Neighbour smoking on balcony

PorridgeWobbler · 19/07/2024 08:40

We have a relatively new neighbour in the flat immediately next to ours. Now that the weather is improving he seems to spend a lot of time on his balcony smoking cigarettes and weed. Yesterday it was about every 2-3 hours. The smell is horrendous and the prevailing wind flows it straight in through our windows. It’s as if someone is smoking inside our flat. I work from home so notice every time he smokes. Last night he lit up again at 11pm so I had to shut our bedroom windows despite it being very hot. I have young children and their bedrooms also end up stinking of smoke.

I feel I need to say something because it is vile and bad for our health. But I also appreciate that it’s his balcony and he can technically do what he wants on it. What should I say?

AIBU to complain to him?

I’d reasonable to ask however he is also not being unreasonable to smoke in his own balcony.

Only thing you can do is make him aware. If he's a decent enough person,he'll be a bit more considerate in the future.

This is the right advice. It sounds awful OP, hopefully he is just blythly unaware of how it is impacting you, and will change up his schedule to be more considerate if he knows.

Good luck!

Talk to him about it nicely the first time, if there's no effect speak to his landlord (if renting). If he's an owner it's trickier, but not sure why others are saying there's nothing you can do. Weed is actually illegal so I'd call the police every time he does it. They probably won't want to take it seriously but I'd keep bugging them and reminding them it's against the law. At the very least they can have a word with him about it.
And yeah, it might be his balcony but what he's doing is really anti social.
If none of the official channels work I'd play him at his own game - every time he smokes I'd put on music right beside the balcony. I suggest Russian orthodox chants or opera, or whatever you think will annoy him. After all, if he can do what he wants in his home then so can you, but I'm petty like that.

What do you think the landlord ( if he has one ) will do about him smoking on his balcony 🤔

MistyMountainTop · 19/07/2024 09:57

Check whether the leasehold conditions allow this - DD's don't allow smoking anywhere within the flats including communal areas and balconies

BlackStrayCat · 19/07/2024 09:55

I wonder how he feels living next to 2 children.
I would not up the music; he can do much better.

Yes imagine people not wanting someone forcing the stink of weed in their own home, especially if they have kids.

I think there is definitely some truth about weed affecting the brain and making people incredibly daft if we go by your comment...

That and the whole tell teacher on him.

Is he a council tenant, private tenant, or a leaseholder or a freeholder?

There’s sure to be someone you can escalate this to. You just need to know his status first.

Why ?
I'm a housing association tenant we are allowed to smoke in our house and garden if we so wish 🙄🙄

BlackStrayCat · 19/07/2024 09:29

I hate the perception that if he is just a tenant (paying 1,000s) he has less right to use his balcony than a freeholder.

As for texting you for your permission to smoke a spliff. Laughable.

It doesn't matter what he is, he's having a fag/spliff on his balcony and there's no official body which will deal with this.

The only thing you can change is your perspective, so close the windows and shut the blinds (this is standard practice in most hot countries during the day), get an air purifier/ac unit/fan and embrace it as part of urban living.

Butterworths · 19/07/2024 09:25

It's worth a chat I'd have thought. I smoked when I was a feckless teen and the neighbours (of our student house) asked us if we could stop smoking right outside the back door as it was making their kids' room smell. We were fine to move to the end of the garden. We just weren't aware.

BlackStrayCat · 19/07/2024 09:22

Of course you cannot do anything and I am sure you piss him off too.

Living in London is like that. "Ive got kids" so, who gives a shit?
FGS ONE DAY of hot weather.😂

loudbatperson · 19/07/2024 09:17

You cannot really do much about the smoking of cigarettes. It may be unpleasant but he is allowed to smoke there so not much you can do.

In regards to the weed, you could try contacting the police and asking them to speak with him, but if he only possesses small amounts for personal use they won't take a great deal of action. Although if they would agree to come and speak to him it may dissuade him smoking it in public.

For neighbourly relations it's probably best to just have a chat and let him know how much the smoke in entering your property. He may try to be considerate, or may not. But it's worth a try before official routes as it avoids a neighbour dispute on record, which may put off potential buyers when it comes time to sell.

For legally smoking on his balcony?

Startingagainandagain · 19/07/2024 09:14

Is it rented?

If so contact the landlord about their weed smoking.

Crazycrazylady · 19/07/2024 09:12

Honestly i get that this is annoying but if he doesn't wish to spoke in his flat, then without walking outside every time he wants a cig, the balcony is his only option.
you can ask but Im not sure there is much you can do about this,
Joys of living in close proximity to other people

Drivingnowhere · 19/07/2024 09:10

This isn’t any kind of solution. I’m in London and it’s 32 degrees today - I can’t just keep my windows shut.

Opening your window in that heat will just heat your flat up. Windows and blinds closed will keep your flat cooler.

LadyMacbethWasMisunderstood · 19/07/2024 09:10

You would be unreasonable to complain to him as it really is his business. You would not be unreasonable to mention it to him in a nice way and appeal to his better nature. If you stress the smell is quite overwhelming at times he might be embarrassed enough to moderate his behaviour a bit. Not sure he will have anywhere else to go though. An air purifier really might make a difference in the flat.

dbeuowlxb173939 · 19/07/2024 09:10

I would hate it too but I don't think there's anything you can do, he's on his own property not in a public place

Janieforever · 19/07/2024 09:09

pictoosh · 19/07/2024 09:08

He's not going to agree to or do that ffs. Texting his neighbour every time he wants a smoke? Don't be daft.

Yes I chuckled at that. 😂

Janieforever · 19/07/2024 09:08

You can let him know but as others said, you have no rights or entitlement here, he’s allowed to smoke on his balcony.

thing is he is likely to say no, as he’s not going to want to traipse down and out every time he wants to smoke, so it’s either stop or use his balcony. So I think shutting your adjacent windows is the only option, even though it’s hot.

pictoosh · 19/07/2024 09:08

Querty123456 · 19/07/2024 09:02

Why don’t you ask him to text you when he’s heading outside for a smoke. Then close the windows, wait 10 mins and all should be clear.
