Non-binary colleague using disabled toilet

1000 replies

DefendingPan · 22/12/2024 10:14

Where I work there’s employee male and female toilets, customer male and female toilets and one customer disabled toilet.

This colleague is non-binary, is not disabled, and uses the disabled toilet/ baby change (with their own Radar key) because they “don’t feel comfortable) using either the male or female toilets.

I mentioned to my boss that I didn’t think this was appropriate and got accused of transphobia and threatened with discipline. I was made to feel like I was being offensive and discriminatory for bringing it up.

We have many elderly customers and many young families who all also need to use it.

Was I being unreasonable?

So it is just a choice? In other words performative.

Well, you’re determined to think so. I say live and let live so long as they’re not hurting anyone, which they’re not.

It’s a choice that people are absolutely within their rights to make.

Define it though?
Everyone is actually male or female.

Fyi nonbinary disabled people actually exist.

I think this is the solution really. Disabled people should all declare themselves trans/non binary. Then watch how everyone falls over themselves to make transport, public spaces, jobs and toilets suddenly accessible.

visitbreakfast · 22/12/2024 13:03

@FionaSkates

Did you just refer to the person in question as ‘it’?

I don't read it like that, I read 'it' to mean the situation in the same way someone would say 'at least it isn't an able bodied person using a disabled toilet'

Yes I can see people are reading it differently regardless of intention which is one of the joys of MN!

MissScarletInTheBallroom · 22/12/2024 13:10

They're not special, but they are selfish if they are using an accessible toilet when they have no need for one.

No they’re not, unless they are keeping disabled people waiting for ages, which isn’t the case or I’m sure the OP would have said so.

GrumpyPanda · 22/12/2024 13:11

PoppyFleur · 22/12/2024 10:22

They are using the toilet they feel most comfortable in. I don’t see what the problem is and I certainly wouldn’t have reported this. Somehow this post has made me think of the film Hidden Figures.

Edited

Didn't take long at all for somebody to turn up with the classic gotcha of comparing black women to men. Classy!

If the employee toilets are single cubicles then arguably there is no need to label them m or f and just have them available for everyone. Problem solved.

Exactly- but then lots of people on here would have to find something else to be performatively offended about and then where would we be?

No, they are referring to the situation as ‘it’ as situations don’t have sexes.

I was asking the poster, but I can see people are reading it either way from the comments!

@IHaveNeverLivedintheCastle We are going in circles. I am aware you find "disability" a negative term. I don't. I'm sorry, but the link to a page on the outdated and offensive concept of "registered disabled" is not a compelling argument! I favour more progressive views of disability.

According to The Equality Act I don't have a disability. You're the one who has said it's a negative term. It's a statement of fact, I don't have a disability or am disabled.

Disability
(1)A person (P) has a disability if—
(a)P has a physical or mental impairment, and
(b)the impairment has a substantial and long-term adverse effect on P's ability to carry out normal day-to-day activities.

Should I tell a lie to be able to make occasional, necessary use of the accessible toilet.?

All this stuff about non-binary people being performative and thinking they’re ’special’ speaks volumes about how nasty some people on here are.

Is this person actually male or female, because that answers what toilet they should be using, unless they also have an actual disability.

DemonicCaveMaggot · 22/12/2024 13:05

My view is that the disabled cubicle can be used by the able bodied provided a disabled person doesn't need it. So if there is a line, the disabled person goes to the head of the line for the disabled toilet.

Hopefully the employee doesn't need to be in the toilet for a prolonged length of time.

The real issue is the lack of disabled toilets. One of my DC uses a wheelchair and quite often ends up waiting for ages outside a disabled toilet because the disabled person inside needs a long time to take care of business - transferring from chair, undressing, dressing, transferring back to chair, washing hands.

WishinAndHopin · 22/12/2024 13:02

Maybe they have a disability they don’t wish to disclose? Some disabilities are hidden.

Either way it’s none of your business and you shouldn’t have poked your nose in.

It’s also better than them inflicting themselves on the wrong toilet and upsetting other people.

If you had read the thread, you would see that this affects disabled people and that we care. It's sad that you think that doesn't matter.

@verysmellyjelly
If you had read the thread, you would see that this affects disabled people and that we care. It's sad that you think that doesn't matter.

OP said they saw the non binary person use the toilet and that's it, so in this case there's literally no proof anyone got affected because she never saw any disabled person waiting for their turn.

Also fact that we don't really know if the person is disabled or not.

@Coconutter24
But in this case they’re not disabled and the commenter didn’t say that non-binary people can’t be disabled

OP says they're not disabled, assumption, not fact, as far as we know they might have a invisible disability.

And before anyone tries to say otherwise, OP is clearly not friends with the person, and as proven by many posters one can have invisible disability and nobody would know.

@PurpleSparkledPixie
Transmen are biologically female.
Transwomen are biologically male.

They are still the same sex they had at birth. It really isnt that difficult to understand.

Can you please clarify your post? Because if I understand correct you want trans to use the bathroom of their birth sex.

But that opens a big issue, because by your logic a transmen, who depending on how far enough they're in the transition would look like a man, should then use the women bathroom because it's their birth sex?

I'm 100% sure women wouldn't like that, the logic that trans should only use the bathroom of their birth sex simply doesn't work either because the issue is not black and white.
