this morning my hv phoned to tell me to apply for dla as i have a diagnosis for AS. I told her that i applied for dla in april 05 for depression anxiety attacks etc but that i was turned down, i have since appealed and am waiting for an answer. She said put a new claim in but surely if i do that i wont get an appeal and if i win my appeal i,ll lose all those weeks that i have been waiting. Someone else told me that if your appeal is sucessful you only get backpayment of 12 weeks max but i have been waiting over 4 months since i first applied can someone shed light on this for me as i am totally confused

The backpayment of 3 mths is not true.
My claim took 9 mths to sort and I was backpaid the 9 mths.
can't decide / not sure if good idea to put in new claim - why don't you find out what stage, your old claim is at ?

when DLA is awarded, the payment is backdated to the date you first claimed (first asked for the forms to be sent, as long as you returned them within 6 weeks).

If your appeal is successful, you should get backdate to your original application date.

Ring the DLA number, and speak to someone there about the new information you have, but don't put in a new claim yet.

just phoned them,they were about to write to my consultant at the hospital but when i told them that i now have an official diagnosis the lady said "right i,ll fax this through straightaway" dont know what that means

If your claim is backdated to April, you could get a nice neat little sum.
