AIBU?

AIBU to be a bit annoyed or have i read this wrong?

I started work 4 weeks ago at our local Boots,15 hrs a week so it would fit in around ds & dh's work shifts.

First week i worked 24 hrs,second week i worked 28 hrs & the third week i worked 21 hrs,so far this week i have worked 10 1/2 hrs & have a 6 1/2 hr shift today.

There are 3 supervisors & 2 of them take it in turns to write the rota, the lady doing the rota this week told me yesterday to come in for 10 this morning & she would give me my hrs for the rest of the week then & i would be in every day.I am a bit annoyed at that as dh is back in work this week so ds will have to go to cm a lot this week.

I just thought of the money & didnt say anything.

Anyway last night i was reading through my paperwork & came across this paragraph,

Your contracted hours are 15.00 per week, together with such additional hours as may be required to meet the needs of the business. There will be no payment for additional hours unless this is agreed in advance with your manager.

I have had 3 pay days & each one has been for the amount of 15 hrs worked.

I am so annoyed with myself for not noticing this earlier & i feel like i have been made a mug out of.

I am going in today to have a word with the manager about this & the issue of not getting our rota till the day before.

AIBU to feel this is not working out?

Sounds ridiculous. Surely they should pay by the hour?

They can't surely expect people to work for free???

I am going to see what the manager says today & if i am not happy they can stick their 1 weeks notice,i am off today,it would cost me money to go to work.

I wouldnt mind but i never asked for the extra hours, they were just handed to me on a post it note,so annoyingly the girls knew i would be working for free.

YANBU at all.

I think you might like to look for a job that pays you for what hours you work

Working for no pay? Seriously? That is outrageous!

YANBU

If I were you I would raise it with the manager and ask if they intend you to work over time- an extra 12 hours in a week is too much not to be paid for it. I think their HR department would find this very interesting. I used to work for high mgt in Mcdonalds and know with big brands they have to treat you will as head office will take a dim view of such expolytation.

I have no idea of the legalities of this but it sounds appalling. In the second week you worked nearly double your contracted hours for no extra pay! And how are you meant to organise CM etc if you don't know what you are doing until the day before?

It sounds like they're taking the piss to me. I would definitely be having a word with the manager.

I would take your contract to CAB, personally. I work for a large high street retailer and we get our contracts and any overtime has to be agreed before being signed for and it gets paid at thye same hourly rate as normal work unless on a Sunday or Bank HOliday.

I am really shocked.

The other issue is not getting my weekly rota till the day before the week starts.

I worked the weekend & the supervisor told me to come in for 10-5.30 today & she will give me my hrs for the rest of the week then.

My cm needs to know when i need her before then so she has made plans for tomorrow & Wed so i shant be working those days for them.

I feel sad as i like the work.

That's standard wording for many contracts with an annual salary. For example, if you work full time in an office, they would use this wording so that you don't get overtime for staying 15 minutes to finish something off, of whatever.

V. unusual to have it in a shop contract though, where presumably you're on an hourly pay structure. Speak to your boss, it may have been a cock up! If not, I can see why you'd leave.

they are taking the piss. Go to ACAS.

I think I would just say "I can only do my contracted 15 hours as otherwise it will cost me money". You may find that whoever does the rota has just not thought about the fact that you are not being paid - she may not even know that you are only supposed to do 15 hours a week.

buda they do know, its only a small shop & thinking about it now i have noticed that the ladies who have been there longer only work their contracted hrs & no more.

I feel like a prize mug & i have been taken the mickey out of because i am new & dont know the way it works.

yes I agree with BUda

either your supervisor is taking the piss or they do not know about the 15 hours

either way, if you raise it with the manager, I'd be surprised if they weren't sympathetic (tell them the hours you have worked)

what I am wondering is how come this went on for 4 weeks without you noticing you weren't paid for those hours? are you paid monthly?

Report
foxinsocks · 02/11/2009 08:11

ok sorry, I can see you have been paid 3 times already

Agree with ribenabeery, it should be that they've paid you wrong ie the local office has not added in the extra hours.

If I were you I'd insist on speaking to the manager as soon as you get in and if you're not gonna get paid walk straight back out again. The odd hour or two would be one thing but almost double your working hours for the same pay in a pay time job like that, no way pedro!

Report
littleducks · 02/11/2009 08:12

I would broach it nicely though, I honestly cant believe that they arent intending to pay you at all for the hours (they may have some stupid system where additional hours are paid once a month or something, or they may have got you mixed up and think they signed you up on a higher hours contract, it does happen)

But if they do confirm they arent paying you, come on here name and shame the branch and im sure we will all kick up a big fuss!

My dsd works part time for Boots and the OP is correct. If my dsd works over her contracted hours she doesn't get paid overtime, just time off in lieu of wages - unless her store manager is feeling generous .

ok, I would say 2 things...

how badly do you need the job?

if you need the money, then you have to go back, hold you head up high and say you hadn't realised what was going on and from now onwards, you are only working the 15 hours unless you get paid the overtime for working more

in the end, this was your error as you carried on doing it after week one when you had a chance to stop it but I'm sure you don't need salt rubbing in your wound. WOuld also have been nice for someone to take you aside and explain what was going on.

Usually in retail you would only be expected to come in and not be paid if there was a meeting or training for an hour or something. I have never heard of anyone being exptected to work for nothing.

How crap is there induction if things like ot and time off in lieu aren't explained.

It could be that the mananger/store mananger hasn't added the extra duty hours onto her time sheet.
I work in Boots and am contracted for 15 hours a week. However, I get paid monthly and they seem to work a month behind when it comes to thing like extra hours - all these have to be added onto a time sheet, if they aren't then they won't pay you.
I also know exactly what hours I am doing - I do the same 3 hours every day, none of this "come in tomorrow and we'll tell you then what you are doing for the rest of teh week

On odd days when I go over my 3 hours a day, say by 30 minutes, then I take it as time off in lieu, as it suits me that way, but any more than that, then I get paid.
I would go to mananger and ask her if she has been putting your extra duty hours on your time sheet, and if not can she do so for next week's pay. make sure you have a note of how many you did each day. Then simply say that you are not going to do more than you are contracted for.

It says: agreed with your manager in advance.

Before rushing into resigning or anything...

next time you are asked say: yes if you pay me.

If they kick up, THEN you take all the steps as described, because really it's like blackmail. Effectively it's a way out of the minimum wage when spread out over the hours. It might fall foul of minimum wage legislation.
