Non-binary colleague using disabled toilet

1000 replies

DefendingPan · 22/12/2024 10:14

Where I work there’s employee male and female toilets, customer male and female toilets and one customer disabled toilet.

This colleague is non-binary, is not disabled, and uses the disabled toilet/ baby change (with their own Radar key) because they “don’t feel comfortable) using either the male or female toilets.

I mentioned to my boss that I didn’t think this was appropriate and got accused of transphobia and threatened with discipline. I was made to feel like I was being offensive and discriminatory for bringing it up.

We have many elderly customers and many young families who all also need to use it.

Was I being unreasonable?

Also it could be possible they are actually disabled but don't want to disclose it

verysmellyjelly · 22/12/2024 11:28

@Tooes The disabled toilet is for disabled people.

@Scabetty Use another toilet. Not occupy the disabled toilet which is for disabled people.

@RemusLupinsBiggestGroupie It is literally everyone's business when the facility disabled people have fought for is abused by someone who is not disabled.

Wonderi · 22/12/2024 11:28

It’s ridiculous that they can’t use one of the other toilets.

I am 100% female but will regularly use the male toilet at work as we have 12+ women and 2 men, so the male toilet is usually free.

It doesn’t make me feel uncomfortable because the sign on the outside doesn’t determine by gender.

However, they may have a hidden disability and so it wouldn’t let it bother me.

MumblesParty · 22/12/2024 11:28

ChallahPlaiter · 22/12/2024 11:22

Not true. Non binary people have existed around the globe for millennia; it’s well documented. It’s just that 21st century UK can be a prescriptive society that insists people have to fit into one or the other category.

@ChallahPlaiter apart from the vanishingly rare cases of XY chromosome abnormalities, everyone is either male or female. There is no such thing as non binary. It doesn’t matter whether you like being “girly” or “masculine”, you’re either a man or a woman. That’s how you know which toilet to use.

JetskiSkyJumper · 22/12/2024 11:28

Well they probably can't win because if they used the male or female toilets someone would probably complain about that too. I think they've made a wise decision.

angrymenopausal · 22/12/2024 11:28

@ChallahPlaiter there are two biological sexes. There have always been two biological sexes. No one cares if a woman is masculine or a man is feminine. But their biology is male or female, however much they may not want that to be the case.

GoingRotten · 22/12/2024 11:27

nonbinaryfinery · 22/12/2024 10:21

Fyi nonbinary disabled people actually exist.

Non binary doesn't exist. You are born male or female. Unless you have a very rare genetic problem.

Get over yourself

TequilaNights · 22/12/2024 11:27

It's a toilet, a few minutes, they are not taking anything away from people with disabilities.
They are removing any ill feeling of 'using the wrong toilet' and using a unisex toilet for people with disabilities.

This is a you problem

HocusFord · 22/12/2024 11:27

What a weird thing to be policing. If it actually becomes an issue - in that they’re using the loo so much it’s genuinely disruptive to others - no doubt your employers will address it.

MILLYmo0se · 22/12/2024 11:27

If the 2 staff toilets are single use can't the company just rebrand then unisex and everyone's happy. Are staff allowed to use the other customers toilets?

RB68 · 22/12/2024 11:26

non binary isn't trans though is it

Just make the existing single person loos just loos rather than male or female etc. They are single contained toilet facilities there should be no issue with that

There has to be a third way as the current discussions and so on focus on the duality of sex when even the reality of science says that is not how itis

I just think we have to let go group toilets and go single locked stall with all facilities otherwise we are not meeting the needs of everyone and everyone needs to pee and poo.

ANd it should be an Accessible toilet not a disabled one ffs

InvisibleBuffy · 22/12/2024 11:26

Tooes · 22/12/2024 10:15

I don't blame them, the disabled toilets tend to be be much nicer.

They might be nicer but that's not what they're there for. They're for the disabled. It's completely inappropriate for an abled bodied person to use them for no reason other than that they've got the gender wobbles. There is no reason they can't use the toilets appropriate for their sex.
Toilets are split into male or female based on sex, not gender stereotypes.

3peassuit · 22/12/2024 11:26

There are few enough facilities for disabled people. I don’t see why a non binary person can’t use a loo in line with their sex as there are none as yet for their gender identity. In the future I’m sure public buildings will be obliged offer facilities for all genders but till that happens keep disabled toilets for disabled people.

