To buy this land and risk upsetting the tenants next door

Long story short. My house is at the back of a large house which was converted into flats last year. I own the freehold to my property and have had problems with the tenants of the flats parking on what is actually my land. It got bad when the LL of the large house 'rented' a part of my property to one of his tenants as an extra parking space and it took a long time and solicitors letters to get it all sorted.

I also had to spend money on getting bollards and a fence to ensure no-one parked on my property.

My property is at the end of a T shape and I part is used as a passage to my house ( I have legal access over it) and a parking area for 5 cars rented by the LL to his tenants

However because of all the problems my solicitor has done some digging to ensure my legal right of way and that nothing comes back to bite me on the bum with the owners of the large house.

It then got interesting - it seems that the LL bought the large house at auction on a 99 year lease. My Solicitor saw the legal pack and there was no mention of the land on the paperwork.

He has now found out through the freeholder that the land does not actually belong to the large house but to the house next door.

The freeholder of the house next door has confirmed yes its his land but as he does not live in the house was unaware that the LL of the large house was using it as far as he was aware only I had access to it.

He has now contacted my Solicitors and offered to sell me the land, If I don’t want to buy he is going to offer the LL the chance to lease it from him but if he does that I am worried about my own access across it.

I am very tempted I can enlarge my garden and my husband (who rents a garage ) can also park his car on the property we can afford it and it may increase the value of my house and provide a safer environment for my DS and bump when he/she arrives.

But that is not going to sit well with the tenants of the large house and I can forsee huge problems with them as a couple were very abusive to me during the problem with the parking before.

I have a couple of weeks to decide. I know it would not fair to the tenants but its something they will have to take up with their LL as either he has been badly advised/mistaken or is chancing his arm renting out parking spaces when he knows its not his land (I suspect the latter).

According to my Solicitor there would be no legal or planning issues if I wanted to change the area to a larger garden (although I will check with the council myself)

So would I be UR to buy it

Definitely get it sorted as soon as possible. I'd be on the phone as soon as your solicitor opens tomorrow! Do not give LL a chance to find out until it's all happening. Speak to the owner tonight if possible! Good luck.

TBH I don't think you have a choice if the LL buys it then they will cause you problems.

Tell the tenants all dealings must be in writing only. Any abuse or anything phone the police and write to the LL solicitor.

Yes Mrs Campbellblack it was me before the LL had rented out the space in front of my house as an extra parking space for his tenants and it was the problems I had with that that led to my Solicitor doing a detailed search and finding out the issues

Buy it. No question - you need to have the ultimate control over it. Does the current use of the land create any precedent since they have been using it for a while?

BUY IT !!!

And don't mention it to anyone else until you have it safely registered in your name.
You can decide later what you want to do with it and how to deal with the neighbours.

It's a no brainer, of course you should buy it. You have practical reasons for it being a positive thing for you even without the difficult tenants. If they don't like it then they can move on, they have no financial tie to the place like you do, and then it will be all sorted.

The long term gain will be well worth the short term stress.

Do it. And I think you're probably right about the LL renting out spaces on land he knows he doesn't own. From what you've said it sounds like he'd stuff you.

I wouldn't be able to sleep for the excitement of waiting for the solicitor's to open on Monday Grin

Who owns the access passage? Is that available to buy too?

Buy it quickly and quietly, before the LL gets wind, the neighbour has done you a huge favour, if you have amy qualms at all imagine the alternative reality where the landlord buys it and makes your life utter hell. Buy it without hesitation.

I remember your previous thread and was staggered that the tenants were so rude and entitled, not to mention the LL charging rent for land that wasn't even his.

So absolutely, definitely, 100% buy it. If not, you have no control over what happens to it, which puts you in a weaker position if you ever need to sell your house. Those tenants won't be there forever.

Also it would be worth it to see the LL's reaction once he finds out.

Absolutely buy it. Where they park their cars is really none of your concern, especially if they've given you abuse about it previously. They're only renting, if they don't like it they can always find somewhere else!

I agree, buy it but work out some kind of rental deal for the current and future tenets so they can park. Who knows, if that continues then the cost of the rent might pay for the land.

Definitely I would buy it in your position OP.

The tenants' parking issues are not your problem. I live in a very busy road and people park here for work and some for the railway station. More often than not I have to park several streets away. It's something I have to live with. No-one has a god given right to park in the street or on land outside their house. It's just unfortunate for the tenants that their LL has given them the impression they have.
