Phase transfer help needed

Hi there. DS is approaching a phase transfer (16+) but we can't get the LA to complete the AR of his EHCP. Have complained to LA, but got nowhere. Haven't had anything back from them at all. Can anyone help suggest where we go next?

Do you mean DS is now in Y11? If so, email the Director of Children’s Services using one of IPSEA’s model letters. If that doesn’t work email again threatening judicial review. Then, if that fails, you need a pre-action letter. The LA should finalise the amended EHCP by the 31st.

If you have already emailed the Director of Children’s Services you don’t need to repeat the first step and if you have already warned them you will pursue JR you don’t need to redo that either.

Thanks for the reply. Yes, Yr 11. Have emailed Director of Children's Services using IPSEA template letter, which was acknowledged, but that's all. Have formally complained through the LA complaints procedure, but they haven't responded to that. SENCO has also messaged. Do you have any idea how much a pre-action letter would cost? We haven't seen draft amendments yet, let alone finalised. Easter weekend means they definitely won't be meeting 31st deadline now.

Email threatening JR. If that doesn’t work contact SOSSEN. Their PAP Project is free and covers LAs not sticking to the timescales following ARs (since you mention you haven’t even had the draft yet I presume you have had the meeting?) and phase transfers. If they can’t help for free it costs £145 via them. The costs from elsewhere varies from £5/600ish upwards. If you are eligible for legal aid that can also cover pre-action letters.
