Neighbour smoking on balcony

PorridgeWobbler · 19/07/2024 08:40

We have a relatively new neighbour in the flat immediately next to ours. Now that the weather is improving he seems to spend a lot of time on his balcony smoking cigarettes and weed. Yesterday it was about every 2-3 hours. The smell is horrendous and the prevailing wind flows it straight in through our windows. It’s as if someone is smoking inside our flat. I work from home so notice every time he smokes. Last night he lit up again at 11pm so I had to shut our bedroom windows despite it being very hot. I have young children and their bedrooms also end up stinking of smoke.

I feel I need to say something because it is vile and bad for our health. But I also appreciate that it’s his balcony and he can technically do what he wants on it. What should I say?

AIBU to complain to him?

I'd mention it to him, and he can stop it or not. If he knows his smoke is billowing into your home and keeps doing it, you'll know he's not bothered and not much you can do about people like that.

AnnaKorine · 19/07/2024 11:03

I had a neighbour who complained when I smoked on the balcony. I did offer to go downstairs instead as it was only a short distance but when I did that they also complained that I was smoking too near to an air vent and asked if I would walk further down the road. They also complained if walked around at morning/afternoon/evening as the flats were poorly sound insulated and they were shift workers. I moved out after a year because of them, they were a nightmare. But I digress, you can mention it to him politely but if it’s a long distance to outside then I wouldn’t bother as he is unlikely to do that regularly. Surely you can just close the window when he smokes?

Clocloxx · 19/07/2024 11:02

Yuck I hate the smell of smoke too! But sorry I don't think you can do much maybe buy him a vape in hopes he will change to vaping

readingmakesmehappy · 19/07/2024 10:59

@x2boys if he's a private tenant then he's almost certainly not allowed to. In my renting days there was always an explicit clause forbidding it, and every landlord I've ever known ensures it goes in the contract. It stinks out the house and the landlord has to replace all the carpets and curtains to get rid of the smell.

BlackStrayCat · 19/07/2024 10:57

You are correct. I am a secret vindictive smoker.

I deeply apologise to you and will seek the appropriate mental health professionals for my anger management.

Also about curbing my desisre to answer a question asking for my opinion with an opinion.

You have well and truly made me rethink my position on this. I was absolutely wrong.

Have a lovely day.

I will report my opinions and ask for them to be deleted.

I haven't missed any point, you keep saying he can smoke on his balcony - not true if his lease forbids it.

And that if OP spoke to him about it he's likely to want to do it more, because that's what you'd do and it's "human nature"- again, not necessarily true, most grown up people wouldn't react like this, that's you projecting.

Highly unlikely his lease forbids smoking on the balcony.

Talk to him about it nicely the first time, if there's no effect speak to his landlord (if renting). If he's an owner it's trickier, but not sure why others are saying there's nothing you can do. Weed is actually illegal so I'd call the police every time he does it. They probably won't want to take it seriously but I'd keep bugging them and reminding them it's against the law. At the very least they can have a word with him about it.
And yeah, it might be his balcony but what he's doing is really anti social.
If none of the official channels work I'd play him at his own game - every time he smokes I'd put on music right beside the balcony. I suggest Russian orthodox chants or opera, or whatever you think will annoy him. After all, if he can do what he wants in his home then so can you, but I'm petty like that.

That’ls just tit for tat and how fall outs with neighbours start; then you’ve got to live with bad feeling. It’ll be raining again soon and he’ll bugger off indoors.

SummerAndSunPlease · 19/07/2024 10:53

Sorry that was aimed at @BlackStrayCat

I'm a housing association tenant i can smoke in my house and garden if I want to.

AlienShmalien · 19/07/2024 10:48

Put a giant fan on your balcony blowing the air back to him.

passiveaggressivenonsense · 19/07/2024 10:48

Can you put a fan on the balcony near where the smoke blows in to redirect it ?

