Totally agree with this. And given what we have seen beforehand, IMO he would be justified in thinking that. As ive said in PP,nobody knows what was going through that officers head, it all happened so fast.

In the grand scheme of things, in terms of prosecution, all that matters is what the officer genuinely thought in the moment.

Even without the potential touch of the firearm the officer could have felt this was a life or death fight. With it, I think it's probably wholly reasonable that the officer believed he was in a life or death fight, not only for his life but others.

I was wondering about this.
On the picture where the two brothers are sitting next to that lawyer, none of them looks bruised?
Surely if the police officer had stamped on his head it would be visible the next day?

@whatnow123 yes when the perpetrator is tased and falling to the ground involuntarily it looks as though his hand momentarily goes near to the officer's holster. He's actively being tased. There is no grabbing motion or anything else to suggest that there was an intention to take it. That is a world apart from "thugs trying to steal armed cops gun".

IF the officer in the chaos of the moment thought that he was trying to take his gun that would be one thing, but we have the ability to watch it all back frame for frame in slow motion, so it seems a bit odd to frame the entire event as thugs attempting to steal an officers gun.

There is a breakdown of the footage and the guys hand appears to at least touch his gun or his holster

Once again the question is... if someone is violently assaulting you and you feel their hand on your gun, is it reasonable to believe he is potentially trying to take it. 100% yes.

Also tired of pp saying "in X county they'd be dead!" As though it's relevant, or matters. In other countries you don't have access to abortions, homosexuals are killed, schools are regularly shot up etc we are more developed than this, and if you would rather live in those countries then by all means trot off there!

i should be shocked by the number of people who think it's ok for a police officer to kick someone, who they'd already tasered, in the head. but this is mumsnet so i'm rarely shocked by the vitriol here.
there's no excuse. it's awful the police were attacked at the airport but that doesn't give them the right to KICK SOMEONE IN THE HEAD.
no police officer in their right mind could defend this. a relative has been viciousy attacked as a serving police officer. there's no way they or anyone they work with would retaliate like that

Interesting as my experience is the opposite.

It also needs to be remembered that it's the officer perception in that moment that counts and if that perception is reasonable.

It could come down to something as simple as, in the chaos of the moment did the officer reasonable believe the male was trying to get to his feet and if he was, considering all that had occurred was it reasonable to use that amount of force to prevent him doing so.

It looks much more like he stamped the floor next to his head and not on his head.

Besides which if he had stamped on his head he’d most likely still be in hospital with some sort of traumatic brain injury.

Long custodial sentences? You'd like to think but my money is on 18 months, serve 7, then back to the community to be lauded for "giving the feds a good slap innit"
