Neighbours have thrown my fence into my garden and caused damage

Obviously I’m not happy.
we’ve been having work done and converted the garage- extending it at single storey- this bit will now be what replaces the fence that was there (which they have thrown over damaging some pots which are on the other side)

the wooden fence that was the boundry was pushed back onto their property so my my builder could make the wall

AIBU to ask them to reimburse me for the damaged pots? From my POV the only thing I can see is that maybe they were unhappy about the surplus to requirements fence being there for a couple of weeks
?

Do you want to escalate the dispute and make everyone more intolerant of each other, or do you want to resolve the dispute and have civil relations with your neighbours?

I would apologise to them for leaving the posts on their side, and not mention the pots.

I always opt to escalate the dispute if neighbours are arseholes as then i have the satisfaction of luxuriating in my righteous indignation whilst also enjoying the peace of no contact.

this is going to depend on whether the OP was actually the arsehole though. In our case it was definitely the neighbour 🤣

😱
I didn’t know this
thank you for letting me know
I will of course apologise to the neighbour

It's tricky and not as straightforward as PPs have suggested.

"...the garage- extending it at single storey- this bit will now be what replaces the fence that was there"

No one here can advise you about party wall issues without knowing exactly where the outer wall of the garage is with respect to the boundary.

If the garage is entirely on your boundary (and does not share a wall with your neighbour's garage etc) and you are extending it entirely on your own property then the Party Wall Act does not come into it. In this case you can build what you like on your own property subject to planning and/or permitted development etc

In contrast, if your garage is linked to your neighbours garage and they share a wall then that wall is a party wall. If you then extend the garage backwards from that party wall along the line of the boundary then the Party Wall Act does come into effect

@RedLollyYellowLolly0 don’t let it drag on. Pop over and clear the air. I don’t think you are at fault (because the fence move was with their agreement although to facilitate your building and keep their pets safe). Just say it won’t be long and ask if there’s any reason they threw it over because you thought it was going to stay until work complete when you’d have removed it. You could then say it broke some pots … but I’d be taking a judgement call based on how the chat went initially.

PomPomSugar · 23/07/2024 12:15

You do not need a Party Wall Agreement as there is no party wall. However, if a wall is now replacing a fence but the wall is completely within (not on) your boundary you should notify your neighbours with a New Line of Junction Notice.

Yes we are- why do you say that?

Why would you do all that and then sell?

And because lack of a pwa could cause problems

Mirrorcat · 23/07/2024 12:09

You’d have been happy to take the rubbish at the end of the building?! Why should they have the old fence posts in their garden?

you need to be really careful here if you’ve built up to the boundary without a PW agreement. Hope you’re not planning on selling anytime soon…..

Dont create neighbour wars. You have to live next to these people. Apologise for the building inconvenience and take a bottle of wine over.once you stsrt being angry over pots it just escalates. Bite your tongue.

Theotherone234 · 23/07/2024 12:08

Sounds like they decided the wall was high enough to contain the dogs so the temporary fence was no longer needed.

Rather than ask you to remove it, or could they remove it themselves, and what should they do with the panels and posts, they just went ahead and removed it and put the wood back on your land.

Perhaps they got annoyed that you left the temporary fence there longer than they deemed necessary.

Would have been better if they'd just talked to you about it.

I feel it's a bit petty to ask for compensation.

I'd call round with flowers and apologise for leaving it there longer than necessary. Opens up a dialogue so they will probably explain their reasoning.

More talking = less misunderstanding

CocoapuffPuff · 23/07/2024 12:04

Sounds like miscommunication and frustration, to be honest. Maybe they thought it would all be finished quicker?
No, they probably shouldn't have thrown the fence bits over willy nilly, bit it sounds like they've lived with your crap in their garden for a while. Everyone reaches the end of their rope eventually. Go talk to them.

S1lverCandle · 23/07/2024 12:03

There’s no party wall agreement - we have planning permission and it’s all gone thought the proper channels
Planning permission doesn't negate the need for a party wall agreement. You're building up to the boundary so a PTW was necessary.
Your builder should have known this.

PlanningTowns · 23/07/2024 12:02

Planning permission won’t give you all the consents you need - it especially doesn’t give party wall agreement nor building regs.

they are probably fed up with it all to be honest. I’d suggest a mid point bottle and flowers is a good idea and again at the end. Don’t leave it otherwise they could get very upset.

Clear it up, say nothing and maybe pop over with flowers/wine and thank them for their patience.

Yes.
i will do this soon when the build and the noise is over.

@RedLollyYellowLolly0 you/ your builder are in the wrong here

She pushed her fence into the neighbours garden to make room for some building work and then objected when the neighbours shoved it back

No.

my builder used what was their crappy rickety fence which was wobbly by the way and he rebuilt it with about 6 new posts and created a box which went o to their land only by about 2 foot - this allowed us to build the wall and for their dogs to be safe.

so their fence was pushed out and rebuilt effectively and made better which benefitted them.
i don’t know if maybe the fence had since fallen or the posts BUT most of the construction has been thrown over onto my property. They could have asked us and we would be happy to take it all when the build was complete. These massive posts and the old fence panels have been thrown over onto my land damaging things.

im not going to say anything to her. I just wanted another viewpoint and can now see why she might have been upset. There’s no party wall agreement - we have planning permission and it’s all gone thought the proper channels.

One of my boundaries is an old, unstable brick wall. If I "push it over" to my neighbours side, someone could die.

You didn't push over the old fence - your builder erected a temporary fence (an unwanted one by the looks of it) on your neighbours land.

Mind boggles how some people fend for themselves with such lack in ability to express themselves. Must be hard to get by.

Wheresthebeach · 23/07/2024 11:53

Are you somehow the same poster as redlorryyellowlorryredlorryyellowlorry who also seems to have upset their neighbour?

AnonymousBleep · 23/07/2024 11:48

I really don't understand any of what has happened here! Maybe I am just slow today but I can't work out what fence has been chucked where and why.

QueenCamilla · 23/07/2024 11:47

What do you actually mean when you say "I pushed over the old fence"?

I suspect there's an issue with communicating in a way that is understood by the majority - including with your neighbours.

Topofthemountain · 23/07/2024 11:44

S1lverCandle · 23/07/2024 11:42

It's a legal requirement to issue a party wall agreement, op. You're not supposed to start building work without one.
Your builder sounds like a proper clown.

Only England and Wales.

This seems a little confusing... was it your old tatty fence that was left on their side? Or the temporary fence for containing their dogs? Or both?? Is the wall finished so their dogs are now contained again?

The tatty fence was partly used with some extra posts that my builder constructed then this was pushed over onto their land temporarily until the wall was built to ensure their dogs were safe. The neighbour was very happy with this -it was well built and replaced what was pretty rubbish and wobbly

the wall is over half way built but the builder was keeping the fence their until the extension was complete.

i do not want to upset the neighbours
thank you for your viewpoints. Perhaps my builder didn’t fully explain which I am a little concerned about now.

SilenceInside · 23/07/2024 11:42

@RedLollyYellowLolly0 at the time I posted you had not mentioned the dogs...

It all sounds a bit of a shit show. If they are otherwise reasonable, then just apologise for leaving the posts there longer than necessary and move on.

newbeggins · 23/07/2024 11:42

If you don't speak directly to the neighbours yourself to explain why your items/rubbish is in their garden, I would assume they had disposed of your fly tipping rubbish and glad they didn't report me.
