Went to post this on the other thread but it got pulled before I could but thought it might still come in handy.

This company specialises in after school/part time nannies. They usually use University students: www.korukids.co.uk/

Fair point! She did seem very certain she wasn’t though. Our afterschool nanny is an employee btw under the lack of substitutability condition. OP is absolutely entitled to choose whoever she wants, mind, she wouldn’t be the first person to choose a nanny on cultural or fit grounds.

Actually, you absolutely ARE the employer of your nanny, legally and for tax purposes. There are some exceptions (eg where they work for multiple people) but generally you are their employer and must abide by employment law. And HMRC will agree. I know it seems odd, but it’s the law. Childminders are not employees. Nannies are.

Surely that is the point, if OP wants after school care she probably isn't the only one the nanny is working for which is why I said she could be the employer but she might not be. Presumably she has looked into it, she quotes HMRC, so not sure why you are so sure she is the empoyer.

Just to clarify I'm not saying OP could be an employer, I assume she knows that with going through the agency and comparing it to windowcleaner, but it could be confusing. I don't know if it was clear in original thread but just thinking there could be confusion and MN maybe not wanting people to get into trouble if they say advertised asking for someone of a particular ethnicity.

Maybe I'm just looking for a positive spin but it just seems possible.

I assume there was confusion as you could be an employer of a nanny or you could not depending on a series of things, I think HMRC website explains it. They certainly used to but I'm retired so it might have changed.

Otherwise, the idea that I'm an 'employer' for seeking out a nanny is a joke. I'm also not an employer of my window cleaner, cleaner, hairdresser, I pay them for a service and I definitely get to choose who comes into my home to do a service without employment law restricting me!! If in doubt, please ask HMRC whether I'm an employer. On that note, I imagine a great many large employers who do have to abide by employment on law, have been asking exactly that question since BLM - how and where can we find more black employees?

These people are funny, trying to block us at every turn, even in our own homes.

Importantly, I didn't place a job ad.

These are some funny funny clueless people.

Some of the people criticising that thread where, like me, not white.

Or is everyone who criticised your view now deemed “white” because they have a different perspective to you?

People have to remember that MNHQ run a jobs board that pays income from employers taking out ads. The OP was suggesting choosing a nanny based on race, which is not a protected occupation and therefore against the law. I agree she should have a right to do it for employees in her own home, but there was a clear conflict of interest for MNHQ as to what they have to police with their other formal job adverts.
