Neighbour smoking on balcony

We have a relatively new neighbour in the flat immediately next to ours. Now that the weather is improving he seems to spend a lot of time on his balcony smoking cigarettes and weed. Yesterday it was about every 2-3 hours. The smell is horrendous and the prevailing wind flows it straight in through our windows. It’s as if someone is smoking inside our flat. I work from home so notice every time he smokes. Last night he lit up again at 11pm so I had to shut our bedroom windows despite it being very hot. I have young children and their bedrooms also end up stinking of smoke.

I feel I need to say something because it is vile and bad for our health. But I also appreciate that it’s his balcony and he can technically do what he wants on it. What should I say?

AIBU to complain to him?

Of course it’s not an option. I can’t afford to just move house because my neighbour is polluting my flat! What are you on?!

I'm not on anything! Just giving you the options, put up with it or move out - it's his home, his balcony and his addiction so if you can't move out.....

When did people become so entitled that they inflict their nasty evil smelling pollutants on other folk?

No one is smoking in her flat. It's her choosing to open the window that is inflicting it on herself and her child.

I live next door to a family with three noisy young boys. I work from home and need peace and quiet to concentrate. In the school holidays I don't tell them not to play in their own garden as the noise disturbs me. I shut the window (and turn the fan on) if them reasonably using their property how they like disturbs me. I don't get to tell them to cease their reasonable behaviour because I want my window open! Like it or not, smoking on your own balcony is a perfectly reasonable thing to do, and OPs desire to have her windows open doesn't trump that.

Apparently the other folk should "just close their windows".

No matter how hot it is

Bluebirdover · 19/07/2024 19:50

@mrsm43s inane because it had already been answered. But you'd not read the OP or lack comprehension skills.

@mrsm43s I merely told you that your inane comment was dealt with in the first OP.

I don't need a lecture, thanks!

Not inane, valid and reasonable.

@mrsm43s the issue with that was explained in the first post.

What? That its hot? Well, yeah, OP probably will be hot if she doesn't want to let outdoor air along with associated smells and pollutants inside, unless she installs air conditioning.

Choice is windows open letting air (and smoke/smells/pollution) in, or windows closed keeping air (and smoke/smells/pollution) out.

OP doesn't get to control what her neighbours do on their own balcony for her convenience. Not her right. She gets to close or open her window, whichever suits her best. That is all she gets to control.

Cigarette smoke is normal daily living, just like children's noise is normal daily living. Luckily, OP has the choice to shut it out by shutting her windows.

When did people become so entitled that they think it's up to everyone else to inconvenience themselves to suit them? People can smoke in their own homes/balconies/gardens if they wish. And I say this as a staunch non smoker.

The issue is the smoke coming in through our open windows, not coming onto our balcony.

So shut your window. Problem solved.

Put up a barrier at the end of your balcony adjacent to his. This could be solid, like a board, or as someone suggested upthread, a trellis with stuff growing up it. Even though this kind of barrier is porous, it can very effectively baffle and deaden the prevailing breeze so the vast majority of the smoke would dissipate on his side.

@PorridgeWobbler

Seriously - get one of these. We’ve got the top one on this list - it clears fire smoke and particles brilliantly - it’s a HEPA filter so will get the pollutants from both the cigarettes and general London pollution out of the air.
Gets rid of the smells quickly too.

Perhaps it’s BECAUSE we have to breath in pollution all day long that I don’t also want to breath it in at home.

If you lived somewhere polluted and someone came and stood next to you and lit a cigarette would you move away from them or just shrug and think “oh well, what does a bit more pollution matter?”.

You seem to object to the idea of someone in London wanting what’s best for their child’s health. Why is that?

Oh great, so you'll have your windows shut all day anyway having to breathe pollution in all day.

I live in London and object to people thinking they can dictate what other people do in their own homes. If you don't like what comes naturally with living on top of other people in a flat then don't live in one.

If he did it Indoors you'd probably still complain and want him to shut his windows next.

Smoking cigarettes is still legal, I’ve not smoked for over a year now, but am still on the side of anyone who smokes. Unless there is a clause saying you can’t in your flats or on the balcony there is nothing you can do, so leave him alone. He’s doing nothing wrong, and your little darling children or indeed you are absolutely not his concern. I really hate how smokers are demonised but not drinkers, who harm far more humans in the grand scheme of things, with their drunken behaviour, drink driving or violence. Smokers have been pushed around, it will disappear one day, and really it will be for the best of course, but he is outside like everyone wanted. But still the complaints go on ‘but they are smoking in beer gardens while we are trying to enjoy the sunshine WHAAAAAAA!’. Just move if it’s that bad!

You sound irrationally angry about smoking, maybe take it up again and chill.

It stinks and no one that isn't a smoker likes it!

Vile habit.

Glad it's getting harder and harder to smoke anywhere.

What made you give up? The smell? The fact it was killing you?

In my sons old flat that he left in Feb
he was not allowed to smoke in his flat or on his balcony

originally he was buying and in the lease there was a clause about not allowing smoking on the balcony

however the balcony was in fact a long walkway it wasn’t separated for each individual flat people did put up mini fences/ planters to separate each balcony but they couldn’t be fixed to anything due to possibly being a fire hazard

no one used it as a walkway either

if he is renting find out who he rents from and complain to them

The important phrase in the above is 'would you move away from them'. That is an option.

Not your balcony, not your business. I don’t drive a polluting car, but I can’t stop others.

Not quite the same as having to breath in cigarette and weeds smoke in your own home.

You're in London. At some point most weeks you will be directly under the fallout cloud of one of the biggest incinerators in Europe. There's also the small point that a large percentage of vehicles in London are still not electric. Cigarette smoke is the least of your worries in London if you're concerned about poisonous chemicals. .

Perhaps it’s BECAUSE we have to breath in pollution all day long that I don’t also want to breath it in at home.

He might not realise and if you tell him he might do the decent thing and go downstairs.

He might not in care which case there's nothing you can do.

Hope for the best and have a nice chat and see if you can get things sorted.

Pushing the problem onto the people who live on the ground floor is hardly "the decent thing". I lost count of the people I had to ask to stop smoking on the front step of our old block of a summer evening because their smoke was blowing into our baby's bedroom while baby was asleep in there.
