Hi there, just need to clarify this with those in the know:
I own a first floor flat with 50% of the freehold, as does the landlord down stairs.
I do not wish him to leave his advertising board 365 days of the year in the communal front garden and have removed it a number of times!
Things have come to a head now, and I need to find out where I stand legally as he is threatening to take me to court for removal of said board
As far as I can see from my research on the internet is that as I am part owner of the communal area I have a right in what goes on in said area.
Can he legally leave it up, as normally it should be removed after 14 days of the new tenant moving in, the current tenant has been in there for over a year and he is just using it as an advertising tool rather than trying to fill the property. (I would feel quite differently if he was trying to sell the property, and agree with the board being placed in the garrden)
I feel quite strongly about this as the flat is my home, and I maintain it to a high standard and in my opinion the board makes it look trashy.
Can anyone answer my questions or is it a really obscure area?
