Partner Threatened Other Driver

My partner who suffers from PTSD and has been having severe problems with it recently, was involved in a roadrage incident a few weeks ago. I wasn't there and didn't see it but he says got out the van and threatened someone with a hammer.

The police have asked him to come in for an interview under caution.

He did it, he didn't commit actual violence but he threatened it. I'm still processing it and trying to work out what to do.

I have been googling and it looks like there is a mandatory minimum sentence of six months which may or may not be suspended. That would be the minimum even with any mitigating factors such as a guilty plea or his mental health.

I've never been in trouble in my life and have no idea how these things work. We have a 2 year old and I'm worried about the consequences for her and me. Things like social services getting involved, her having a dad in prison, it's all just horrible and I am scared.

Like I said I don't know what will happen, he has never threatened me or our DD, I have no concerns about our safety with him. But I am worried about everything else. She is my priority but I am worried about him, he is in the middle of a mental health crisis and I don't know what to do. I don't think splitting up with him will help, but I will do it to protect her.

Everything is a mess!

do you really want a man in a mental health crisis who threatens people with hammers around your child?

I don’t know how you can say with such certainty that you are safe in this situation tbh

Leaving someone doesn't happen just like that I need to plan etc. I am not worried about us being at risk from him. But I am worried about the consequences of his behaviour and the impact on our daughter.

From what you have described - he didn't hit anyone of anything. At worst he would be charged with Threatening Behaviour and would be likely to receive a fine or community service. The police may even just decide to issue a caution.

But that doesn't change the fact that he seems incapable of controlling his temper. Everyone gets angry but I couldn't live with someone who threatened someone with a hammer - even once.

He needs to control his temper and get on top of his mental health. He didn't hit anyone but this is very serious.

I looked it up and I think it would come under threatening with an offensive weapon which would carry a minimum sentence of 6 months up to a maximum of 4 years.

It is the beginning of the end for us, but obviously I need to get my ducks in a row.

I'm more worried about what could happen with our daughter, lie social services getting involved etc.

There is no excuse for threatening violence. I would not want a man with such anger issues anywhere near me or in my house, who knows when he might get ‘triggered’ and go for you too. This is not a safe situation or relationship for you OP and I suggest you get yourself and your daughter out as soon as you can

I know there is no excuse, I've said I'm planning to leave. I've literally only just found out about it.

I just would like to know what might happen with regards to my daughter, me, social services etc.

I think you can look it up online, sorry that doesn't sound helpful but you should be able to contact them quickly. In my DH's case the GP made a referral but very quickly, like the next day at a weekend. We didn't have to go through any hoops really but our GP knows us well. DH did something that stood out as very unusual and risky like yours has
