AIBU?

To need some paid holidays

I've had a bit of a breakdown recently with work. Boss pays no sick pay, holiday pay etc. I work full time and after numerous years I have just had enough!!!! I would be happy with just one week, it's so unfair. I know I have a few days I need to book off this month but I also can't afford to take the hit in my wages. It's a law for a reason! But my employer doesn't care. Angry is anyone else in this boat Sad

Are you an employee?

If so you have rights to paid leave.

I would advise contacting ACAS for advice on what you are entitled to and what to do about your current situation.

Are you self employed/contractor?

If not you are absolutely entitled to holiday pay.

Are you a PAYE employee in the UK?

Sometimes bosses can be shif, mine waited until the day I went onto maternity to tell me she wouldn't be paying (is it ssp?) or whatever the designated thing it is. I couldn't get the state maternity pay because she was supposed to pay it.
It took Hmrc about a year to investigate and back pay it all. It was a very stressful time!

Shif? Obviously I meant shit! Blush

You've been putting up with this for years and done nothing? More fool you!

Or are you actually self employed/ a contracor?

No it's not a dodgy job lol as far as I know anyways. No I'm not PAYE, again as far as I know because boss doesn't provide much in way of paperwork etc so god knows. Also to the person(s) saying more fool me for staying, I am looking for other employment, I have a disability so that makes it difficult. you don't know my circumstances so its unfair for you to pass judgement on that. I should be able to do my job without worrying if my employer is breaking the law or not? It's hardly my fault.

Also Ginger that is horrible. What an awful thing for a boss to do.

Are you paid cash in hand? If you can give more details, we can probably help work out how he's avoiding paying and maybe find a way around it.

Sorry I forgot to answer, no it is not cash in hand.

If you're employed (not self employed) your boss must pay holiday leave. What do you do?

Report
SwingingFromTheChanderlier · 04/05/2016 20:47

Sounds totally dodgy, sorry.

Do you pay tax? Employer has to give you paid leave!

Natkingcole9 · 04/05/2016 20:48

It is dodgy and I'm fed up! Looking for advice on what I can do. So far I just take time off when I can afford to do so, which isn't going to be much this year by the looks of it.

Yes my friend has this problem. His boss absolutely won't ever let him have any time off because they wouldn't be able to cope. It makes me Angry.
It's not legal but I don't know how they get away with it.
