Am I a first time buyer?

I'm thinking of buying a house in my name. My husband and I are married. My husband bought a house in his name, but I paid the deposit and we've been paying the mortgage together. I transfer money for the mortgage to my husband's account, and he pays it. In this case, if I buy a house in my name, am I entitled to first-time buyer benefits?

No you’re not entitled to all first time buyer benefits. Because you are legally married the asset (the house) is a joint marital asset, so you are not treated as a first time buyer even if buying in your sole name because you do already own a home legally so for stamp duty purposes you are not a first time buyer. You can still use ISA’s though and I believe some other things

You paid the deposit, you pay towards the mortgage but because only your husband's name is on the deeds you think you are a FTB? For the sake of all the genuine FTB's I hope this isn't a loophole you can exploit. I'm not someone who says people should only have one house because if you can afford it then you should be able to buy what you want for whatever reason, holiday home, rental etc, not my business, but for goodness sake, even if only morally, pay the correct dues.

Speak to a mortgage broker - I think you would be. You aren’t on the deeds for a house so I’m not sure why you wouldn’t be.

Not sure why people are being a bit judgey on this? It’s a fair question!

Op wouldn't a FTB as she is married to someone who owns a house and in law that means she has a claim on that property.

It you want to have separate finance's then you don't marry.

Op I'm not sure why you aren't on the deads anyway if you paid the deposit and help pay the mortgage. Seems daft not to be, but at lest your married so he can't just runoff with the house.

From that article in the guardian it sounds as if you would only be able to benefit if you are selling the current home/divorcing. Then the new home is only in your name.

Otherwise as a married couple you would have a second home so need to pay the higher rate of stamp duty.

I think you probably are. You don’t own a house because your name isn’t on the land registration for the property you live in. Legally you don’t own a property.
