and for the 3rd time we have WON!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

that's 4 tribunal wins in 2 years!

knew we had a strong case but still...............

thank you so much to everyone on here who held our hand through this journey even when at times we felt like we could never win.

our dd will now be going to an indie dyslexia boarding school in sept - such a shame we have had to appeal at every stage and the saddest part is that she is even more behind now than when we started the journey to get her statemented 18 months ago.

Fantastic! The LA's case always sounded bloody ludicrous, they really shouldn't have wasted everyone's time by pursuing it.

Was the decision based on the costs of the respective placements, or the fact that their school couldn't meet dd's needs? Or both?

not going for costs again as the judgement sort of paints the LA in a good light - even commending them for going to visit our school just 2 days before the hearing!!

the judge was not an easy one this time and gave us absolute hell despite the overwhelming amount of evidence and the no evidence at all from the LA.

we won on costs as our placement cheaper but also as they ruled the LA school also couldn't meet her needs.

they ruled that having on an onsite SALT was not needed which I had expected and that wasn't the basis of my appeal anyway. they also agreed that she needed specialist teaching by qualified spld teachers not teacher who just have experience ie don't hold the spld qualification so the LA argument about why the wouldn't concede (as they felt costs could go down in future years) shows that argument now blown out of the water as the only way the costs can go is up!

overall the judgement isn't damning of the LA, they question her asd dx (great!) but we won and that's all that matters
