Non-binary colleague using disabled toilet

DefendingPan · 22/12/2024 10:14

Where I work there’s employee male and female toilets, customer male and female toilets and one customer disabled toilet.

This colleague is non-binary, is not disabled, and uses the disabled toilet/ baby change (with their own Radar key) because they “don’t feel comfortable) using either the male or female toilets.

I mentioned to my boss that I didn’t think this was appropriate and got accused of transphobia and threatened with discipline. I was made to feel like I was being offensive and discriminatory for bringing it up.

We have many elderly customers and many young families who all also need to use it.

Was I being unreasonable?

My partner once used the woman's bathroom in his office building. He needed to go and the men's was on the other side of the building.

Someone from another department wrote a letter complaining about him being in there and how unsafe he made her feel.

According to many comments on here he was in fact using the correct bathroom as a trans man.

Trans men would use the make toilet, not the female.

Bloonket · 22/12/2024 11:38

Stay out of it.
Adjust your thinking to that toilet being for disabled, baby changing and …. The uncomfortable.

Not true. Non binary people have existed around the globe for millennia; it’s well documented. It’s just that 21st century UK can be a prescriptive society that insists people have to fit into one or the other category.

Everyone is ‘nonbinary’; nobody conforms entirely to regressive sex stereotypes. I never wear make-up or heels, live my life mostly in jeans, work in a male dominated profession. I am still perfectly capable of using facilities dedicated to my sex.

verysmellyjelly · 22/12/2024 11:37

@Princessconsuelabananahammock9 That's not about a disabled toilet so it's not relevant to the thread.

I have a need to use accessible toilets and I don’t agree with others on here who say this person has no right. The OP has declared this person without a disability and perhaps this person does not have a disability but they may have a continence need. It is absolutely their right to keep this private from nosy colleagues. I have several close family members with inflammatory bowel disease and when they need to go, they need to go. They don’t consider themselves disabled, which is their choice, but they have an urgent toilet need.

Anyone who has an urgent need for the toilet deserves to use the accessible toilet and they absolutely never have to justify themselves.

Just because you want to give away access to the disabled toilet doesn't mean you can speak for all disabled people. That toilet is a right we fought for, it is hard won and it is ours. It's not something that anyone should be able to just decide to use. People who need it really need it and often can't even get into a normal toilet at all. For some people with disabilities it is a "better" option (more private, less embarrassing, etc) but for some of us it's literally the only one! We shouldn't have to share it with people who are not disabled whatsoever.

JetskiSkyJumper · 22/12/2024 11:36

@angrymenopausal because some people complain about anything. This post being a good example. What has them telling anyone got to do with anything? Same can be said for being disabled. Not everyone tells people and despite what some people like to think no you can't always tell and no someone won't always tell you.

PurpleSparkledPixie · 22/12/2024 11:36

IsitaHatOrACat · 22/12/2024 10:22

Maybe ask for toilets to be gender neutral

Just make sure there's San pro bins in both though as I have experienced having ro wait for the correct "gender neutral" toilet to be available...

I hope you mean mixed sex. Not everyone believes in genders and even the Scottish government says sex and gender are totally different.

OP - if the male and female toilets are single cubicles then they should NOT be using the disabled toilet and your boss is very very wrong. Maybe a solution with your toxic boss is to get the male toilet turned into a mixed sex one. So mixed sex, female, and disabled.

Disabled toilets are for disabled people - full stop.

‘Non-binary’ individuals should use the toilet that corresponds to their biological sex. It's that simple.

They are not “disabled toilets” they are accessible toilets. They are not just for “disabled” people, whatever your definition of that is.

DaphneduMaureen · 22/12/2024 11:33

nellythe · 22/12/2024 11:00

Then what’s the point in radar keys? Yes, I know they’re available online. However the point is that they’re NOT free to use for all and sundry.

Anyone can ask for the key to an accessible toilet. You do not need to be disabled to access an accessible toilet and any Costa or KFC which refuses an able-bodied person would be in the wrong to do so. Anyway, locking disabled toilets came about due to junkies, not able-bodied people who needed a pee.

