To ask neighbour not to smoke in his own garden?

We live in a flat in converted townhouse. We are on the second floor. Neighbour is in the garden flat (not shared garden). Our bedroom is at the back of the house.

As it’s getting hotter, we need to have our bedroom window open all night.

Garden flat neighbour is a heavy smoker. He stands in the french doors of his flat and smokes “out” into the garden (if that makes sense).

The problem is, that the smoke rises up and it makes our bedroom stink. Three mornings in a row we have woken up to a bedroom smelling of cigarette smoke.

AIBU to ask him not to smoke in his garden? Or at least go somewhere else where it won’t rise up into other people’s homes. Other people in our building have also commented on this.

You can try. But don’t expect much. In my last apartment the upstairs people constantly threw fag butts down onto their neighbour’s balcony below - and they landed in a baby’s pram and started to burn. Luckily the mother was there and managed to get baby out before too much damage was done.

They continued hurling them down onto the neighbour’s balcony even after that - and being asked to stop by the housing association.

Also for people saying there’s no risk: third-hand smoke drifting into a bedroom and sticking so badly it’s notable the next morning can be dangerous, especially to children.

Our neighbours smoke in theirs, and are thankfully in the process of moving out. I never did say anything, but it really bugged me.

bloodyplumbing · 14/05/2024 20:22

@SabreIsMyFave I'm anti smoking, but you cannot demand that they stop!

You're being ridiculous and may have to use your electricity or shut your window. Saying you're not going to, only impacts you, your choice. The tic turd can politely decline your request.

It's not illegal!

Because YOU smoke, everyone else has to close windows and not have fresh air in ther house or flat. Wow - what a selfish, horrible T**t!

This. Why the fuck should anyone have to have a stuffy house, with NO fresh air blowing through - just because of some selfish stinky inconsiderate arse puffing away at a stick of nicotine? Some - not all - but some smokers are such vile and selfish individuals.

Like the idea of the fan blowing OUT of the window... Like fuck would I be wasting my electric running a fan to blow the bloody smoke away, because some selfish tic-turd next door decides to smoke near my window.

@fope You absolutely have to ask them (nicely) to smoke as far away from your house (and windows) as possible.

@Whatthebarnacles It still doesn't hurt to be considerate of other people.

Whatthebarnacles · 14/05/2024 19:38

RosieTheChi · 14/05/2024 18:10

@Whatthebarnacles You can't smoke anywhere outside. Only on public land. Smoking is not allowed outside hospital doors or in a garage forecourt.

I think you know what I meant. I'm talking about gardens and streets

maddiemookins16mum · 14/05/2024 19:34

YANBU and I’m a smoker. He knows where his smoke goes….up, it’s not rocket science to know it will waft into the windows above.

liquoricetorpedoes · 14/05/2024 19:03

My Mum has lung problems and an allergy to cigarette smoke (it’s a nightmare) and has had this with a neighbour. They were asked politely if they would mind smoking away from her property and it has caused huge issues with them calling her totally unreasonable and entitled. So based on our experience, you can ask but I don’t hold out much hope.

rwalker · 14/05/2024 18:39

Depends how you ask
I certainly wouldn’t ask for no smoking in garden
perhaps say not directly under the window

HollaHolla · 14/05/2024 18:38

I would hate it too, but I don't think you can ask him to stop smoking in his own garden. I hate the smoke too. 😣

fungipie · 14/05/2024 17:53

I used to smoke. OP is not asking neighbour not to smoke in his garden, but perhaps to smoke in a different area where it would not affect OP, or less.

I don't smoke and I wouldn't ask anyone to move in a different part of their garden,it's like saying can you not drive when I am around because the smell of fumes and the smoke will get in my lungs.

Beryls · 14/05/2024 18:18

I think it would be reasonable to ask but depends what he's like? I'm a smoker and the last week I've been going down to the bottom of the garden as neighbours have had their windows and patio doors open with it being warm and wouldn't like it to blow into their houses. I wouldn't be offended if a neighbour asked me to do this if I hadn't already thought of it myself.

Riapia · 14/05/2024 18:18

No point him going to the end of his garden. A MN’er can smell cigarette smoke from the next county.
😉😁😁😁

BlondeFool · 14/05/2024 09:27

I understand it's awful for you but it's his perogative to smoke in his own garden.

I think you are being ridiculous to think you can stop someone smoking in their own garden. I hate smoke too but would keep my window closed and keep a fan on through the night.

Missindependent007 · 14/05/2024 18:16

pictoosh · 14/05/2024 17:57

As things currently stand, I think it's pretty cheeky to ask someone not to smoke or suggest where to smoke, on their own property.
You might get away with asking him to move if you do it very nicely and he's a good guy but I can't imagine he'd keep it up for long. It's his preference to stand at the door and he'll go back to doing that...not to inconvenience you but because it's his house and that's what he likes to do.

Think you're on a hiding to nothing on this one I'm afraid.

Exactly...It's like stating people should stop using vehicles because the fumes are smelly and bad for the lungs 🫁.

Yellowhammer09 · 14/05/2024 09:49

I don't think you'd be unreasonable to ask if he can smoke at the other end of the garden. Any normal person would understand. Yes, it's a private garden but it affects his neighbours.

This.

He might be a decent person and not realise his smoke is coming into your bedroom.

RosieTheChi · 14/05/2024 18:10

Whatthebarnacles · 14/05/2024 18:06

YABVU.
Not only is it his right to smoke in his own garden, but it is literally everyone's right to smoke anywhere outside at all. Literally! They've been banished from indoors by all and sundry as it is, you can't possibly expect anything from him.

But yeah, it's a gross smell. For all of 5 minutes or so. It's no different to him doing a bbq. Or someone cooking strong foods. Not pleasant if it's not your thing, but unreasonable to suggest that someone does as you want.

Greenleafants · 14/05/2024 18:04

I feel for you. It’s really shit. Maybe try closing the windows and getting a really good fan?

Differentstarts · 14/05/2024 18:01

RosieTheChi · 14/05/2024 17:54

@Differentstarts Absolutely but it depends on the level and frequency of the noise in addition to the nature of it. So normal every day activities are fine but if someone was having screaming arguments and loud parties, then that would be a problem.

I don't think it would harm the neighbour to ensure the smoke doesn't bother the neighbours. It's good to have a bit of consideration all round.

But most people smoke by the back door so that they can listen out for kids, doorbell, telephone or anything else that may need attending to. I'm not going away from my house and leaving my children unattended to suit a neighbour who wont close their windows. I'm not the mccanns.

HangingOver · 14/05/2024 18:01

He’s a smoker, so you instantly know he isn’t a decent person by that fact alone

Oh fuck ooooooff

SloaneStreetVandal · 14/05/2024 17:56

I sympathise, the smell of cigarette smoke is vile and very clingy. There's no harm in explaining to him that the smoke is coming directly into your bedroom, and asking if he'd mind moving further out into the garden. He may refuse, in which case you'll need to just tolerate - perils of living in a shared building!

RosieTheChi · 14/05/2024 17:55

@allthemiddlechildrenoftheworld From working down the pit from a young age.

allthemiddlechildrenoftheworld · 14/05/2024 17:55

@RosieTheChi It could be argued though, why should other people have to smell and breathe in your smoke? It's not contained on your property and ends up in the property of another person so should other people not be considered?

I have a neighbour with Emphysema and he wouldn't be able to breathe with smoke wafting into his house constantly. What about people like him?

What would your stance be on excessive noise coming from your property? have you ever asked yourself how he/she got emphysema???????