NahNotHavingIt · 22/12/2024 11:25

DefendingPan · 22/12/2024 10:21

FYI this person is not disabled and does not consider themself to have a disability

Are you their doctor then?

You literally have no idea what's in their medical records, because they'll see it as none of your business.

Wheelz46 · 22/12/2024 11:25

@DefendingPan How do you know this person has no disability?

RinklyRomaine · 22/12/2024 11:24

PoundlandColumbo · 22/12/2024 11:17

I'm GC but I'd stay out of this one if I were you. It doesn't directly affect you. Choose your battles.

I've never understood this take. The welfare of the disabled is everyone's responsibility. Anyone vulnerable; women, children, those with different abilities - to male violence or discrimination are everyone's concern, at least in a decent society.

Morecoffeeforme · 22/12/2024 11:24

It’s all utterly ridiculous. You’re either male or female.

My relative is in a wheelchair and she has nowhere else to physically go. These selfish self obsessed people identifying that they have a disability should stay at home if they’re too fragile to use the bloody toilet assigned to their sex

Princessconsuelabananahammock9 · 22/12/2024 11:24

TigerRag · 22/12/2024 11:14

You might be able to wait 2 minutes but not all of us can.

What do you do if the disabled toilet is occupied?

If you genuinely can't wait two minutes do you use whatever toilet is available?

Would you use the men's bathroom?

My mom has Crohn's, my sister is in a wheelchair. Sometimes they have to wait.

My sister has a very rare terminal illness so she wears incontinence pads because she can't always wait.

If you really can't wait, do you frequently have accidents?

I can't imagine a world where there is always a free toilet available.

newtlover · 22/12/2024 11:24

surely the issue here is the employer's duty to provide a toilet for customers with disabilities and/or babies
depending on the business I could imagine this is a fairly frequent need, and the employee is presumably often there when the business is open so there will forseeably be a clash, and its up to the employer to sort this out

Sushu · 22/12/2024 11:24

I have a need to use accessible toilets and I don’t agree with others on here who say this person has no right. The OP has declared this person without a disability and perhaps this person does not have a disability but they may have a continence need. It is absolutely their right to keep this private from nosy colleagues. I have several close family members with inflammatory bowel disease and when they need to go, they need to go. They don’t consider themselves disabled, which is their choice, but they have an urgent toilet need.

Anyone who has an urgent need for the toilet deserves to use the accessible toilet and they absolutely never have to justify themselves.

NahNotHavingIt · 22/12/2024 11:23

We have many elderly customers and many young families who all also need to use it.

Was I being unreasonable?

Yes, unreasonable to poke your nose in where it doesn't concern you.

Fine if they're keeping disabled people waiting, but I'm sure that's not the case is it OP?

angrymenopausal · 22/12/2024 11:23

Vaxtable · 22/12/2024 11:16

I firmly believe trans women should not use the ladies, however I dint have a problem with them using male or disabled toilets. I certainly wouldn’t report it

This isn't a trans woman. It's someone who's non-binary. Who knows if they are of the male or female sex? But this person has decided that the little picture on the front of the self contained toilets distress them so much that they need to use the disabled loos.
Madness.

Animatic · 22/12/2024 11:23

What's the issue, unless they spend hours to the end not allowing anyone else to use it?

5128gap · 22/12/2024 11:22

CreationNat1on · 22/12/2024 10:21

Why are you policing the world? How often is the disabled toilet occupied by this person when it disadvantages another user/how frequently does it cause a real issue, rather than a potential issue?

Because some things need 'policing' don't they? You can't have every random suddenly deciding they need to use facilities designed for disabled people, for no reason other than they 'feel' more comfortable, because disabled people would be seriously disadvantaged. I'd feel a lot more comfortable being able to park right outside Tesco when it's raining, but those spaces are not for me. And if people put their 'comfort' ahead of other people needs, somebody needs to step up and tell them no.

ChallahPlaiter · 22/12/2024 11:22

MumblesParty · 22/12/2024 10:54

@Scabetty the person should use the gents if he’s a man, or the ladies if he’s a woman. It’s not complicated. There’s no such thing as non binary. It’s a concept made up by people to get attention.

Not true. Non binary people have existed around the globe for millennia; it’s well documented. It’s just that 21st century UK can be a prescriptive society that insists people have to fit into one or the other category.
