Now trans and gay hate crime will mean SIX months in jail after judges are ordered to crack down with harsher sentences than those that are given for domestic burglaries

  • Figures revealed that transgender hate crimes up 37 per cent on the year before
  • Sentencing Council denies the guideline is 'politically influenced or motivated'

    Offenders found guilty of stirring up hatred on the grounds of sexuality should get at least six months in prison, new sentencing guidelines state.

    And there should be a six-year jail sentence for those convicted of the worst cases of intolerance against gay or transgender people.”

    I have read the stats. from the Mail and although I’m not a statistician, these numbers look skewed?

    And I’ve read the PDF from the sentencing council, and (I’m or lawyer) none of this looks good for free speech, and a lot like compelled speech.

    Am I missing something or is our language now policed?

Bump - I really want to understand if I’ve misunderstood the sentencing council PDF - specifically from page 33, because by my reading this could impact use of pronouns, etc, on sites like Mumsnet / twitter / Spinster.

As has been mentioned on other threads, it looks as if the DM has misinterpreted the new guidelines, which specifically relate to

Offences relating to stirring up racial or religious hatred and hatred based on sexual orientation

No mention of gender identity, disability or any other of the protected characteristics.

I've experienced homophobic and trans phobic hate crime.

It's not as simple as one crime is a hate crime.

It's an aggravating factor. For example, the person being investigated because of us has made several harassing phone calls to friends, outing us and then flying into a rage when it didn't turn them against us, she stole items to use as proof to out us at the kids school and our local pub, she has obtained pictures and forwarded them around to out and humiliate us.

This is just the tip of the iceberg and has been going on for nearly 2 years including explicit evidenced blackmail.

None of this will be charged as a hate crime. CPS COULD and only COULD add it as an aggravating factor if its accepted that she would not behave in the same manner towards someone who was not homosexual or transgender.

I suspect these guidelines would only be able to be used in larger scale crimes, organised criminal groups and such. I mean. The DM would never publish poorly interpreted horseshit.

Also could be some interesting cases brought agaisnt anyone who protests against lesbians like what happened to the lesbian strength march in Leeds.
Certainly a homophobic hate crime
