to find this really fucking annoying even though it doesn't really affect me much

I live in a detached house with a walkway between myself and the neighbours to access both our gardens at the back (diagram attached).

The neighbour has a front garden whereas I have a driveway. They have a gate that opens to the side of my house to allow them access to the walkway to get to their back garden. The walkway is shared land according to the deeds but stops at the top of my driveway (basically my driveway isn't shared but the walkway is).

Whenever my neighbour is doing anything in their garden, bringing this in / out of the garden/ taking things from the garden to their car on the road or whatever, they will go up and down my driveway instead of going through their gate and then down their garden.

It really annoys me. I don't really know why but AIBU to think this is just an odd thing to do?

My living room window looks onto my driveway and some days they will be working in the garden and making multiple trips up and down my drive and I feel awkward and like I need to close my blinds.

I don't even have a bad relationship with them, not friends or close but fine neighbours and we say hello how are you etc when we see them.

But I just find the whole thing really weird. I would never dream of strolling up and down their garden path repeatedly.

We also have cars on the drive so when they are bringing things in and out it worries me they will get scratched.

Aibu to find this annoying and tbh a bit rude?

I think it's weird to be bothered by this unless they're scratching your car on the way past. It's obviously much easier than opening their gate, going into their garden and out again to the road, especially if the reason for the gate is that they have pets in the garden.

It's not wierd at all, it's rude and annoying for Op
Put a fence/ gate up Op as they could claim right of way after a few years

They enter /exit via their gate

Aren't they using their gate?
Looks like they come out their gate but have no other choice than walk through the OP drive.

I've said the plan is to put a gate at the top of my drive, until that happens though I still think it's weird to walk up and down someone else's drive all the time. I would never go through their gate and down their garden, even if it was easier for whatever reason.

People are all different.

You have to enforce boundaries at times.

Who lived there first - you or them? Because if them, they may have done this for years.

NoSquirrels · 15/08/2024 16:14

Do they have a gate onto the street too, as well as onto the walkway?

BurntBroccoli · 15/08/2024 16:14

Is their garden fenced all the way round?

MikeRafone · 15/08/2024 16:14

Cross posts

repark your cars strategically

so the access is blocked on your side

StarryDance · 15/08/2024 16:13

That walkway looks like it extends to the street.

Rough red line showing where the boundaries are on the deeds. And the dotted line is where neighbour walks up and down to go through the walkway.

If this is correct, speak to your solicitor about any issues with not enforcing your boundary.

OneFrenchEgg · 15/08/2024 16:12

Op has not put a gate in from the street to the neighbours garden which confused me. I think she wants them to come down walkway, go into front garden, exit from front garden onto street

MikeRafone · 15/08/2024 16:12

Are they walking over the pink section?

I can’t see how else are they supposed to access the street… what is the small line along the street and attached to their front garden?

Edited

They enter /exit via their gate

  1. your diagram is not clear, we can't see what is yours and what is shared

  2. a few people have said to put a fence up - including me! - but you haven't replied about that. Why not just put a fence up?

So with a new fence you're basically mirroring what they currently have.

I'd be quite annoyed too as I bet they have a good gawp in!

Yes, do this.

BurntBroccoli · 15/08/2024 16:11

Could you post your Land reg plan and deed?

It isn't. The shared part extends onto thr walkway but not down my driveway.

CurlsnSunshinetime4tea · 15/08/2024 16:10

Are you certain that the entire width of the driveway is your property?
Unfortunately it would be common sense that the common walkway extend to the road. I wonder if previous neighbors simply agreed to “pave” that part but the section of “land” remains shared access.

budgetingnovice1993 · 15/08/2024 16:10

They have access to walkway , through their garden

Iwasafool · 15/08/2024 16:09

Just wanted to add this wouldn't worry me but it would drive my husband round the bend and I'd never hear the end of it so I'd have to try and sort it.

Through the gate at the top of their garden which opens into the shared walkway.

That would still mean stepping onto your drive

are you sure the shared drive isn’t down the middle like this

Just to clarify there is a fence between my drive and their garden so I would have no reason to walk down their drive (if they made one) or garden.

I’m confused now - where’s the fence? It’s around their garden, yes? Not on your drive? There’s only a fence because of the garden. Without the garden there would be no fence.

What I mean is that if they had no front garden (and no fence therefore) and only a drive, like you, then it wouldn’t feel to you like trespassing even if they did sometimes walk on your drive (which they wouldn’t need to, as they could then walk on their own drive instead).