Trainors · 22/12/2024 11:31

This is the world you live in now. We have had to respect other people’s religious beliefs for centuries. Now it’s gender beliefs.

Their gender has nothing to do with occupying the disabled toilet. Their identity isn't a disability.

Particlee · 22/12/2024 11:33

Hoppinggreen · 22/12/2024 11:30

Zero, thats the amount of people doing this .
They do it because they have MH issues not because people don't look "female" enough.

The person who did it to me explicitly used those words.

Swannyb · 22/12/2024 11:33

HocusFord · 22/12/2024 11:27

What a weird thing to be policing. If it actually becomes an issue - in that they’re using the loo so much it’s genuinely disruptive to others - no doubt your employers will address it.

It's not "weird" to want the toilet for disabled people, that disabled people fought for as a legal right and key access need, to be available to us when needed. It isn't just another lol for anyone who fancies it at any given time. Remember we often cannot use the "normal" loos and this person can but is choosing not to. I'm not criticising them for their identity, that is their own business, but they have no right to use the disabled toilet.

angrymenopausal · 22/12/2024 11:32

JetskiSkyJumper · 22/12/2024 11:28

Well they probably can't win because if they used the male or female toilets someone would probably complain about that too. I think they've made a wise decision.

Why would people complain if they use the toilet appropriate to their sex?
The only reason others know if someone is non-binary is because they've told them!

WarmingClothesontheRadiator · 22/12/2024 11:32

Scabetty · 22/12/2024 10:16

What would you suggest they do?

Use the toilet appropriate for their sex

PostmanPatAlwaysRingsTwice · 22/12/2024 11:32

The OP, I think, feels that it would be wrong if a disabled person couldn't use the toilet because it was occupied by someone who could use one of the non-accessible ones. This person isn't justified in taking up the accessible toilet.

GoingRotten · 22/12/2024 11:32

If they are neither male, female or disabled they should go outside and piss in a bush.

Trainors · 22/12/2024 11:31

FourEyesGood · 22/12/2024 10:18

Until there is a unisex toilet or one dedicated to those who are non-binary, there is nowhere else for this person to go.

Really, how does it affect you? It’s not as if they’re in there all day, is it? (If they are, that’s a bigger issue.)

Don't be ridiculous. They have a sex and are perfectly able to use the toilet that corresponds to their sex.

Non-binary is about their belief in their gender identity. Toilets are about your biological sex. Sex and gender identity are different.

There is no coherence in them refusing to use the toilet that corresponds to their sex and it is extraordinarily entitled to take over the facility dedicated to people with a disability protected characteristic that they do not have.

verysmellyjelly · 22/12/2024 11:30

TequilaNights · 22/12/2024 11:27

It's a toilet, a few minutes, they are not taking anything away from people with disabilities.
They are removing any ill feeling of 'using the wrong toilet' and using a unisex toilet for people with disabilities.

This is a you problem

Yes they are taking away immediate toilet access from disabled people, plus even further contributing to the already unfortunate perception that the disabled toilet is just conveniently there to be exploited by anyone who fancies it. That can and does have a massive negative impact. It's easy to say that's nothing when you're not affected.

angrymenopausal · 22/12/2024 11:30

RB68 · 22/12/2024 11:26

non binary isn't trans though is it

Just make the existing single person loos just loos rather than male or female etc. They are single contained toilet facilities there should be no issue with that

There has to be a third way as the current discussions and so on focus on the duality of sex when even the reality of science says that is not how itis

I just think we have to let go group toilets and go single locked stall with all facilities otherwise we are not meeting the needs of everyone and everyone needs to pee and poo.

ANd it should be an Accessible toilet not a disabled one ffs

What does science say exactly? Apart from the tiny minority of people with DSD where does science say there is a third way that isn't xx or xy?

Hoppinggreen · 22/12/2024 11:30

What a load of nonsense. People who don’t feel it necessary to conform to regressive sexist stereotypes have existed forever. Calling this “non-binary” is navel gazing bullshit.

Can you define non-binary without using regressive sexist stereotypes?
