I attended a brilliant sen legal workshop today (hosted by peach) that explained how the new SEN law will affect statementing process, will take away parents' rights and right to appeal will be gone.Have got papers from there....is it ok to scan and pot a copy here, if people will be interested?

I'm not aware that you can upload unfortunately, however people could possibly inbox you their email address so you could send on to them on a requested basis? I would be interested and will inbox you if that is ok?

What right to appeal has gone? What parents rights have gone? I am doing something on the bill at the moment. It is pretty useless stuff - weak, vague and certainly doesn't change things for the better. But I am not sure what rights of appeal you are talking about.

If it's the workshop whose publicity I've seen, it was run by a couple of people who I am afraid have been responsible in the past for seriously misreading previous versions of the draft and spreading a lot of unnecessary alarm. Inappropriately is right, no rights of appeal have gone. I would treat this with quite a lot of caution.

Just about to say the same - right of appeal still exists, right to request s.a. Exists etc. Its not very exciting in terms of changes (same review periods, slightly shorter assessment times etc) but not a loss of rights really.

Thanks for the documents. I will have a look through them tomorrow and see what they say but I agree with the posters above. I know when the proposed draft came out last year(not the draft bill) there was some misinformation about the rights of parents being removed.

The problem with the Bill is that the Gov said it would tackle the SEN process being a struggle. The Bill does nothing to change that.

It is a complete loss of rights....the right to request for SA is there but you cannot challenge the decisions. It is not written explicitly in the new draft code of practice, but in application, the new draft code is not v helpful. Nerfmother....do you think it is v helpful?

Which decisions do you mean? My understanding is that you can appeal against say a refusal to assess etc just as now? New sencop very short, not read it more than once, bits are interesting, but no, I don't think its better.

The document is not right here in front of me nerfmother. I will write first thing in the morning about it :-) but yes, the new draft is least helpful. On the face of it may look like things might be improving but in all practice, things are going to be v v difficult for at least hfa asd kids

I think there is a lot of understandable concern; it is likely that getting a plan will be even more restricted and there are questions about accountability for the rest of sen provison (without a plan). Originally, mediation was going to be enforced, but no longer - is that what you meant?
If you want to send me the docs, I'd be happy to read them.
