/02/2025 13:49

It's standard practice to get a medical report if you want to make a claim otherwise it’s just one persons word against another. Your DP should have seen a Doctor straight after the accident so you had a record of it. You should have also insisted on getting an incident report from the holiday rep or hotel at the time.

Nobody will pay out when your DP wasn't injured enough that he needed to seek medical help. Nor was the incident bad enough that you decided to raise the issue with the hotel/holiday rep at the time.

FallOfTheHouseOfUtterlyButterly · 18/02/2025 13:44

I'm going to agree you're more concerned about the money than your DH being injured because you didn't get him checked out despite the apparent severity of the injuries

YouveGotAFastCar · 18/02/2025 13:44

Yeah, his unwillingness to see a doctor has meant you can't really pursue insurance or your hotel here. It's unfortunate that it happened, but if it was bad enough to impact on six days of his holiday, he needed to spend a few hours of one of them getting checked out so that you could try and recoup some costs.

I hope you both had a nice time anyway.

NeverDropYourMooncup · 18/02/2025 13:44

I've seen worse injuries from blokes getting pissed and falling over.

Ramblethroughthebrambles · 18/02/2025 13:43

I don't think it's necessarily relevant whether he should or shouldn't have seen a doctor. The way I would see it is the OP & partner paid probably a substantial sum for decent accommodation and the hotel/ travel company didn't fully meet their end of the contract. If the OP were trying to sue for £1000s then that would be unreasonable or would need medical evidence of serious injury. However, floorboards breaking should not happen & it could really shake someone up to suddenly fall through. It's not necessarily a sign that the hotel have been criminally negligent but surely some modest recompense is reasonable for the accommodation not being of the standard paid for?

itsrainingonmywashing · 18/02/2025 13:42

If on blood thinners and gaining such 'wounds' I would have def seen the doc, ut that looks so minor, it was never going to be a serious bleed out.
I don't get the 6 days either even for an older person.🤔
Reads like a Daily Mail sad face was in order tbh, but I think OP knew deep down she was bu.

wholettheturnipsburn · 18/02/2025 13:38

Oh dear.

If that happened at home he would just get on with it

Mayfly3 · 18/02/2025 13:38

I'd think you were at it. That looks sore, but hardly severe. Children are come up with worse grazes regularly and just get on with it.

DancingFerret · 18/02/2025 13:36

Blaming others and expecting "compo" seems to be a way of life these days.🙄

YourHappyJadeEagle · 18/02/2025 13:36

I don’t think you’re going to get anywhere with the hotel unless you engage a solicitor and even then it will probably cost more than you’d receive.
You can write honest reviews on Trip Advisor and Trustpilot naming the hotel and the nature of the incident.

“He didn’t want to see a doctor”

that’s your problem, not the holiday company

Agree with this.

If his injuries were that much of a concern then he would have sought medical attention.

sweetpickle2 · 18/02/2025 13:31

My mum is 70 and has had two strokes, so I understand how serious something like this can be even if it doesn't look like it outwardly.

However I am not sure why you didn't go to a hospital? I'd have taken my mum straight there, given her medical history.

As for compensation, I'm not sure. I'd expect them to look into it and be a bit more bothered than you've said, but I don't know if I'd be after a payout.

LittleBigHead · 18/02/2025 13:31

Ihaveausername · 18/02/2025 11:40

I wasn't trying to drip feed, but someone asked about underlying health conditions. He is 70, had 2 strokes 18 months ago and is on blood thinners. It wasn't a chair. It was the floor!!!

But even so --- 6 days recovery from a light graze? His underlying conditions see to be the problem more than anything.

My husband works in an emergency department and someone came in needing more than paracetamol for ‘the pain’ of a paper cut - was that your husband?

What specifically was it that he wanted to do on holiday that he missed out on doing as a result of the injury?
