Appeal - primary school - distance - help

Hi all, my son didn't get his first choice which is a real pain. He's been going to the nursery which sits in the school since two and my youngest will also be attending there when he is two. I've been doing some research as to see if I can appeal. I found out one child got into the school who lives further away than me and doesn't even attend the nursery. There is no linkage from the nursery but it does say it should go on distance (straight line). Anyone got any tips?

Probably also worth adding that even if the OP does prove a mistake was made it may not be her child that gets the place. It should be the child who should have got the place in the first place.

You need to be able to show that a mistake was made and that if the mistake hadn't been made you would have got the place.

The OP is correct that any of the suggested reasons why this child might be in a higher category eg SEN statement, looked after etc would probably mean that they would have got their 1st choice not their 2nd - unless their SEN statement said "these needs can only be met by school A or school B" in which case it might be possible for the LEA to assign then to school B.

It does seem possible that a mistake has been made. If the mistake was a mismeasurement of your distance you may get a place on appeal. If the mistake was a mismeasurement of the other child's distance then you are unlikely to get a place as there could be dozens of other applicants who are also closer than that child.

Do not cite anything to do with nursery attendance or convenience for drop-off and pickup time in your appeal. They are irrelevant and including them will make your whole case less credible.