Fluffyunicorn1 · 19/07/2024 10:47

Just ask him nicely. He can either be nice about it or just tell you where to go. My next door neighbor smokes cigarettes'. Our houses are joined and his back door is pretty much next to our back door. He used to stand at his door and smoke which then came into my house and made my house smell of it. I politely asked him if he wouldn't mind smoking there if he can see my back door is open as it is smelling of smoke in my house and he apologized, said he didn't realize and he doesn't do it there now. He was very nice about it and understood that as a non smoker with children i didn't want the smell. We get along very well now.

Still a No from me.
NONE of my neighbours (and I have quite a few) have my number - even and especially those who behave "anti-socially". I don't have or want theirs.
And to reiterate, if people know it causes a problem, and don't stop or moderate what they are doing to be more considerate, then there is no point in asking more than once.
In my unfortunate personal experience.

I wasn't talking about you or trying to persuade you that it's a good idea to give neighbours one's number.

Just answering the question 'I also wonder who these people are, who have their neighbours' numbers....' with a possible scenario in which that might happen.

Really no need for any drama.

BlackStrayCat · 19/07/2024 10:43

I am bloody angry you are deliberately missing the point.

If someone is going to do something in a flat they are presumably paying a lot of money for, with a balcony, which is presumably what the balcony is for in their mind, they will likely (UNCONCIOUSLY) smoke more not less. "Turn into a chain smoker" was a joke/tongue in cheek.

I am not a bad neighbour, spiteful, angry or battling against the world, smoker, drug taker or an unreasonable inexperienced person.

I am a middle aged lady who lives with her teen by the sea. (Having lived in London for eons) Both renting and owning.
Jesus Christ.

HunterHearstHelmsley · 19/07/2024 10:40

He's likely chosen the flat with the balcony for this very reason.

You could have a chat with him but I don't think you can reasonably expect him to leave his property every time he wants a cigarette.

SummerAndSunPlease · 19/07/2024 10:36

@BlackStrayCat You seem very angry, I hope you get the help you obviously need.

halava · 19/07/2024 10:36

No windows on the other side away from the balconies?

Let HIM know (politely) first and see what he says. Log out of MN for five minutes to do that. Unfortunately we can't do much.

LighthouseTheme · 19/07/2024 10:35

MarkWithaC · 19/07/2024 10:27

Well, I can imagine it might go something like
'If we swap numbers then maybe you could message and let me know when you're heading out there, so I have a heads-up to close my windows?'

NB I haven't said I think it's a good idea to ask him to text when he's going for a smoke (as it happens, I don't); I was just trying to respond to your seeming incredulity that neighbours might exchange numbers.

BlackStrayCat · 19/07/2024 10:33

FGS. It was sarcastic. I would not spitefully turn into a chain smoker.

I do not fucking smoke.

Goodbye.

Butterworths · 19/07/2024 10:26

No, as I said upthread I have been in this situation. The neighbours said please don't smoke under the kids' window (outside our own back door). I said oops yes no problem and smoked elsewhere. I did not start chain-smoking to spite them.

Not everyone treats the world as a battle ground.

Edited

So you were in a city flat with a garden? Gosh Good for you. You sound like a fabulous smoker.

Stop nit picking. This is totally different.

SummerAndSunPlease · 19/07/2024 10:28

@BlackStrayCat You said if a neighbour asked you not to smoke on your balcony you'd "take up chain smoking". That's not being a "lovely neighbour".

People with this kind of attitude were the reason I moved out of a city flat and now live in the country with very few neighbours. It was constant weed smoking that stunk out our flat when we had a newborn baby, and ignored polite asks to not do it out of their window (there was a shared garden they could have gone in).

Would you really be happy with someone smoking every 2-3 hours and stinking out your flat?

Also, it might be against their lease to smoke on the property so I wouldn't be so adamant that they "bloody well can" smoke on their balcony.

Which conversation - the one in which they are asked to notify the person they are going to annoy....? How weird. Not in my world.

OFGS.

If someone tells you not to do something everyone knows it makes them do it more (unconciously)

Children/sweets
XH/me drinking a glass of wine
Teens/drugs,alcohol,smoking

You name it.

Private tenancy maybe but not all tenancy. I'm a tenant and there's nothing forbidding smoking in my flat.
