Nursery rejection

Has anyone had their child hours in nursery reduced on the base that the nursery can't meet a child needs. This happened to my children at a public nursery in Daventry. I don.t know how to fight this.They suggested a private nursery would suit better, but it is in too short notice and no place available close to me.Thank you.

What reasonable adjustments has the nursery made? Have they requested an EHCNA? Asked the Area SENCO for advice?

Is the nursery a nursery class attached to a school?

The SENCO applied for Ehcp for the children. They are 3 and 4 years old. The nursery is attached to the school. The only measure they took was to separate the children in two shifts, so they reduced to 3 hours their program, the boy in the morning and the girl in the afternoon. I am on the coming and going with the children as i don't have anyone to watch them. The excuse school gave me is the fact that they are a public school and they are not fit to meet their needs. I mention that the children are not so bad, especially the girl who started to talk, and they are usually friendly. They force me into this because i am working from home as self-employed, and i can probably be available to watch them.I also find it's a discrimination as they have one child with additional needs but won't keep mine also.

A lot of people advised me to ho at the public nursery, saying it will make the transition easier to the school, but nobody has warned me that a public school will fail to offer hole support to children with additional needs. I will make all i can to warn other parents with Send children to think twice before going to a public school,as it seems not to be the best for them.

Where in the EHCP process are you?

By public school do you mean a state school? In England, public schools are independent schools. 

If you mean a nursery that is part of a state school, the exclusion guidance applies - see here. The school should not be excluding like they are. Complain to the HT.

Hi,the nursery is part of a state school. I made a complaint to HT.I should receive a reply by tomorrow .Thank you for sharing this information.

If the complaint to the HT doesn’t work, go to the governing body. It is also worth raising with the LA.

Hi, I'm so sad to see my complaint has not had any results. The school said they don't have the obligation to offer me a place in nursery, and because their application for Ehcp is just at the beginning, they have to wait to receive it, and with this to receive funds for additional needs for the children. So i am punished to struggle to have the children in different shifts. The system doesn't care about the parents with send children,they put you more deep into the hole. I wasn't aware of what can happen if you go to a state school with send children. I'll try to warn other parents ,as it can destroy you.

Complain to the governors. Read the exclusion and suspension guidance I linked to. If this is a nursery that is part of a state school that guidance applies and they cannot just informally exclude like this.

Have EHCNAs request actually been submitted to the LA? Has the school applied for early years inclusion funding - they don’t need EHCPs for this?

Hi,thank you so much for your support. Today, i had an online meeting with our designated Send support and with the school person who deals with Send matters. They said the school have to wait for the funds,and it might take a couple of months. Until then, they can't meet the children needs for 6 hours a day. Probably by the time they receive the funds, it's summer .The girl should go to reception, but also warn me she might not be prepared.I did tell them she needs all the time she can get to progress, and they ignored it.My partner said to accept we choose wrong nursery and to move on.We will try to move house in the summer and to look for an area were we have more possibilities. It is more on us now to prepare the children for school, we will try our best.

The LA will tell you what they want you to believe. The school can apply for early years inclusion funding now they don’t need to wait for an EHCP.

The school applied for the early years, including funds for the boy. They say my girl Cristina might not meet the criteria for the funds, as she's doing better. Because they reduced the hours to 3 they have to aplly for funds for only 3 hours now. I have the feeling they want to keep it to 3 hours by the end of the year.The previous nursery, which was a private nursery, did a referral for the girl in june last year, but the new nursery said that it got lost in the system and never got to them.I was very happy with the previous nursery ,but unfortunately they moved 40 minutes away, and i don't drive.All this happened as we didn't had much knowledge about this things and waited for other people to look for ours children interest.

Unfortunately, you need to be pro-active. IPSEA and SOSSEN are good places to start to learn about the SEN system. Push back on the school and LA, they don’t have to wait months for additional funding. It doesn’t have to be limited to 3hrs.

Check if your LA has early years specialist assessment places for those going through the EHCP process.

I am on this boat currently. Child being dropped from 30 to 15 with immediate effect.
Early years have olly just assessed and finding is in the process. I am so down right now

I know it is hard,look for advice, and for help from charities, i found someone who is very dedicated ,Enfold from Northampton. They have vast knowledge , and some of them have been at some point in our situation and know how to deal with this kind of problem.
